A. REQUEST
Pursuant to Chapter 55, Section 55-15 of the City of Miami Code of Ordinances (City
Code), as amended, the property owner, 2900 Terrace Owner, LLC (the "Applicant") requests,
through the replating process, to close, vacate, abandon, and discontinue for public use one, a
10-foot-wide private alley, (the "Street Vacation Area") and is generally located between
Northeast 29 Terrace and Northeast 29 Street, Miami, Florida.
B. RECOMMENDATION
The City of Miami Plat and Street Committee (the "Plat and Street Committee"), at its meeting
on January 5, 2023, approved the "Oak Row - Tentative Plat #2018" (Formerly #1871-B) (the
"Tentative Plat"), please refer to Attachment 1 — Legal Description Title in Packet: Exhibit "A"
and Attachment 2 — "Oak Row - Tentative Plat #2018" (Formerly #1871-B). The Tentative Plat is
subject to the current Department of Resilience & Public Works letter drafted on March 15,
2023, please refer to Attachment 3 - Public Works Letter — "Oak Row - Tentative Plat #2018"
(Formerly #1871-B) and is generally bounded between Northeast 29 Terrace, Northeast 29
Street, Northeast 4 Avenue and Biscayne Bay.
Based on the recommendation of the Plat and Street Committee and Planning Department
staff's analysis, the Planning Department recommends an "Approval with Conditions" of the
Applicant's request to vacate and close the Street Vacation Area from public use.

C. BACKGROUND
Details of the Street Vacated Area: Width, Area, Site Location, and Surrounding Uses
The Street Vacation area is approximately 2,000 square feet or 0.046 acres. The Street
Vacation Area is generally bounded by the following City of Miami (the "City") Throughfares:
Northeast 29 Terrace to the north, Biscayne Bay to the east, Northeast 29 Street and Northeast
4 Avenue, refer to Figure 1. Its abutting properties are predominated by Vacant lots,
Commercial and Institutional uses, please refer to Table 1.

Proposal
The Applicant is seeking a Resolution of the Miami City Commission for the closing, vacating,
abandoning, and discontinuing for public use the Alley. The Alley fails to provide any benefit to
the Public. This is primarily due to its location among parcels that are exclusively owned by the
Applicant. Additionally, the adjacent property to this alley remains undeveloped. This situation
highlights a significant opportunity for potential development for bigger projects.

Pursuant to the provisions of City of Miami Code Section 55-15(a), as amended, the City of
Miami Department of Resilience and Public Works has researched for any City projects
involving the right of way to be closed and vacated by the subject plat. This department hereby
confirms, based on our records, that the City has not expended any funds within the prior fifty
(50) years and/or any restricted fund improvements on the right of way proposed to be vacated
and closed. Please refer to Table 2:

Vacated Area based on key sections of the Miami 21 Zoning Code (Miami 21) and the Miami
Comprehensive Neighborhood Plan (MCNP), and their findings are listed below, please refer to
Table 3:

Vacated Area aligns with Miami 21's Article 2 Section 2.1.2(b.) (3.) and
MCNP's Goal CI-1.
The alley is unimproved and exists only on paper. Curb cuts for the alley do
not exist. The 10-foot-wide private alley is approximately 100 feet from NE
4th Street, 900 feet from the waterfront on NE 29 Street and 650 feet from
the next cross street on NE 29 Terrace. While the alley unimproved it
provides the only north — south passage for the block. Removal could create
a superblock. However, per Article 5, Section 5.6.1(i), for sites with340) feet
of Frontage length or more, a cross -Block Passage shall be provided as
follows: If the Frontage Line of a site is at any point more than three
hundred and forty (340) feet from a Thoroughfare intersection, the Building
shall provide a cross -Block Pedestrian Passage. A cross block passage
would provide a north — south passage at more appropriate location than
the existing alley. Creating a more ideal 150 by 350 block on the west
reducing the block face to the east to 750 feet and 400
respectively.
The cross block passage , designed in compliance with Miami 21
regulations, will effectively maintain pedestrian connectivity and
accessibility. This passage will not only support walkability but also

E. CONCLUSION
Pursuant to Chapter 55, Section 55-15 of the City of Miami Code of Ordinances, the findings
from the Plat and Street Committee and the findings from the Planning Department staff, the
Planning Department recommends Approval with Conditions for the closing, vacating,
abandoning, and discontinuing for public use the Utility Easement as part of the "Oak Row -
Tentative Plat #2018" (Formerly #1871-B) based on the following Conditions of Approval, as
stated below:
F. CONDITIONS
1. The vacation and closure of the Street Vacation Area shall be developed in accordance with
the "Oak Row - Tentative Plat #2018" (Formerly #1871-B), as prepared, signed, and sealed

2. A building permit, including phased permits, will not be issued on the property being platted
until the final plat is recorded in the official records of Miami -Dade County, Florida or as
authorized by Section 55-10(j) of the City of Miami Code of Ordinances, as amended.
3. A temporary certificate of occupancy or a certificate of occupancy shall not be issued,
unless and until the governmental agency or developer obtains final plat approval and
records the final plat in the official records of Miami -Dade County, Florida, within the
recordation period, as defined in Section 55-10(j)(10) of the City of Miami Code of
Ordinances, as amended.
4. The City reserves the right to inspect the site to ensure compliance with the conditions
listed.
5. Failure to comply with the conditions herein may result in the immediate revocation of this
"Vacation Closure" application and shall be subject to any fines and penalties pursuant to
the City Code.
6. Pursuant to Chapter 55, Section 55-15 of the City Code, "[an] approval of the requested
vacation and closure shall be valid for a period of four years and shall remain independent
of the referenced tentative plat during this period. The approved final plat must be recorded
within the four-year approval period of the requested vacation and closure. Any revised
tentative plat submitted for review subsequent to the approved vacation and closure must be
compatible with the approved vacation and closure, as determined by the plat and street
committee. The tentative plat most recently approved by the plat and street committee shall
be the official tentative plat of reference when submitting documents for final plat approval
by the City Commission."

Ladies and Gentlemen:
The City of Miami Plat and Street Committee, at its meeting of January 5, 2023 approved the above tentative
plat subject to the following revisions being made to the tentative plat, additional information being provided
and/or variances being granted. Please be advised that the processing of your tentative plat cannot proceed
until these conditions and/or comments have been satisfied:
Resilience and Public Works
1. The Opinion of Title needs to be revised to be in City of Miami form.
2. An Opinion of Title is required for the remnant portion of Lot 10, Block 9, Broadmoor, Plat Book
2, Page 37, abutting the tentative plat, and for the remnant portion of Tract 3, Revised Plat
Broadmoor Plaza, Plat Book 32, Page 76, abutting the tentative plat.
3. Remove the parcel numbers designation from the legal description in the Opinion of Title, in the
Application, and in the Tentative Plat.
4. Move the expressed purpose statement to be after the legal description.
5. List all property addresses to the corresponding folio numbers applicable to this plat.
6. Add adjacent subdivisions information.
7. Remove or revise surveyor's notes #3 and #9.
8. The tentative needs general revisions, contact the Survey Section.
9. Provide corrections on the underground information of existing storm water drainage system adjacent
to proposed plat — underground lines, inlet rim elevation, inlet type, structure bottom elevation, pipe
invert elevation and direction, pipe size, pipe length, exfiltration trench, and legend. All information
obtained from the City records must be field verified. Field verifications are also required for all new
structures that are not on the City records. Dirty obstructed structures must be cleaned to be accessible
for the field verifications and research, if necessary.
10. Surveyor's Note #7 for Underground Utilities must be revised. Underground stormwater drainage
utilities are to be located. All information obtained from the City records must be field verified. Field
verifications are also required for all new structures that are not on the City records.
11. Surveyor's Note #10 elevation datum — add conversion factor equation to N.A.V.D. 1988.
12. Corrections on underground information to be completed prior SDI engineering plans submittal.

19. All encroachments across proposed tract and/or lot lines must be removed prior to final plat submittal.
20. An Opinion of Title, in the City of Miami Opinion of Title form, must be provided at the time of final
plat submittal.
21. Current backup documentation will be required for all who execute the fmal plat. A resolution for
authority to execute documents and a Certificate of Good Standing from the Secretary of State are
required, if applicable.
22. Tentative plat application must be made with Miami -Dade County after receiving approval from the
City of Miami Plat and Street Committee.
23. Be advised that an incomplete final plat package will not be accepted by the City of Miami. It is the
owner's responsibility to work with his/her surveyor and his/her attorney to assure that everything is
in order before submitting the final plat package.
24. Be advised that if all requirements for scheduling the final plat for City Commission action are not
in order, the final plat will not be scheduled for a City Commission meeting.
25. A letter of concurrency from Miami -Dade County School Board is required prior to the fmal plat
submittal.
26. A letter from the Miami -Dade Water and Sewer Department is required to determine if any
adjustments to their facilities or easements are required. Also, a letter to release the final plat in
connection with water and sewer service agreements.
27. Provide two 8 1/2" by 11" paper location sketch exhibits, one "Before Replat" and one "After
Replat".
28. Existing utilities located within the alley to be closed and vacated must be relocated or easements
provided.
29. An opinion of title as to reversionary rights for the right-of-way to be closed and vacated will be
required by the Planning, Zoning and Appeals Board. The opinion of title must also address whether
or not there are individuals, in addition to the abutting property owners, having an interest in the
right-of-way to be closed and vacated. A copy of the opinion of title must be provided to the
Survey Section of Resilience and Public Works Department.
30. The Planning, Zoning, and Appeals Board will require a Sketch and Legal Description with a
square footage, on an 8 1/2" X 11" paper, for the proposed closure. Contact the Office of the Hearing
Boards, at 305-416-2030. Provide a copy to the Survey Section of Resilience and Public Works
Department.
31. The Subdivider or applicant is to comply with the requirements of Chapter 55, Sec. 55-15(a) City of
Miami Code before scheduling a public hearing before the city commission for the vacation and
closure of the alley.

32. The Plat and Street Committee has reviewed he tentative plat of OAK ROW 2900 subdivision and
determined that all technical requirements contained in the Miami City Code Subdivision
Regulations have been met and has approved the tentative plat. The members of the Plat and Street
Committee have further considered the request for vacation and closure of the alley with respect to
Miami City Code requirements and have voted 5 in favor and 0 in denial of this vacation and
closure request.
In addition to the above requirements, you should be aware of the following:
1. State and local laws require the installation of various physical improvements in the public rights -of -
way when property is platted. These subdivision improvements include paving, drainage,
landscaping, sidewalks, etc. In some cases this could represent a substantial investment on your part.
REQUIRED: The submission of an electronic copy of the tentative plat, in an AutoCAD version, to
the City of Miami Public Works Department, Roadway Plans Section will EXPEDITE the
preparation and enhance the ACCURACY of the subdivision improvement letter required for the
final plat approval.
2. Execution of Covenant for Postponement of Subdivision Improvements is required in cases where
the required subdivision improvements are not completed.
3. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric,
telephone, water, etc., caused by this plat will be at the property owner's expense. Also, utility
easements may be required on the property being platted.
4. A building permit will not be issued on the property being platted until the final plat is recorded or as
authorized by the City of Miami Code Section 55-10(i). Also, the Certificate of Occupancy for any
building construction will be issued only after all the required subdivision improvements have been
completed.
5. Approval for fire flow requirements must be obtained from the Fire -Rescue Department prior to the
issuance of a building permit.
6. In order to mitigate problems associated with access and construction activities throughout the
neighborhood, the contractor/developer is encouraged to notify the affected neighborhood residents,
in writing, of the project starting and completion dates at the time of issuance of permits.
7. Additional items must be provided to the City of Miami Department of Resilience and Public Works,
Development and Roadway Plans Section before the fmal plat is submitted to the City Commission
for approval. You will be notified in writing as to what these items are after the amount of the bond
has been determined for the necessary subdivision improvements. It is required that the applicant
contacts the City of Miami Resilience and Public Works Survey Section to verify that all fmal plat
submittal documents are complete prior to final plat submittal.
8. Tentative plat approval is only valid for one (1) year and six (6) months from the date of the Plat and
Street Committee meeting at which time it was approved.

At the January 5, 2023 Plat and Street Committee meeting, one tentative plat was approved that contains an alley
vacation and closure. The results of the Committee's review of the public interest findings concerning the closure are
summarized as follows:
"OAK ROW 2900" Tentative Plat #2018 (private alley)
1. The alley is private. It is not improved, not accessible to and not being used by the general public. The closure of the
alley will allow the development of a unified site.
2. The alley is completely within the boundaries of the Tentative Plat site. The general public does not utilize the alley.
Public service vehicles and emergency vehicles, such as police and fire -rescue, do not utilize the alley.
3. There would be no adverse effect on the ability to provide emergency services. Any new development will be required to
provide adequate emergency access. The unified site will have access from roadways abutting three sides of the property.
4. The unimproved alley is not part of the general neighborhood pedestrian or vehicular circulation system in the area. A
future development may provide enhanced pedestrian and vehicular circulation in the area.
The Plat and Street Committee members voted to recommend 5 in favor and 0 in denial of this request to vacate and
close the alley.
