AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
40/ARTICLE III OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, TITLED "PERSONNEL/CIVIL SERVICE RULES AND
REGULATIONS," BY AMENDING SECTION 40-108 OF THE CITY CODE,
TITLED "PERSONAL LEAVE," ADDING REFERENCE TO INDIGENOUS
PEOPLES' DAY; CONTAINING A SEVERABILITY CLAUSE; PROVIDING FOR
AN IMMEDIATE EFFECTIVE DATE.

WHEREAS, pursuant to Resolution No. R-23-0435, adopted on September 28, 2023,
the City Commission recognized the second Monday of October every year as both "Columbus
Day" and "Indigenous Peoples' Day"; and
WHEREAS, such Resolution further directed the City Manager to bring forth future
legislation amending Section 40-108 of the Code of the City of Miami, Florida, as amended
("City Code"), to make reference to both "Columbus Day" and "Indigenous Peoples' Day"; and
WHEREAS, Section 40-108 of the City Code only mentions "Columbus Day" and does
not mention "Indigenous Peoples' Day";
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 40 of the City Code is further amended in the following particulars:1

Sec. 40-108. Personal leave

(a) National holidays. The following and any other days designated by the city commission
or under its authority are holidays: New Year's Day, Washington's Birthday, Memorial
Day, Independence Day, Labor Day, Columbus Day/Indigenous Peoples' Day, Armistice
Day, Thanksgiving Day, and Christmas Day. Compensatory time off shall be allowed for
work done on these days. When a holiday falls on the regularly assigned day off for an
employee, such employee shall be compensated by another day off. In order to be
eligible for holiday pay, the employee must be in "with pay" status on the working day
preceding and the working day following the subject holiday.

Section 3. If any section, part of section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective immediately after final reading and
adoption thereof.2

2 This Ordinance(s) shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
