HomeMy WebLinkAboutR-24-0198City of Miami Resolution R-24-0198 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16020 Final Action Date: 5/23/2024 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), REJECTING THE SOLE RESPONSIVE AND RESPONSIBLE BID AND ALL OTHER BIDS RECEIVED FEBRUARY 6, 2024, PURSUANT TO INVITATION TO BID ("ITB") NO. 23-24-009 AND SECTION 29-B OF THE CHARTER OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CHARTER"), FOR THE SALE OF CITY OF MIAMI ("CITY") SURPLUS VACANT LAND LOCATED AT 2200 SOUTHWEST 9TH AVENUE, MIAMI, FLORIDA ("PROPERTY"); AUTHORIZING THE CITY MANAGER TO PREPARE AND ISSUE A NEW ITB IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS MAY BE DEEMED NECESSARY FOR THE SALE OF THE PROPERTY. WHEREAS, the City of Miami ("City") is the fee simple owner of real property located at 2200 Southwest 9th Avenue, Miami, Florida ("Property"); and WHEREAS, on November 3, 2023, the City issued Invitation To Bid ("ITB") No. 23-24- 009 for the sale of the Property to the highest paying responsive and responsible bidder, under full and open competition; and WHERAS, the minimum bid requirement amount of Six Hundred Twenty Seven Thousand Dollars ($627,000.00) for the Property was set above the average market value of the two (2) appraisals obtained by the City from licensed State of Florida certified appraisers; and WHEREAS, on February 6, 2023, one (1) responsive and responsible bid was received from Goulds Investment Group LLC, a Florida limited liability company ("Sole Bidder"), totaling Seven Hundred Fifty -Five Thousand Dollars ($755,000.00); and WHEREAS, pursuant to Section 29-B of the Charter of the City of Miami, Florida, as amended ("City Charter"), "there shall have been at least three (3) written proposals received from prospective purchasers or lessees; however, if there are less than three (3) such proposals received and if the guaranteed return under the proposal whose acceptance is being considered is equal to fair market value the City Commission determines that the contemplated sale or lease will be in the City's best interest then, subject to the approval of a majority of the votes cast by the electorate at a referendum, the sale or lease may be consummated"; and WHEREAS, due to the substantial cost of a referendum, the City Commission desires to reject the sole responsive and responsible bid and all other bids received for the sale of the Property; and WHEREAS, the City Manager recommends the preparation and issuance of a new ITB for the sale of the Property, as indicated on the Recommendation Memo signed by the City Manager, attached and incorporated hereto as Exhibit "A"; City of Miami Page 1 of 2 File ID: 16020 (Revision:) Printed On: 7/29/2025 File ID: 16020 Enactment Number: R-24-0198 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The sole responsive and responsible bid and all other bids received February 6, 2024, pursuant to ITB No. 23-24-009 and Section 29-B of the City Charter, for the sale of the Property, are hereby rejected. Section 3. The City Manager is hereby authorized' to prepare and issue a new ITB in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for the sale of the Property. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: rge Wy ng III, C ty ttor -y 5/14/2024 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
