the violations relating to the certificate of use and business tax receipt, however, unbeknownst to
the Plaintiff, a certificate of (compliance was never issued by the City of Miami at that time.
11. Plaintiff was not in a position to eure deficiencies, aa they all related to the
Tenant-:' s 'business operations. Although the Tenant vacated prior to September 3, 2021, daily lines
began to accrue,
12. On September 7,•2021, the Final Administrative Enforcement Order wa$ filed
connection with the Premises. A tme and correct copy of the Order is attached as Exhibit B.
13, The deficiencies were fully cured and the City certified thatjhe'PropertY i$hi
compliance on August 9, 2023. A true and correct copy of email confirming Affidavit of
• ComPliancu.fromtitr of NEM" InsncetoriVitturielOtomitiniaattaehednaUhlbit'C.
14, Section 2-817(d)(2) of Defendant's Code provides that mitigation is not available
for properties that exceed ,271 days to reach compliance except for the exceptions listed in
subsection (d)(4) of Defendant's Code. Plaintiff does not -qualify under any of the exceptions.
Accordingly, mitigation is not available to Plaintiff.
15, Before filing this cause of action, Plaintiffcommunicated with Defendant in an
attempt to mitigate the fines to no avail.
16. All conditions precedenthave been completed before the filing of this cause of
action.
