Dear Ms. Hull:
This law firm represents the owners of the referenced
properties, Y and Y LeJeune, LLC and Y and Y S Miami, LLC (the
"Applicants"). This letter shall serve as the Applicants' letter of
intent in support of a rezoning of the properties described herein.
Property. The Property is approximately 41,135 square feet
in size and is located along the west side of LeJeune Road (NW 42nd
Avenue) between NW 2nd Street and NW 2nd Terrace. The Property
is comprised of six (6) lots with two (2) different land use
designations and two (2) different zoning transects.

The proposed re -designation to Low Density Restricted Commercial will provide a more
transitional designation that will serve to ensure that any potential uses or development in the
Restricted Commercial area along LeJeune Road will remain compatible with the less intense
areas to the west.
Zoning. The Property is zoned both T6-8-O and T3-O. See Figure 2 below. The T6-8-O
portion of the Property is approximately 27,635 square feet and is developed with a restaurant,
at the corner of NW 2nd Street and LeJuene Road and there is a small office building at the corner
of NW 2nd Terrace and Lejeune Road.

Article 7, Section 7.1.2.8(c), Miami 21 states that a rezoning of land will only be considered
where the proposal involves an extension of an existing transect boundary, unless the rezoning
involves at least 40,000 square feet of land area or 200 feet of street frontage on one street. In
the present case, the Property meets the second criteria as it exceeds 40,000 square feet. Thus,
the Applicants' requested zoning change is consistent with successional rezoning requirement.
Analysis. Article 7, Section 7.1.2.8(f) of Miami 21 provides the criteria for amendments to
Miami 21. The provision provides as follows "[f]or all amendments:
(a) The relationship of the proposed amendment to the goals, objectives and policies
of the Comprehensive Plan, with appropriate consideration as to whether the proposed change
will further the goals, objectives and policies of the Comprehensive Plan; the Miami 21 Code; and
other city regulations.
(b) The need and justification for the proposed change, including changed or
changing conditions that make the passage of the proposed change necessary."
In the present case, the proposed amendment is consistent with the goals, objectives and
policies of the MCNP for the following reasons:
The approval of the rezoning would further Goal LU-1 (5), which promotes land use
patterns that promote the efficient use of land, and minimize land use conflicts, while protecting
and preserving residential sections within neighborhoods. The T-3 0 portion of the Property is
partially developed with surface parking and partially vacant. There is presently no residential
development on the Property and the rezoning would allow this area to be further utilized for

The rezoning to T4-O would allow additional parking to serve the T6-8-O zoned
development. As a result, there would be a reduced demand for on -street commercial parking
in front of the homes along NW 2nd Terrace and NW 2nd Street. This would minimize land use
conflicts while helping to preserve the residential section of the neighborhood.
In addition, the proposed rezoning would accommodate the potential redevelopment between
the T6-8 0 area and the homes to the west with development that is more transitional in terms
of density and scale than the current T3-0 zoning. Thus, the rezoning would allow a more
efficient use of land, while simultaneously minimizing potential land use conflicts with lower
density residential areas.
Maintaining the Property's T3-0 zoning would fail to recognize that the Property has not
been developed with T3-0 uses in the recent past and that T3-0 uses are less compatible with
the abutting T6 area than T4-0 uses.
The Applicants' request to rezone the T6-8-0 portion of the Property to T6-8-L is
supported by the fact that T6-8-L is more restrictive with respect to potential uses that may be
allowed. The proposed T6-8-L would not allow certain potential incompatible uses allowed by
Exception such as Large Scale Retail, Gambling Facilities, and Amusement Rides. In addition, drive
thru uses are not permitted in T6-8-L.

Changed Conditions. LeJeune Road in this area has experienced growth i
as it is one of the principal Transit Corridors leading to the growing Miami Internation
area. The Florida Department of Transportation has also made significant improvements to
LeJeune Road in recent years that have beautified the area and improved traffic flow on the
street. In addition, Miami Freedom Park, a 25,000 seat soccer stadium with ancillary uses, was
recently approved by the City Commission for this area. This stadium will be located less than 2
miles north of the Property on the east side of LeJeune Road and it is anticipated that the stadium
will bring more residents and businesses to the general area.
In addition, there are existing physical changes such as the Keystone multi -family
residential tower that was developed in 2017 on the T6-8-O land to the south, immediately
across from the Property (See below).

The proposed re -designation to Low Density Restricted Commercial and
corresponding rezoning to T4-O will provide a similar, more transitional designation than
the current Duplex Residential designation that will serve to ensure that any potential uses
or development in the Restricted Commercial portion of the Property along LeJeune Road
will remain compatible with the less intense Duplex Residential areas to the west.
The Applicant believes that the proposed Low Density Restricted Commercial
designation would be more reflective of the increasingly transitional character of the
Property that has resulted from the new development in the area. LeJeune Road in this
area has experienced growth in recent years as it is one of the principal Transit Corridors
leading to the growing Miami International Airport area.
The Florida Department of Transportation has also made significant improvements
to LeJeune Road in recent years that have beautified the area and improved traffic flow
on the street. In addition, Miami Freedom Park, a 25,000 seat soccer stadium with ancillary
uses, was recently approved by the City Commission for this area. This stadium will be
located less than 2 miles north of the Property on the east side of LeJeune Road and it is
anticipated that the stadium will bring more residents and businesses to the general area.
In addition, there are physical changes immediately abutting the Property such as
the Keystone multi -family residential tower at 190 NW 42 Avenue that was developed in
2017 on the T6-8-O land to the south, across from the Property.

The approval of the land use change and rezoning would further Goal LU-1 (5),
which promotes land use patterns that promote the efficient use of land, and minimize
land use conflicts, while protecting and preserving residential sections within
neighborhoods. The T-3 0 portion of the Property is partially developed with surface
