A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT, AMENDING RESOLUTION R-23-0271, PROVIDING AN AMENDMENT TO THE NEW JURISDICTIONAL BOUNDARIES OF THE CITY COMMISSION DISTRICTS FOLLOWING THE RESULTS OF THE 2020 UNITED STATES CENSUS; OFFICIALLY DELINEATING THE BOUNDARIES OF EACH DISTRICT AS SET FORTH IN "EXHIBIT 1" TO BE EFFECTIVE UPON ADOPTION WHEREAS, the voters of the City of Miami (" City") adopted a Charter Amendment on September 4, 1997, providing for a non -voting Executive Mayor elected City-wide, and five ( 5) City Commissioners elected from districts; and WHEREAS the City Commission adopted Resolution No. 97-495 providing for the jurisdictional boundaries of the City Commission Districts; and WHEREAS, on May 8, 2003, the City reapportioned district boundaries in Resolution No. 03-0448 following the results of the 2000 Census; and WHEREAS, on May 23, 2013, the City reapportioned district boundaries in Resolution No. R-13-0208 following the results of the 2010 Census; and WHEREAS, on June 14, 2023, the City Commission reapportioned the district boundaries in Resolution No. R-23-0271 ("Amended 2022 Map") following litigation with various community organizations after the initial reapportioned plan adopted after the 2020 Census; and WHEREAS, Resolution No. R-23-0271 is still under legal scrutiny as the? subject of three separate legal actions; and .;f,; ry r ri WHEREAS, Resolution No. R-23-0271 removed from District 1 fur m properties that had continuously been located in that District since the City-' N.) Commission adopted Resolution No. 97-495 providing for the jurisdictional"' boundaries of the City Commission Districts; and WHEREAS, those four properties have been, and are, part of the community bordered by NW 17th Avenue on the East, NW 22"d Avenue on the West, the North Fork Miami River and the Miami River on the North, and State Road 836 on the South, and which is traversed by a single thoroughfare that runs from NW 17th 15172 Legislation -SUB THIS DOCUMENT IS A SUBSTITUTION TO ORIGINAL. Avenue to NW 22nd Avenue on NW South River Drive, NW 19' Avenue and NW 11 th Street; and WHEREAS, the anticipated outcome of all litigation would likely restore those four properties back into District 1; and WHEREAS, placing said four properties back into District 1 will not cause any significant deviation in the population of the remaining four districts; and WHEREAS, not only will placing said four properties back into District 1 restore to the community its previous integrity without the artificial split caused by Resolution No. R-23-0271, but it will also be the likely result of the current federal redistricting lawsuit in the Southern District of Florida, 1:22-cv-24066-KMM; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The real property consisting of two adjacent and contiguous lots in Miami -Dade County property records Folio Number: 01-3134-094-0010 with legal description of "BETTYS ISLAND PB 109-57, TRACT A. LOT SIZE 14375 SQ FT, OR 19087-3725 04 2000 2(2)" and address of 1111 NW 17th Court Miami, Florida 33125, and Folio Number 01-3134-045-0810 with legal description of "LAWRENCE PARK AMD PB 7-140 BEG 28.68FTN OF SW COR LOT 67 N 15.09FT NELY AD 30.75FT TO MOST NLY COR LOT 67 SE ALG LOT,/, 68FT E 8.61FT SWLY AD 21.49FT WLY AD 54.62FT TO POB & PROP1NT & TO COMMON ELEMENTS NOT DEDICATED TO PUBLIC LOT SIZE SQ FT, OR 19087-3725 04 2000 2(2)" and address of 1701 NW South River Drive, Miami, Florida 33125, encompassing the two adjacent and contiguous properties located immediately West of NW 17' Avenue, North of NW South River Drive and East of the Lawrence Canal, are hereby removed from CI* co Commission District 3 and added to City Commission District 1 as reflected inrud in the attached map. Section 5. The City shall amend the Commission District Map to effectuate the adopted change. Section 6. This Resolution shall become effective immediately upon adoption and signature by the Mayor.
