about the legislation and
what's to come.
WHAT'SIN THE
SENATE BILL?
SR 1122, the "Historical
Monuments and Memo-
rials Protection Act,"
would prohibit any local
government from remov-
ing a "historic Florida
monument *memorial,"
and it would be retroactive
to jay 1, 201&
The bill defines any
"permanent statue. mark-
er, plaque, nag banner,
cenotaph, religious symbol,
painting, seal, tombstone,
or display" that's been on
public property for at kart
25 years and depicts an
event or persona part of
state history as a "historic
Florida monument or me-
morial"
The legislation effeelive-
ly gives only the state the
right to make decisions
about the removal of his-
toric monuments. It stales
that the Dieisian of Histor-
ical Resources within the
Department of State and
the Department of Veter-
ans Affairs will oversee
such decisions.
Any local government
that tries to pass an ordi-
nance or ode that aims to
remove a historic monu-
mmt will have a pemla-
nenr injunction issued
against it by the court and
the ordinance or role will
be deemed invalid. A local
official who votes in favor
of a rule or ordinance to
remove a historic monu-
ment could be subjected to
a fine of up to S1,000.
The bill also gives people
the grounds to sue a local
government or local offi-
cial over the removal or
attempt at a removal of a
historic monument.
Any local government
that removes a monument
will have three years from
its original removal date to
restore it. 1f a municipality
can't afford to replace it,
the state government will
cover the costs to restore
the monument and will
withhold state funding for
the arts, cultural and his-
toric preservation from
that local government until

CONTROVERSY
The sponsor of SR 1122,
Sen. Jonathan Martin,
R-Fort Myers, said in Tues-
day's meeting that Write
Legislature doesn't act

American monuments,"
Martin said he was In-
spired to draft the bill after
seeing monuments re-
moved around the country
in 2020 and 2021. At that
time, in the aftermath of
the murder of George
Floyd and Slack lives

Speakers who opposed
the bill brought up con -

ments should have the
fight to take down monu-
ments wch as Confederate
markers because they
"honor the Confederate
States of America, not the
