BACKGROUND Details of the Street Vacated Area: Width, Area, Site Location, and Surrounding Uses The Street Vacation area is approximately 2,000 square feet or 0.046 acres. The Alley fails to provide any benefit to the Public. This is primarily due to its location among parcels that are exclusively owned by the Applicant. Additionally, the adjacent property to this alley remains undeveloped. This situation highlights a significant opportunity for potential development for bigger projects. Ew CO PZ-23-16389 01/12/24 Pursuant to the provisions of City of Miami Code Section 55-15(a), as amended, the City of Miami Department of Resilience and Public Works has researched for any City projects involving the right of way to be closed and vacated by the subject plat. This department hereby confirms, based on our records, that the City has not expended any funds within the prior fifty (50) years and/or any restricted fund improvements on the right of way proposed to be vacated and closed. Please refer to Table 2: Criteria: Findings: Criteria 1: Is it in the public interest, or would the general public benefit from the vacation of the rights of way or easement? Plat and Street Committee Finding 1: The alley is private. It is not improved, not accessible to and not being used by the general public. The closure of the alley will allow the development of a unified site. Criteria 2: Is the general public no longer using the rights of way or easement? including public service vehicles such as trash and garbage trucks, police, fire, or other emergency vehicles? Plat and Street Committee Finding 2: The alley is completely within the boundaries of the Tentative Plat site. The general public does not utilize the alley. Criteria 3: Would there be no adverse effect on the ability to provide police, fire, or emergency services? Plat and Street Committee Finding 3: There would be no adverse effect on the ability to provide emergency services. Any new development will be required to provide adequate emergency access. The unified site will have access from roadways abutting three sides of the property. Criteria 4: Would the vacation and closure of the rights of way or easements have a beneficial effect on pedestrian and vehicular circulation in the area? Plat and Street Committee Finding 4: The unimproved alley is not part of the general neighborhood pedestrian or vehicular circulation system in the area. A future development may provide enhanced pedestrian and vehicular circulation in the area. Ew CO PZ-23-16389 01/12/24 Planning Department staff reviewed the Applicants proposed vacation and closure of the Street Vacated Area based on key sections of the Miami 21 Zoning Code (Miami 21) and the Miami Comprehensive Neighborhood Plan (MCNP), and their findings are listed below, please refer to Table 3: Criteria: Findings: Planning Miami 21 Code Department The proposed vacating and closing of the Street Vacated Area is consistent Criteria 1: with Miami 21 standards, goals, and objectives. Miami 21, Article 2, Section 2.1.2(b)(3.): "Ensuring that private Development contributes to increased infrastructure capacity and through building embellishes a pedestrian -friendly public realm of highest ambient quality". MCNP It is consistent with Capital Improvements, Goal CI-1 Adhere to sound fiscal management policies that ensure the timely provision of public capital facilities required to maintain existing public infrastructure, which meet the need for public facilities resulting from future development and redevelopment, and that enable the provision of public capital facilities that enhance the quality of life within the city." Planning Staff defers to the Plat and Street Committee's recommendations as a Department testament that the Applicants proposed vacation and closure of the Street Analysis 1: Vacated Area aligns with Miami 21's Article 2 Section 2.1.2(b.) (3.) and MCNP's Goal CI-1. The alley is unimproved and exists only on paper. Curb cuts for the alley do not exist. The 10-foot-wide private alley is approximately 100 feet from NE 4th Street, 900 feet from the waterfront on NE 29 Street and 650 feet from the next cross street on NE 29 Terrace. While the alley unimproved it provides the only north — south passage for the block. Removal could create a superblock. However, per Article 5, Section 5.6.1(i), for sites with340) feet of Frontage length or more, a cross -Block Passage shall be provided as follows: If the Frontage Line of a site is at any point more than three hundred and forty (340) feet from a Thoroughfare intersection, the Building shall provide a cross -Block Pedestrian Passage. A cross block passage would provide a north — south passage at more appropriate location than the existing alley. Creating a more ideal 150 by 350 block on the west reducing the block face to the east to 750 feet and 400 respectively. The cross block passage , designed in compliance with Miami 21 regulations, will effectively maintain pedestrian connectivity and accessibility. The design will adhere to both aesthetic and functional standards, ensuring that it integrates seamlessly with the existing and future urban fabric, thereby enhancing the overall walkability and vibrancy of the area. Planning Department Finding 1: Complies Planning Department Criteria 2: Miami 21 Code It is consistent with Miami 21 Zoning Code, Article 2, Section 2.1.3.3(b.): "Development should adequately accommodate vehicles while respecting the pedestrian and the spatial form of public space". MCNP It is consistent with MCNP's Goal TR-1: "Maintain an effective and cost-efficient circulation network that provides transportation for all persons while reducing both the dependency on automobiles and overall roadway congestion" Planning Department Analysis 2: The applicant's proposal to vacate and close the Alley is essential for the successful redevelopment of this project site. This redevelopment could potentially include Residential and Commercial uses. It aims to adhere to the MCNP's Level of Service Standards for transportation, water, and sewer. Additionally, the plan will enhance the existing pedestrian and vehicular network by eliminating a private, unimproved platted alley. Planning Department Finding 2: Complies Table 3: Planning Department E. CONCLUSION Pursuant to Chapter 55, Section 55-15 of the City of Miami Code of Ordinances, the findings from the Plat and Street Committee and the findings from the Planning Department staff, the Planning Department recommends Approval with Conditions for the closing, vacating, abandoning, and discontinuing for public use the Utility Easement as part of the "Oak Row - Tentative Plat #2018" (Formerly #1871-B) based on the following Conditions of Approval, as stated below: F. Tentative plat application must be made with Miami -Dade County after receiving approval from the City of Miami Plat and Street Committee. 23. Be advised that an incomplete final plat package will not be accepted by the City of Miami. It is the owner's responsibility to work with his/her surveyor and his/her attorney to assure that everything is in order before submitting the final plat package. 24. Be advised that if all requirements for scheduling the final plat for City Commission action are not in order, the final plat will not be scheduled for a City Commission meeting. 25. A letter of concurrency from Miami -Dade County School Board is required prior to the fmal plat submittal. 26. A letter from the Miami -Dade Water and Sewer Department is required to determine if any adjustments to their facilities or easements are required. Existing utilities located within the alley to be closed and vacated must be relocated or easements provided. 29. An opinion of title as to reversionary rights for the right-of-way to be closed and vacated will be required by the Planning, Zoning and Appeals Board. The opinion of title must also address whether or not there are individuals, in addition to the abutting property owners, having an interest in the right-of-way to be closed and vacated. A copy of the opinion of title must be provided to the Survey Section of Resilience and Public Works Department. 30. The Planning, Zoning, and Appeals Board will require a Sketch and Legal Description with a square footage, on an 8 1/2" X 11" paper, for the proposed closure.
