NOTICE OF PUBLIC HEARING
The Miami City Commission will hold a Public Hearing on Thursday,
March 14, 2024, at 9:00 A.M., to consider the award of a contract to the
Florida Not for Profit listed below through MB-Poverty grant funds from
the Distncl 5's share of the City of Mlamrs MD -Poverty Initiative Program.
Foundation of Community Assistance and Leadership. Inc., a Florida Not
for Profit Corporation, and to consider the City Manager's recommendations
and finding that competitive negotiation methods are not practicable or
advantageous regarding these Issues:
• Foundation of Community Assistance and Leadership, Inc. — FOCAL
Moore Park Learning Center
Inquiries regarding this notice may be addressed to Melissa T. Sutherland,
Administrative Assistant II, Office of Grants Administration, at (305) 416-1005.
This action is being considered pursuant to Section 18-85 (A) of the Code of
the City of Miami, Florida as amended )the 'Code'). The recommendations
and findings to be considered in this matter are set forth in the proposed
resolution and in Code Section 18-85 (A), which are deemed to be incorporated
by reference herein and are available as with the regularly scheduled City
Commission meeting of March 14. 2024, at Miami City Hall, 3500 Pan
American Drive, Miami, Florida.
The Miami City Commission requests all interested parties be present or
represented at the meeting and may be heard with respect to any proposition
before the City Commission in which the City Commission may take action.
Should any person desire to appeal any decision of the City Commission with
respect to any matter to be considered at this meeting, that person shall ensure
that a verbatim record of the proceedings is made including all testimony and
evidence upon which any appeal may be based (F.S. 286.0105).
Pursuant to Miami City Code Section 2-33(0), whenever a scheduled City
Commission meeting is cancelled or is not held due to a lack of a quorum or
other emergency, a special City Commission meeting will be automatically
scheduled for the Tuesday immediately following the cancelled meeting. In the
event of one of the aforementioned circumstances. the special meeting would
be held on March 19, 2024, at 9:00 a.m. in the City Commission chambers
located at Miami City Hall, 3500 Pan American Drive. Miami, Florida 33133. All
of the scheduled agenda items from that cancelled meeting shall automatically
be scheduled as an agenda item at the specal City Commission meeting.
The City Clerk shall notify the public of the special meeting that is to take
place by placing a notice of the special City Commission meeting at the
enhance of City Hall and the City's main administrative buiktmg, placing a
notice on the City's website, and, it feasible, placing an ad in a newspaper of
general circulation before the special meeting on the immediately following
Tuesday. There shall be no additional notice by publication required for any
such scheduled agenda item that is moved to the special City Commission
meeting.
In accordance with the Arnencans with Disabilities Act of 1990, persons
needing special accommodations to participate in this proceeding may
contact the Office of the City Clerk at (305) 250-5361 (Voice) no later than
five (5) business days prior to the proceeding. TTY users may call via

FIFTHS AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBUC HEARING, RATIFYING.
APPROVING, AND CONFIRMING THE CITY MANAGER'S RECOMMENDATION AND

PROCEDURES; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE
A REVOCABLE LICENSE AGREEMENT (-LICENSE"). IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, BETWEEN THE CRY OF MIAMI ('CITY') AND BOTECH MARINE
CENTER, INC. 1'LJCENSEE'1 FOR THE LICENSEE'S USE OF PORTION OF CRY OWNED
PROPERTY LOCATED AT 3501 RICKENBACKER CAUSEWAY. MIAMI. FLORIDA 33149
FOR THE PURPOSE OF OPERATING A BOAT REPAIR AND MAINTENANCE BUSINESS,
INCLUDING SERVICING AND CARE OF BOATS, BOAT ENGINES AND SYSTEMS FOR
A MONTHLY USE FEE OF FOUR THOUSAND TWO HUNDRED FIFTY-TWO DOLLARS
AND FFI7Y CENTS ($4,252.50.) PLUS TAXES, WHICH COMPRISES A REPAIR SHOP
('AREA 1') AND BOAT DOCK RACKS AREA ('AREA 2'), COLLECTIVELY REFERRED

Richard Hibey, defense lawyer in cases
of international intrigue, dies at 82

Richard Hibey, a Wash-
ington defense lawyer
whose courtroom flair
and international ex-
pertise attracted clients of
infamy and intrigue, in-
cluding ousted Philippines
autocrat Ferdinand Mar-
os and Jonathan Pol-
lard,the Navy intelligence
analyst who leaked U.S.
secrets to Israel, died Feb.
19 at his home in Wash-
ington. He was 82.
His son David Hibey
confirmed the death but
gave no specific cause.
Hibey (pronounced
HIGH -bee) built a reputa-
tion as an artful legal
strategist in high -profile
cases that were tried as
much before jurors as in
the court of public opin-
ion.During the 1980s and
'90s, he was drawn into
me of the biggest in-
ternational dramas, in-
cluding Pollard', espion-
age case and allegations
that Marcos and wife,
Imelda, looted a fortune
from the Philippines. He
also represented Claw E.
George, a former chief of
the CIA's clandestine
service who was
used
of making falsestate-
menu to Congress about
the Inncontra scandal,
which involved covert
American arm sales to
Inn to fund anti -leftist
rebels in Nicaragua.
In the American Bar
Association journal Litiga-
tion in 1991, Hibey de-
scribed himself as a legal
"gunslinger." That kind of
confidence, he said, was
what his clients needed.
"The administration of
justice in this country is
predicated on an adver-
sary process," he said. "1
figure if 1 do my end well,
then justice will be
served. I think that is a
moral position and it
allows me to be able to
represent people who are
considered by others to be
among the sleaze bags of
the 20th century."
Hibey never adopted
the public swagger of
some other big -name
defense lawyers such as F.
Lee Batley or William
Kunstler. Instead, Hibey
cautiously discussed the
facts of a case with jour-
nalists and meticulously
avoided comments that
he felt could give the
prosecution an edge.
"I have no deep ide-
ological convictions that
bring me here," he once
said. "1 view myself, first
and foremost, as a trial
lawyer."
During the 1992 trial of
George, Hibey tried to
portray the chief witness,
another ex -CIA official, as
the real concealer of facts
from the Reagan -era
operation.
Alan Fiers had pleaded
guilty to withholding
information from Con-

Hibey asked Fiers on the
witness stand in U.S.
District Court in Wash-
ington.
"It was not a we state-
ment," he said.
"It was, therefore, a
lie," Hibey pressed.
"1t was not a we state-
ment," Fiers repeated.
Hibey snapped back:
"Do you have difficulty
with the word' lie'?"
The trial ended in a
hung jury in August 1992.
On retrial, George was
convicted but was par-
ed by President
George H.W. Bush before
sentencing. (Also par-
doned were Fiers, former
defense secretary Caspar
W. Weinberger and sever-
al others implicated in
lran onto.)
During the legal saga
with the Marcoses — who
Bed the Philippines in
1986 after an uprising
brought Corazon Aquino
to power — Hibey repre-
sented the couple while
lawyers for the new Phi-
lippine government
probed allegations of
massive personal graft
during two decades of
Marco ride.
Inc 1986 deposition at
the Marco villa in Hono-
lulu, Ferdinand Marcos
replied 197 times: "I claim
the tight against self-
incrimination and the
right to remain silent." In

meetings with reporters
Marcos and his wife
were indicted in 1988 on
racketeering charges by a
federal grand jury in New
York. accused of siphon-
ing more than S100 mil-
lion in cash and assets
from the Philippines. The
disgraced Philippine lead-
er died in September 1989
before standing Mal

1990, Hibey withdrew
from the case over pos-
sible conflicts of interest.
Prosecutors planned to
call one of his legal part-
ners, Stanton Anderson,
as a witness over taped
phone calls with a Marcos
associate. Imelda Marco
was acquitted in July
1990.
With Pollard, Hibey
negotiated a guilty plea
for the former Navy
counterterrorism analyst,
who was arrested in 1985
n charges of passing
secrets to Israel that in-
cluded details on people
who had cooperated with
U.S. intelligence agencies.
Under the plea deal, Pol-
lard was to receive a re-
duced sentence in ex-
change for cooperating
with investigators.
Pollard, however, re-
peatedly violated the
arrangement by making
public statements, in-
cluding granting inter-
views to Israeli media and
others. His then -wife,
Anne Henderson -Pollard,
told "60 Minutes" that
the couple had no regrets
about passing classified
documents to Israel.
"I was really apoplec-
tic," Hibey recalled in a
2023 oral history for the
D.C. District Court's
historical society, "be-
cause it had undone what
was to be at the essence
of my plea for mercy."
Pollard was sentenced
to life in prison in March
1987. (Henderson -Pollard
received two concurrent
five-year prison sentenc-
es.) Pollard was released
from custody in 2015, and
he immigrated to Israel
five yeah later. While in
prison, Pollard fled cant
papers asserting that
Hibey provided "inade-
quate and unprofessional
handling" of the sentenc-
ing phase.
Among Hibey's other
clients was CBS producer
Mary Mapes during an
independent investigation
into documents used in a
"60 Minutes Wednesday"
report in September 2004
on whether President
George W. Bush fulfilled
his Texas Air National
Guard obligations during
the Vietnam War. The
report, which prompted
Mapes's dismissal, said
the "60 Minutes" team
failed to authenticate the
documents. The story also
led to correspondent Dan
Rather's resignation.
The 2015 movie
"Troth" starred Cate
Blancher as Mapes and
Robert Redford as Rather.
Hibey was played by the
Australian actor Andrew
McFarlane.
The film begins with

the U.S. attomey's office
in Washington. In late
1969, he led the prose-
cution of Billie Austin
Bryant, who escaped from
federal prison in Virginia
and was charged with
killing two FBI agents
while on the run.
During the Mal, Hibey
remembered a detail from
wvestigators. Bryant,
hen handed the pistol
allegedly used in the kill-
ings, spun the gun around
his trigger finger. Hibey
gave the handgun to
Bryant on the witness
stand. He did the same
cocky twirl in full sight of
the jury. Bryant was con-
victed and sentenced to
two life sentences.
In 1972, Hibey entered
private practice and was a
partner in several law
firms. Hibey was lead
counsel fora U.S- Olym-
pic Committee probe into
the alleged bribery in the
awarding of the 2002
Winter Games to Salt
Lake City. A report in
1999 led to the expulsion
of six International Olym-
pic Committee members.
Hibey retired in 2017.
In addition to his sin
David, survivors include
Hibey's wife of 56 years,
the former Mary Ellen
Leary; mother son, Justin;
• sister, two brothers; and
three grandchildren.
Hibey described his
legal approach as trying to
pare a ca. down to its
simplest terms: disregard-
ing the ideology and back-
ground of a client and
figuring out what could be
done within the law.
"An unpopular client,"
he said, "nonetheless
deserved the best repre-
sentation that could be

Monday in the case about
whether toner President
Donald Trump can be
kicked off the ballot over
his efforts to undo his
defeat in the 2020 elec-
tion.
Trump is challenging a
groundbreaking decision
by the Colorado Supreme
Court that said he is dis-
qualified from being presi-
dent again and ineligible
for the state's primary,
which is Tuesday.
The resolution of the
case on Monday, a day
before Super Tuesday
contests in 16 states, would
remove uncertainty about
whether votes for Tnunp,
the leading Republican
candidate for president,
will ultimately count. Both
sides had requested fast
work by the court, which
heard arguments less than
a month ago, on Feb. 8.
The Colorado court was
the first to invoke a post -
Civil Warconstimtional
provision coed at prevent-
ing those who "engaged in
insurrection" from holding
office.
Trump also has since
been bared from primary
ballots to Illinois and
Maine, although both deci-
sions, along with Col-
orado's, are on hold pend-
ing the outcome of the
Supreme Court case.
The Supreme Court has
until now never ruled on
the provision, Section 3 of
the 14th amendment.
The court indicated
Sunday that at least one
case will be decided Mon-
day, adhering to its custom
of not saying which one.
But it also departed from
its usual practice in some
respects, heightening the
expectation that it is the
Trump ballot case derision
that will be handed down.
Except for when the end
of the term nears in late
June, the court almost
always issues decisions on
days when the justices are
scheduled to take the
bench.
But the next scheduled
court day isn't until March
15. And apart from during
the coronavhus pandemic
when the court was closed,
the justicer almost always
read summaries of their
opinions in the courtroom.
They won't be there Mon-
day.
Any opinions will be
posted on the court's web -
site beginning just after 10
a.m. Eastern time Monday.
Separately, the justices
last week agreed to hear
arguments in late April
over whether Tramp can
be criminally prosecuted
on election interference
charges, including over his
role in the Jan. 6, 2021,
attack on the US. Capitol.
The court's decision to step
into the politically charged
case, also with little in the
way of precedent to guide
it, calls into question
whether Trump will stand
trial before the November
election.
The former president
faces 91 criminal charges
in (our prosecutions. Of
those, the only one with a
trial date that seems poised
to hold is his state case in
New York, where he's
charged with falsifying
business records in
con-
nection with hush money
payments to a porn actor.
That case is set for trial on
March 25, and the judge
has signaled his determina-
tion to press ahead.

tion. Of course, resolution
requires concessions on all
sides," the Bahamian lead-

For months, the regional
bloc has been trying to get
Henry and political and
civil society leaders to
come to a power -sharing
agreement in the volatile
Caribbean country. last
month, thousands of Hai-
tians around the country
demanded the resignation
of Henry, reminding him
that he had promised to
step down from power on
Feb. 7, 2024. That prom-
ise, however, was con-
tingent on his holding
elections to turn power
over to a democratic gov
e eat.
Now Henry has made a
similar promise. The U.S.
and other nations have
acknowledged that the
security situation in Haiti
needs to improve before
elections can take place.
Despite a promise by Ken-
ya to lead an armed securi-
ty mission into Haiti, with
troops from several Carib-
bean and African nations,
the deployment has been
staged by a court ruling in
Nairobi that the deploy-
ment of 1,000 Kenyan
police officers would be
unconstitutional.
As Caribbean leaders
wrapped up their summit,
Henry was on his way to
Kenya at the invitation of
President William Ruro.

Ali, who chaired the CAR-
ICOM meeting, said the
issue of Haiti took up con-
siderable time. This in-
cludes at least 10 hours of
informal discussions on
top of "more than 15 hours
of work," he said.

NOTICE OF PUBLIC HEARING
The Miami City Commission will hold a Public Hearing on Thursday,
March 14, 2024, at 9:00 A.M., to consider the award of a contract to the
Florida Not for Profit listed below through Anti -Poverty grant funds from
the District 5's share of the City of Miami's Anti -Poverty Initiative Program.
Foundation of Community Assistance and Leadership, Inc., a Florida Not
for Profs Corporation, and to consider the City Manager's recommendations
and finding that competitive negotiation methods are not practicable or
advantageous regarding these issues:

This action is being considered pursuant to Section 18-85 (A) of the Code of
the City of Miami. Florida as amended (the "Code"). The recommendations
and findings to be considered in this matter are set forth in the proposed
resolution and in Code Section 18-85 (A), which are deemed to be incorporated
by reference herein and are available as with the regularly scheduled City
Commission meeting of March 14, 2024, at Miami City Hall. 3500 Pan
American Drive, Miami. Florida.
The Miami City Commission requests all interested parties be present or
represented at the meeting and may be heard with respect to any proposition
before the City Commission in which the City Commission may take action.
Should any person desire to appeal any decision of the City Commission with
respect to any matter to be considered at this meeting, that person shall ensure
that a verbatim record of the proceedings is made including all testimony and
evidence upon which any appeal may be based (F.S. 286.0105).
Pursuant to Miami City Code Section 2-33(o), whenever a scheduled City
Commission meeting is cancelled or is not held due to a lack of a quorum or
other emergency, a special City Commission meeting will be automatically
scheduled for the Tuesday immediately following the cancelled meeting. In the
event of one of the aforementioned circumstances, the special meeting would
be held on March 19, 2024, at 9:00 a.m. in the City Commission chambers
located at Miami City Hall, 3500 Pan American Drive, Miami, Florida 33133. All
of the scheduled agenda items from that cancelled meeting shall automatically
be scheduled as an agenda item at the special City Commission meeting.
The City Clerk shall notify the public of the special meeting that is to take
place by placing a notice of the special City Commission meeting at the
entrance of City Hall and the City's main administrative building. placing a
notice on the City's website. and, if feasible, placing an ad in a newspaper of
general circulation before the special meeting on the immediately following
Tuesday. There shall be no additional notice by publication required for any
such scheduled agenda item that is moved to the special City Commission
meeting.
In accordance with the Americans with Disabilities Act of 1990, persons
needing special accommodations to participate in this proceeding may

Richard Hibey, a Wash-
ington defense lawyer
whose courtroom flair
and international ex-
pertise attracted clients of
infamy and intrigue, in-
cluding ousted Philippines
autocrat Ferdinand Mar-
cos Jonathan Pol-
lard,the Navy intelligence
analyst who leaked U.S.
secrets to Israel, died Feb.
19 at his home in Wash-
ington. He was 82.
His son David Hibey
confirmed the death but
gave no specific cause.
Hibey (pronounced
HIGH -bee) built a reputa-
tion as an artful legal
strategist in high -profile
cases that were tried as
much before jurors as in
the court of public opin-
ion. During the 19803 and
'90s, he was dawn into
me of the biggest in-
ternational dramas, in-
cluding Pollard's espion-
age case and allegations
that Marcos and wife,
Imelda, looted a fortune
from the Philippines. He
also represented Clair E.
George, a former chief of
the CIA's clandestine
service who was
accused
of making false state-
ments to Congress about
the Inn -contra scandal,
which involved covert
American ann sales to
Iran to fund anti -leftist
rebels in Nicaragua.
In the American Bar
Association journal Litiga-
tion in 1991, Hibey de-
scribed himself as a legal
"gunslinger." That kind of
confidence, he said, was
what his clients needed.
"The administration of
justice in this country is
predicated on an adver-
sary process," he said. "I
figure if 1 do my end well,
then justice will be
served. I think that is a
moral position and it
allows me to be able to
represent people who are
considered by others to be
among the sleaze bags of
the 20th century."
Hibey never adopted
the public swagger of
some other big -name
defense lawyers such as F.
Lee Bailey or William
Kunstler. Instead, Hibey
cautiously discussed the
facts of a case with jour-
nalists and meticulously
avoided comments that
he felt could give the
prosecution an edge.
"1 have no deep ide-
ological convictions that
bring me here," he once
said. "1 view myself, lust
and foremost, as a trial
lawyer."
During the 1992 trial of
George, Hibey tried to
portray the chief witness,
another ex -CIA official, as
the real concealer of facts
from the Reagan -era
operation.

lard was to receive a re-

change for cooperating
with investigators.
Pollard, however, re-
peatedly violated the
_arrangement by making

told "60 Minutes" that
the couple had no regrets
about passing classified
documents to Israel.
"1 was really apoplec-
tic," Hibey recalled in a
2023 oral history for die
D.C. District Court's
historical society, "be-
cause it had undone what
W2S ro be at the essence
of my plea for mercy."
Pollard was sentenced
to life in prison in March
1987. (Henderson -Pollard
received two concurrent
five-year prison sentenc-
es.) Pollard was released
from custody in 2015, and
he immigrated to Israel
five years later. While in
prison, Pollard fled court
papers assening that
Hibey provided "inade-
quate and unprofessional
handling" of the sentenc-
ing phase.
Among Hibey's other
clients was CBS producer
Mary Mapes during an
independent investigation
into documents used in a
"60 Minutes Wednesday"
report in September 2004
on whether President
George W. Bush fulfilled
his Texas Air National
Guard obligations during
the Vietnam War. The
report, which prompted
Mapei s dismissal, said
the "60 Minutes" team
failed to authenticate the
documents. The story also
led to correspondent Dan
Rather's resignation.
The 2015 movie
"Truth" starred Cate
Blanchett as Mapes and
Robert Redford as Rather.
Hibey was played by the
Australian actor Andrew
McFarlane.
The film begins with
the line: "Mr. Hibey will
see you now."

Iran -contra.)
During the legal saga
with the Marcoses — who
fled the Philippines in
1986 after an uprising
brought Corazon Aquino
to power — Hibey repre-
sented the couple while
lawyers for the new Phi-
lippine government
probed allegations of
massive personal graft

In a 1986 deposition at
the Marcos villa in Hono-
lulu, Ferdinand Marcos
replied 197 times: "I claim
the right against self-
incrimination and the
right to remain silent." In

Marcos and his wife
were indicted in 1988 on
racketeering charges by a
federal grand jury in New
York, accused of siphon-
ing more than S100 mil-
lion in cash and assets
from the Philippines. The
disgraced Philippine lead-
er died in September 1989
before standing trial.
As the trial for Imelda
Marcos approached in
1990, Hibey withdrew
from the case over pos-
sible conflicts Of interest.
Prosecutors planned to
call one of his legal part-
ners, Stanton Anderson,
as a witness over taped
phone calls wish a Marcos

1969, he led the prose-
cution of Billie Austin
Bryant, who escaped from
federal prison in Virginia

During the trial, Hibey
remembered a detail from
investigators. Bryant,
when handed the pistol
allegedly used in the kill-
ings, spun the gun around
his trigger finger. Hibey
gave the handgun to
Bryant on the witness
stand. He did the same
cocky twirl in full sight of
the jury. Bryant was Con-
victed and sentenced to
two life sentences.
In 1972, Hibey entered
private practice and was a
partner in several law
firms. Hibey was lead
onset for a U.S. Olym-
pk Committee probe into
the alleged bribery in the
awarding of the 2002
Winter Games to Salt
Lake City. A report in
1999 led to the expulsion
of six International Olym-
pic Committee members.
Hibey refired in 2017.
In addition to his son
David, survivors include
Hibey's wife of 56 years,
the former Mary Ellen
Leary; another son, Justin;
a sister; two brothers; and
three grandchildren.
Hibey described his
legal approach as trying to
pare a case down to its
simplest terms: disregard-
ing the ideology and back-
ground of a client and
figuring out what could be
done within the law.

Brightline bridge to Aventura Mall due by fall shopping rush

rail line's seniorvice president ofdevelop-
ment said last week.
"The bridge is ready. We're just mak-
ing sure that we've got a place to put the
bridge," Brian Kronberg told the Citizens'
Independent Transportation Trust.
Brightline has hurdles it needs to clear for
that to happen, allowing rail passengers and
others to cross busy Biscayne Boulevard
on foot and reach Aventura Mall, which
annually has 28 million visits, he said.
The company needs a use and occu-
pancy agreement for an aerial easement
for the bridge over Biscayne Boulevard.
That agreement has been through several
revisions, Mr. Kronberg said.
At the same time, the rail line has been
negotiating a land lease for the point where
the bridge will discharge users ion prop-
erty owned by the mail and its developer
Tumberry. On that, he said, "We're close
and we're getting that much closer every
week."
"With the bridge under completion
and due to be completed in a matter of
weeks," he said, "as soon as we can get
the lease with Tumberry signed we can
start construction."
Meanwhile, he said, Brightline is work-
ing with the staff of the county's Depart-
ment of Transportation and Public Works
on ground transportation improvements to
get a safe pedestrian access into the mall
itself, because the bridge won't connect
to the mammoth mall. "It's on the mall
property, but you have to cross a few streets
to get into either the county bus facility or
the entrance of the mall," Mr. Kronberg
told the trust last October.
In October 2022 Brightline said it had
officially completed the publicly funded
Aventura station with installation of the
west side 68-ton, 131-foot pedestrian
skybridge stretching on two 41-foot-high
towers and called it the final piece of the
station's stmcturebefore launching service
at 19796 W Dixie Hwy.
The east side bridge to the mall is the
remaining piece in the puzzle.
In October 2019, the trust approved
the property acquisition and development
agreement between the county and Bright -
line and $76.7 million in transportation
surtaxes to develop the station. Under
the agreement, the county got $4 million
from the City of Aventura to develop the
east side pedestrian bridge that's now in
the works.
"What that means is passengers will be
able to leave the platform, go up the verti-
cal transportation, go east above Biscayne
Boulevard, and get dropped down onto the
Aventura Mall outparcel," Mr. Kronberg
told the trust last April.
Direct connection to Aventura Mall at
19501 Biscayne Blvd. has vital implica-
tions. The mall is Florida's largest and third
in the nation in square feet of retail that
hold 350 store and restaurant locations.
The bridge truss is being made by Ala-
bama company Contech. "The erection of
the bridge is a few days," Mr. Kronberg
told the trust last year. "We'll do a night-
time closure of Biscayne Boulevard, the
bridge will be set in place."
Transportation trust cool to funding chillers but approves it
The Citizens' Independent Transporta-
tion Trust last week turned a cold shoulder
to a call to divert tax money meant to
expand the transit system to instead install
new air conditioning but unanimously
relented when told that federal funds for
transit projects might ride on their vote.
This week the Miami -Dade County
Commission is to act on the plan to spend
$1,640,500 of People's Transportation
Plan bond funds to replace two chiller
units at the transportation department's
William Lehman Center, which the
transportation trust grudgingly approved.
The water chiller units are now 42
years old, and the trust was told they
haven't worked since 2019. Instead, the
county has been renting two portable air
conditioning chiller units for $9,100 per
month, a cost estimated to increase to
$13,600 as the rental contract changes.
"Here we go again," said trust member
Peggy Bell, who has repeatedly sought
to safeguard transit tax receipts for the
new transportation projects that taxpayers
were promised. "Now we're air condi-
tioning places."

activity since covid. This has re-
sulted in qual ity-of-1 ife complaints
surfacing, including concerns
relating to "unruly commercial
charter and boat rental patrons"
and"disturbances caused by public
intoxication."
Commissioner Joseph Maga-
zine, at first reading, brought the
idea at exempting commercial
ferry services from the new restric-
tions, and it was decided the city's
legal department would work on
the wording for second reading.
"At first reading there was
discussion about amending this
ordinance to include an exception
for water taxis and we've worked
with the sponsor, Commissioner
Suarez, as well as with the sponsor
ofthat amendment, Commissioner
Magazine." said City Attorney
Rafael Paz. "We think it might be
more problematic to do that and
create that exemption, and in any
event Poseidon Ferry, the one water
taxi the city has approved, is going
to conclude their service by 7:30
p.m. So, this would not implicate
their operations in any way."
The ordinance, which passed
without any exceptions, prohibits
charter activity between 9 p.m.
and 7 a.m.

Should any person desire to appeal any decision of the City Commission with respect to any
matter to be considered at this meeting, that person shall ensure that a verbatim record of the
proceedings is made including all testimony and evidence upon which any appeal may be based
(F.S. 286.0105).
Pursuant to Miami City Code Section 2-33(o), whenever a scheduled City Commission meeting
is cancelled or is not held due to a lack of a quorum or other emergency, a special City Com-
mission meeting will be automatically scheduled for the Tuesday immediately following the can-
celled meeting. In the event of one of the aforementioned circumstances, the special meeting
would be held on March 19, 2024, at 9:00 a.m. in the City Commission chambers located at
Miami City Hall, 3500 Pan American Drive, Miami, FL 33133. All of the scheduled agenda items
from that cancelled meeting shall automatically be scheduled as an agenda item at the special
City Commission meeting. The City Clerk shall notify the public of the special meeting that is to
take place by placing a notice of the special City Commission meeting at the entrance of City Hall
and the City's main administrative building, placing a notice on the City's website, and, if feasible,
placing an ad in a newspaper of general circulation before the special meeting on the immedi-
ately following Tuesday. There shall be no additional notice by publication required for any such
scheduled agenda item that is moved to the special City Commission meeting.

De conformidad con la Resolution R-23-0438, las reuniones de la Comision de la Ciudad del 14 de marzo de
2024 v del 28 de marzo de 2024 se han combinado en una (1) reunion que se llevara a cabo el iueves 14 de
marzo de 2024 a las 9:00 a.m. en las camaras de la Comision de la Ciudad ubicadas en el Avuntamiento de
Miami, 3500 Pan American Drive, Miami FL 33133.
La reunion de la Comision de la Ciudad del 14 de marzo de 2024 se transmitira en vivo para que los miembros
del publico la vean en el sitio web de la Ciudad (www.miami.gov/tv), Facebook, Twitter, YouTube, Comcast
Canal 77 (Comcast solo para residentes que viven en la Ciudad de Miami) y AT&T Canal 99 (AT&T solo para
residentes que viven en la Ciudad de Miami).
Para su information, los comentarios publicos sobre los temas de la agenda que se escucharan en esta reunion
se pueden enviar a traves de un formulario de comentarios en Irnea y se distribuiran a los funcionarios electos
