A RESOLUTION OF THE MIAMI CITY COMMISSION PROHIBITING ANY
FUTURE PAYMENT OF ANY ATTORNEY FEES OR COMPENSATION TO
COUNSEL HIRED TO REPRESENT FORMER COMMISSIONER ALEX DIAZ
DE LA PORTILLA IN HIS CAPACITY AS A CITY OF MIAMI COMMISSIONER.

WHEREAS, Section 111.07, Florida Statutes, authorizes the City of Miami ("City") to
defend any civil action arising from a complaint for damages or injury suffered as a result of any
act or omission of action of any of its officers, employees, or agents for an act or omission
arising out of and in the scope of his or her employment or function; and
WHEREAS, the City of Miami retained services of counsel for former Commission Alex
Diaz de la Portilla in civil actions filed while he was an elected official of the City of Miami,
Florida, in accordance with Section 111.07 Florida Statutes; and
WHEREAS, pursuant to Section 111.07 Florida Statutes, the upfront payment for the
defense of a City Commissioner is discretionary; and
WHEREAS, the civil cases of record at this time are: Acevedo, Hubert vs. City of Miami,
et al., Court Case No. 22-CV-20224-KMW, Manuel Prieguez v. Alex Diaz de la Portilla, et al.,
Court Case No. 23-22431, and a matter before the Miami -Dade Commission on Ethics;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. The City Commission hereby directs the City Manager to cease any further
upfront payment of monies or compensation to any counsel retained or to be retained by former
Commissioner Alex Diaz de la Portilla for civil actions filed against him for acts committed while
he was an elected official of the City of Miami, Florida, from this day forward.
Section 3. This Resolution shall become effective immediately upon adoption.
