John Crabtree is the managing partner of Crabtree, Auslander & Tackenberg—a
Miami -based appellate law firm with a national practice. He is an elected member of
the American Law Institute and board certified in appellate practice by The Flonda
Bar. He currently serves as one of two U.S. representatives on the Class Action
Committee for the International Bar Association His cases have been featured in the
national media, including The Wall Street Journal. the New York Times, the Chicago
Tribune and The National Law Journal. He has received Martindale -Hubbell's highest
rating and is named in the current editions of Best Lawyers in America and Florida
Super Lawyers.
John has handled over 200 civil appeals before state and federal appellate courts --
including oral argument before the Supreme Court of the United States. He has also
represented various amici curiae, and wrote an amicus brief in the landmark age
discrimination case Smith v. City of Jackson. presenting a novel textual argument that
the Supreme Court used in its decision.
John has represented both plaintiffs and corporate defendants in dozens of class
actions over the past 30 years. He was lead counsel for the drivers in the only class
action Uber has ever lost on the merits. He served on the ALI's Members Consultative
Group for the class action treatise, "Principles of the Law of Aggregate Litigation."
By appointment of successive presidents of The Florida Bar. John served two terms as
chair of Florida's Appellate Court Rules Committee —the committee that drafts the
rules governing Florida's appellate courts. By appointment, he also chaired the
Appellate Certification Committee —the Bar committee that evaluates, tests, and
board -certifies lawyers as appellate specialists in Florida. By election of his peers,
John chaired the Bar's 1400-member Appellate Practice Section.
John has lectured and written on a range of appellate and class action topics, and he
has served as a consultant and as an expert witness in the area of appellate practice.
He is the author of The Material Difference in Florida Contract Law, Fla. B.J., March
2016, an article on Florida's anomalous breach -of -contract law. He is also the
continuing author of both "Civil Appeals" and "The Record on Appeal - Civil
Appeals," two chapters in the Bar's Florida Appellate Practice treatise.
Apart from his law practice• John co-founded VaxCare, the leading provider of
vaccine dispensing technology in the U.S. He is also the U.S. patent holder for a
LIDAR-based biometric technology that matches consumers with best -fitting
products.

Councilmember London made a motion to approve the resolution. The motion was seconded by
Councilmember Sardinas.
T e Attorney addressed the Council regarding the quasi-judicial hearing procedure and all
witnesses giving testimony were sworn in by the Clerk.

Director Calleros Gauger addressed the Council regarding the above resolution, waiving
the requirement for the articulation on the facade, and that the variance would be tied to
the site plan.

The Mayor opened the public hearing. There were no speakers present. The Mayor
closed the public hearing.
The resolution was approved by a 6-0 voice vote. The vote was as follows: Councilmembers
Caplan, London, Moss, Sardifias, Vazquez, and Mayor Rasco voting Yes.

REPORTS AND RECOMMENDATIONS:
The following items were discussed:
Village Manager. This item was addressed earlier in the evening and the CIP update report was
provided in the agenda.
Mayor and Councilmembers: Councilmember Moss addressed the Council regarding confirming
the date for the Council Workshop regarding Zone 1's stormwater level of service which will be
held on March 20, 2024 at 6:00 p.m. in the Council Chamber.
Mayor Rasco appointed John Crabtree to serve as the Key Biscayne representative on the City of
Miami's Virginia Key Advisory Board. It was the consensus of Council to confirm this
appointment.
Mayor Rasco appointed Daisy Fuentes to serve on the Village's Education Advisory Board. It was
the Consensus of Council to confirm this appointment.
Councilmember London addressed the Council regarding converting the Council Chamber into a
multipurpose room to be used as a Council Chamber and a lecture space or movie theater.
There was discussion from Council, the Manager, and Director Calleros Gauger regarding
converting the Council Chamber into a multi -purpose room and the design of the multi -purpose
rooms for the new library. It was the consensus of Council for Councilmember London to be the
liaison on this item and meet with the Key Biscayne Film Festival group along with Director
Hofferberth and look into what component programming would be needed for a possible
conversion. The Manager will speak with Miami -Dade Public Library System Director Ray Baker
regarding the design of the multi -purpose rooms at the new library.
