HomeMy WebLinkAboutR-24-0023City of Miami Resolution R-24-0023 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15330 Final Action Date: 1/11/2024 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER, THE CITY ATTORNEY, AND THE CITY CLERK TO PROPOSE AN AMENDMENT TO CHAPTER 16 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, TITLED "ELECTIONS," PROVIDING FOR ADDITIONAL FINANCIAL DISCLOSURES FROM CANDIDATES TO ELECTED OFFICE IN THE CITY OF MIAMI; FURTHER DIRECTING THE CITY MANAGER AND THE CITY ATTORNEY TO RETURN TO THE CITY COMMISSION AT ITS FEBRUARY 8, 2024, MEETING WITH PROPOSED AMENDMENT. SPONSOR(S): Commissioner Joe Carollo, Commissioner Manolo Reyes WHEREAS, transparency in the City of Miami ("City") is key to maintaining the trust of its residents; and WHEREAS, in order to provide transparency in the receipt of campaign contributions and close the loop hole allowing candidates to receive contributions from third parties and pass them off as "personal loans," the City Commission finds that it is in the best interest of the City to direct the City Manager, the City Attorney, and the City Clerk to propose an amendment to Chapter 16, titled "Elections," providing that candidates to elected office who gift or loan themselves funds in any amount over $1,000.00, disclose proof of aged funds in the originating account for at least four (4) months; and WHEREAS, the proposed amendment will be brought back to the February 8, 2024, City Commission meeting; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission hereby directs the City Manager, the City Attorney, and the City Clerk to propose an amendment to Chapter 16 of the City Code, titled "Elections," to provide that candidates to elected office who gift or loan themselves any money over $1,000.00 must disclose proof of aged funds in the originating account for at least four (4) months. Section 3. Further directing the City Commission to present a proposed amendment at the February 8, 2024, City Commission meeting. Section 4. This Resolution shall become effective immediately upon its adoption.
