A RESOLUTION OF THE MIAMI CITY COMMISSION DECLARING NO
OBJECTION TO THE NAMING OF A CERTAIN PRIVATE ROAD WITHIN
BRICKELL KEY AS "ISLAND DRIVE," SUBJECT TO ALL APPLICABLE
REVIEW AND PERMITTING REQUIREMENTS; FURTHER DIRECTING THE,
CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO OFFICIAL$
NAMED HEREIN.

WHEREAS, Brickell Key is a private island within the City of Miami ("City") which is
accessed via a public right-of-way, Southeast 8th Street, and features a network of internal
private roads that connect the various buildings and amenities on the island; and

WHEREAS, Swire Brickell Key Hotel, Ltd., and Swire Jadeco LLC (collectively, "Swire")
are the owners of certain land located on Brickell Key ("Property"), as more particularly
described in Exhibit "A," attached and incorporated; and
WHEREAS, Swire proposes to improve a portion of the Property with a private road
("Private Road Area") to be known as Island Drive, as more particularly described in Exhibit "B,"
attached and incorporated; and
WHEREAS, the City acknowledges the significance of properly naming and designating
private roads within its jurisdiction; and
WHEREAS, providing a formal and distinct designation for the proposed private road will
enhance public safety and future emergency response efforts;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The Miami City Commission declares no objection to the naming of the
Private Road Area, described in Exhibit "B," attached and incorporated as Island Drive, subject
to all applicable permitting requirements.
Section 3. The naming of Island Drive does not constitute a legal dedication of the
Private Road Area for public right of way or maintenance purposes and nothing in this
Resolution shall be construed as imposing an obligation or responsibility on the City for the
construction or maintenance of the Private Road Area. The abutting property owners and/or the
subdivider shall maintain the private road in perpetuity as required by the provisions of Chapter
55 of the Code of the City of Miami, Florida, as amended ("City Code"), and shall provide a
restrictive covenant to be recorded in the public records of Miami -Dade County to this effect. No
attempt shall be made to dedicate the private right-of-way to the public.

Section 4. The design of the Private Road Area must be reviewed and approved by the
City's Director of Resilience and Public Works subject to the criteria set forth in Section 55-
11(d)(4) of the Code of the City of Miami, Florida, as amended, subject to any reasonable
deviations which may be granted by the Director.
Section 5. The City Clerk is directed to transmit a copy of this Resolution to the Board of
County Commissioners of Miami -Dade County, Florida.
Section 6. This Resolution shall become effective immediately upon its adoption.

1 This Resolution shall become effective as specified herein unless vetoed by the Mayor within ten (10)
