Subject: Mutual Aid Agreement - City of Pinecrest and North Bay Village
Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), authorizing the City
Manager to execute mutual aid agreements, in substantially the attached form, between
the City of Miami and the City of Pinecrest and North Bay Village, to receive and extend
mutual aid in the form of law enforcement services and resources to ensure public
safety and ability to adequately respond to intensive situations, including but not limited
to natural and man-made disasters or emergencies as defined in Part 1, Chapter 23,
Florida Statutes, the "Florida Mutual Aid Act."
Background of Item:
There are natural and man-made challenges faced by the City of Miami's ("City") Police
Department ("MPD") and other local municipal police departments that are, or are likely
to be, beyond the control of the services, personnel, equipment, or facilities of MPD or
other local municipal police departments.
The City and the City of Pinecrest and North Bay Village (collectively, the "Participating
Municipalities") wish to enter into a Mutual Aid Agreement ("MAA") to ensure that
preparation and resources from each Participating Municipalities' respective law
enforcement agency will be adequate to address natural and man-made challenges,
protect public peace and safety, and to preserve the lives and property of the people of
the City and the Participating Municipalities.
The City and the Participating Municipalities have the authority under the Florida Mutual
Aid Act, Chapter 23, Part 1, Sections 23.12-23.127, Florida Statutes, to enter into
mutual aid agreements.
The City and the Participating Municipalities have the authority under the Florida
Interlocal Cooperation Act of 1969, promulgated under Section 163.01, Florida Statutes,
to enter into interlocal agreements for the purposes of permitting local governmental
units to make the most efficient use of their powers by enabling them to cooperate with
other localities on a basis of mutual advantage and thereby to provide services and
facilities in a manner and pursuant to forms of governmental organization that will
accord best with geographic, economic population, and other factors influencing the
needs of the local communities.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE COMBINED VOLUNTARY
COOPERATION AND OPERATIONAL ASSISTANCE MUTUAL AID AGREEMENTS, IN
SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND
THE CITY OF PINECREST AND NORTH BAY VILLAGE TO RECEIVE AND EXTEND
MUTUAL AID IN THE FORM OF LAW ENFORCEMENT SERVICES AND
RESOURCES TO ENSURE PUBLIC SAFETY AND ABILITY TO ADEQUATELY
RESPOND TO INTENSIVE SITUATIONS, INCLUDING BUT NOT LIMITED TO
NATURAL AND MAN-MADE DISASTERS OR EMERGENCIES AS DEFINED IN PART
1, CHAPTER 23, FLORIDA STATUTES, THE "FLORIDA MUTUAL AID ACT."
WHEREAS, there are natural and man-made challenges faced by the City of Miami's

WHEREAS, the City of Pinecrest and North Bay Village (collectively, the "Participating

WHEREAS, the City and the Participating Municipalities have the authority under the

mutual aid agreements; and
WHEREAS, City and the Participating Municipalities have the authority under the Florida

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute the MAA, in substantially the
attached form, with each of the Participating Municipalities to receive and extend mutual aid in
the form of law enforcement services and resources to ensure public safety and the ability to
adequately respond to intensive situations, including but not limited to natural or manmade
disasters or emergencies as defined in Chapter 23, Part 1, Florida Statutes.
Section 3. This Resolution shall become effective immediately upon its adoption.
