REQUEST Pursuant to Chapter 55, Section 55-15 of the City of Miami Code of Ordinances (City Code), as amended, the property owner, 8347 Biscayne, LLC, (the "Applicant") requests through the replatting process to vacate and close from public use a 40-foot wide public Right- of-way, that being NE 83 Lane, (the "Street Vacation Area") that is generally bounded by the following City of Miami (the "City") Thoroughfares: NE 85 Street, E Dixie Highway, NE 83 Terrace, and Biscayne Boulevard, Miami, Florida, more particularly described in Exhibit "A". B. RECOMMENDATION The City of Miami Plat and Street Committee (the "Plat and Street Committee"), at its meeting on May 5, 2022, approved the "Little River Heights - Tentative Plat #2003", refer to Attachment 1 — PZ-23-16250_Tentative Plat. Based on their recommendation in conjunction with the Planning Department staff's facts and findings, refer to Attachment 2 — PZ-23-16250_Letter from Public Works, the Planning Department recommends an "Approval with Conditions" of the Applicant's request to vacate and close the Street Vacation Area from public use. BACKGROUND Details of the Street Vacated Area: Width, Area, Site Location, and Surrounding Uses The Street Vacation Area is approximately 8,522 square feet or 0.196 acres. The Street Vacation Area is generally bounded by the following City of Miami (the "City") Thoroughfares: NE 85 Street, E Dixie Highway, NE 83 Terrace, and Biscayne Boulevard, refer to Figure 1. It is abutting properties are predominated by Commercial and Residential Uses, please refer to Table 1. The T5 Transect Zone allows for a Mixed -Use but primarily residential urban fabric with a range of Building types. Whereas the T6 Transect Zone consists of higher Density Mixed -Use Building types that accommodate a wide range of Uses: Residential, Office, and Commercial, see Figure 2 Vacation and Closure Approved — May 5, 2022 The Plat and Street committee at their May 5, 2022 meeting, reviewed and approved the Applicant's Little River Heights - Tentative Plat #2003, refer to Figure 3. PZ-23-16250: 8347 BISCAYNE BLVD-Vacation Closure — Page 3 of 26 11/2/2023 INNAMED Tf -8-0 3-R Figure 2: Street Vacated Area = black outline; Miami 21 Code s Transect Zones: T6-8-0 (pink); T5-R (brown) Figure 3: The Little River Heights - Tentative Plat #2003 — red outline = the approximate location of the Street Vacated Area PZ-23-16250: 8347 BISCAYNE BLVD-Vacation Closure — Page 4 of 26 11/2/2023 Plat and Street Committee Review of a Tentative Plat and its associated Right of Way Closure Pursuant to Section 55-15(b)(1), in consideration of the Applicant's Little River Heights - Tentative Plat #2003, the Plat and Street Committee considered the Applicant's proposed Street Vacated Area to be vacated and closed in conjunction with the eight (8) identified properties (8347 Biscayne Boulevard, 637 NE 83 Terrace, 627 NE 83 Terrace, 652 NE 83 Lane, 645 NE 83 Lane, 615 NE 83 Lane, 611 NE 83 Lane, and 625 NE 83 Lane) on each side of the rights -of - way, that being NE 83 Lane, to be vacated and closed shall be included in the plat, and all abutting property owners shall join in the plat and the disposition of the rights -of -way or easements shown, refer to Figure 4. FINDINGS Pursuant to Chapter 55, Section 55-15(c) of the City of Miami Code of Ordinances, the Plat and Street Committee, at their May 5, 2022 meeting, reviewed and recommended approval of the Applicant's "Little River Heights - Tentative Plat #2003" to vacate and close a right of way, that PZ-23-16250: 8347 BISCAYNE BLVD-Vacation Closure — Page 5 of 26 11/2/2023 being NE 83 Lane, from public use. The Plat and Street Committee considered the following four (4) criteria in making their recommendation to the Planning, Zoning, and Appeals Board, please refer to Table 2 and Attachment 3 - PZ-23-16250_Public Works MOU. Criteria: Plat and Street Committee Members - Findings Criteria 1: Is it in the public interest, or would the general public benefit from the vacation of the rights of way or easement? Plat and Street Committee Finding 1: The City Thoroughfare, that being NE 83 Lane, is a "dead-end" street that is not designed according to present-day standards and requirements. The applicant is the owner of all the properties abutting NE 83 Lane and is proposing a future mixed -use commercial and residential development that is found to be consistent with the area's Comprehensive Plan and Zoning designations. The vacation and closure of the right-of-way and the proposed redevelopment will be a considerable improvement to the area and will add to the City's tax base. Criteria 2: Is the general public no longer using the rights of way or easement? including public service vehicles such as trash and garbage trucks, police, fire, or other emergency vehicles? Plat and Street Committee Finding 2: The entire length of N.E. 83 Lane is only being utilized by the applicant and its tenants. The general public is not utilizing N.E. 83 Lane as it does not connect with any other street. The only public service vehicles that utilize N.E. 83 Lane are the ones servicing the applicant and its tenants. Criteria 3: Would there be no adverse effect on the ability to provide police, fire, or emergency services? Plat and Street Committee Finding 3: Police, fire, and emergency services will not be adversely affected by the proposed vacation and closure of the right-of-way since the street proposed to be vacated and closed does not connect with any other street. Criteria 4: Would the vacation and closure of the rights of way or easements have a beneficial effect on pedestrian and vehicular circulation in the area? Plat and Street Committee Finding 4: The vacation and closure of NE 83 Lane would have a beneficial effect on pedestrian and vehicular circulation in the area, in that a "dead-end" condition will be terminated, and the sidewalks and streetscapes in the proposed development will be a considerable improvement over the existing condition facilitating pedestrian connectivity north to south. Table 2: the four (4) questions regarding the Vacation Closure, per Chapter 55, Section 55-15(c) of City Code Planning Department staff reviewed the Applicant's proposed vacation and closure of the Street Vacated Area based on key sections of the Miami 21 Zoning Code (Miami 21) and the MCNP, and their findings are listed below, please refer to Table 3: PZ-23-16250: 8347 BISCAYNE BLVD-Vacation Closure — Page 6 of 26 11/2/2023 Criteria: Findings: Planning Miami 21 Code Department The proposed vacating and closing of the Street Vacated Area is consistent Criteria 1: with Miami 21 standards, goals, and objectives. Miami 21, Article 2, Section 2.1.2(b)(3.): "Ensuring that private Development contributes to increased infrastructure capacity and through building embellishes a pedestrian -friendly public realm of highest ambient quality". MCNP It is consistent with the Capital Improvements, Goal CI-1 Adhere to sound fiscal management policies that ensure the timely provision of public capital facilities required to maintain existing public infrastructure, that meet the need for public facilities resulting from future development and redevelopment, and that enable the provision of public capital facilities that enhance the quality of life within the city." Planning Miami 21 Code Department It is consistent with Article 3, Section 3.8.2.c of Miami 21 Code: Analysis 1: "All Thoroughfares should terminate at other Thoroughfares, to form a network. Cul-de-sacs should be permitted only when supported by natural site conditions. Thoroughfares that provide View Corridors shall not be vacated." This City Thoroughfare, that being NE 83rd Lane, does not terminate at another Thoroughfare and it functions as a "de facto" dead-end street with only one connection point that serves as both its ingress and egress to Biscayne Boulevard. MCNP It is consistent with Capital Improvements Element, Goal CI-1 of the MCNP: "Adhere to sound fiscal management policies that ensure the timely provision of public capital facilities required to maintain existing public infrastructure, that meet the need for public facilities resulting from future development and redevelopment, and that enable the provision of public capital facilities that enhance the quality of life within the city." Pursuant to Chapter 55, Section 55-15 of the City Code, the Applicant requests, through the replatting process, to vacate and close NE 83rd Lane is part of a redevelopment project that is linked to PZ-23-16251: 8347 PZ-23-16250: 8347 BISCAYNE BLVD-Vacation Closure — Page 7 of 26 11/2/2023 Criteria: Findings: Biscayne Boulevard — Waiver (the "Waiver"). Specifically, this Waiver application is for a proposed redevelopment project of an assemblage of 12 properties, which includes the seven (7) properties listed under this Staff Analysis's Subheading - Plat and Street Committee Review of a Tentative Plat and its associated Right of Way Closure. This Street Vacation Area will be part of a redevelopment project that will conform to the regulations of the Miami 21 Code, which promotes better traffic circulation for this immediate area. Planning Department Finding 1: Complies Planning Department Criteria 2: Miami 21 Code It is consistent with Miami 21 Zoning Code, Article 2, Section 2.1.3.3(b.): "Development should adequately accommodate vehicles while respecting the pedestrian and the spatial form of public space". MCNP It is consistent with MCNP's Goal TR-1: "Maintain an effective and cost-efficient circulation network that provides transportation for all persons while reducing both the dependency on automobiles and overall roadway congestion" Planning Department Analysis 2: The Applicants proposed vacation and closure of the Street Vacated Area is a critical element to the success of redeveloping this project site for possible future Uses, such as Residential and Commercial, complying with the MCNP's Level of Service Standards for transportation, water, and sewer, and improving the current pedestrian/vehicular network by removing an underutilized or abandoned dead end street. Planning Department Finding 2: Complies Table 3: the four (4) questions regarding the Vacation Closure, per the MCNP and Miami 21 Code Vacating and Closing a Right -of -Way: Capital Expenditures by the City and Reimbursement Requirements by the Applicant Pursuant to Chapter 55-15(a) of the City Code, "any ... applicant requesting to vacate and close a right(s)-of-way shall research and obtain a confirmation from the City's Office of Capital Improvements and the Department of Resilience and Public Works regarding whether the city expended any funds for improvements on the right(s)-of-way proposed to be vacated and closed within the prior 50 years, except as to restricted funds required to be repaid regardless of PZ-23-16250: 8347 BISCAYNE BLVD-Vacation Closure — Page 8 of 26 11/2/2023 the timeframe ("confirmation"). If the confirmation indicates that funds were expended, the City's Finance Department and Office of Management and Budget will determine the total amount of the city's expenditure, specifically including expenditure of restricted funds (bond funds, grant funds, or otherwise) for such improvements as a separate line item." City's Department of Resilience and Public Works — Capital Expenditures Confirmation The Applicant submitted a letter drafted by the City's Department of Resilience and Public Works on June 15, 2023 called the "Little River Heights - Tentative Plat #2003Vacation of Right of Way — Expenditures of Funds/Restricted Funds Confirmation (the "Public Work's Confirmation Letter"). In the Public Work's Confirmation Letter, the City's Department of Resilience and Public Works identified the following City project that is linked to the right of way, that being NE 83 Lane, proposed to be vacated and closed: North Shorecrest Roads Project — B-30035A, refer to Attachment 4 — PZ-23-16250_Public Works Confirmation Letter. City's Office of Capital Improvements — confirmation The Applicant submitted a letter drafted by the City's Department of Office of Capital Improvements on October 20, 2023 called the "Little River Heights - Tentative Plat #2003 Vacation of Right of Way — Expenditures of Funds/Restricted Funds "Confirmation" (the "OCI Confirmation Letter"). In the OCI Confirmation Letter, the City's Office of Capital Improvements identified the following City project that is linked to the right of way, that being NE 83 Lane, proposed to be vacated and closed: North Shorecrest Roads Project, B-30035A, please refer to Attachment 5 — PZ-23-16250 OCI Confirmation Letter. CONCLUSION Based on the facts and findings from the Plat and Street Committee and Staff's findings, the Planning Department recommends Approval with Conditions for the vacating and closure of right-of-way as part of the Little River Heights - Tentative Plat #2003. The Conditions of Approval are listed below: F. CONDITIONS 1. The vacation and closure of the Street Vacation Area shall be developed in accordance with the Tentative Plat entitled the "Little River Heights - Tentative Plat #2003", as prepared, signed, and sealed by Mark Steven Johnson, Professional Land Surveyor (License number 4775) of Schwebke-Shiskin & Associates, Inc. with a survey date of November 28, 2022. PZ-23-16250: 8347 BISCAYNE BLVD-Vacation Closure — Page 9 of 26 11/2/2023 2. A building permit, including phased permits, will not be issued on the property being platted until the final plat is recorded in the official records of Miami -Dade County, Florida or as authorized by Section 55-10(j) of the City of Miami Code of Ordinances, as amended. 3. A temporary certificate of occupancy or a certificate of occupancy shall not be issued, unless and until the governmental agency or developer obtains final plat approval and records the final plat in the official records of Miami -Dade County, Florida, within the recordation period, as defined in Section 55-10(j)(10) of the City of Miami Code of Ordinances, as amended. 4. The City reserves the right to inspect the site to ensure compliance with the conditions listed. 5. Failure to comply with the conditions herein may result in the immediate revocation of this "Vacation Closure" application and shall be subject to any fines and penalties pursuant to the City Code. 6. Pursuant to Chapter 55, Section 55-15 of the City Code, "[an] approval of the requested vacation and closure shall be valid for a period of four years and shall remain independent of the referenced tentative plat during this period. The approved final plat must be recorded within the four-year approval period of the requested vacation and closure. Any revised tentative plat submitted for review subsequent to the approved vacation and closure must be compatible with the approved vacation and closure, as determined by the plat and street committee. The tentative plat most recently approved by the plat and street committee shall be the official tentative plat of reference when submitting documents for final plat approval by the City Commission." Area in acres needs to be revised. b. The signature block needs corrections c. The notary section needs corrections. The name of the owner and company does not match the signature block. Provide clarification. Add title and state of registration. 2. On the Opinion of Title print the name and Florida Bar number of Attorney. 3. The Authority is self-serving. Submit a company resolution signed by the appropriate individuals. 4. School Concurrency a. Application phone required. b. Total Acreage needs corrections to match the tentative plat. c. Need corrections on signature lines. d. Notary needs to be corrected. Refer to application comment (1)(c). 5. The name of the underlying plat needs to be corrected on the Application, Opinion of Title, and Tentative Plat, b. Tentative Pat needs corrections. a. Add the survey date. b. Correct the North arrow in the main sketch, it is not pointing due north. c. Location Sketch needs corrections. d. Show the correct distances along the centerline and monument line on Biscayne Boulevard. 7. Provide corrections to underground drainage information. 8. Storm water drainage system improvements will be required as part of the subdivision improvements on the right-of-way. Proposed tract lines and zoning transect lines do not match. Contact the Planning Department and obtain confirmation that the City's G.I.S. information has been revised to match with the tentative plat. 10. Revised the tract areas in the development information, it does not match with the Surveyor's Notes. 11. The tentative plat cannot be submitted or used to obtain a building permit until all of the above conditions have been satisfied. Standard Comments 12. Provide updated tentative plat survey prior to final plat submittal to be reviewed by Committee members for compliance to applicable City Codes. 13. All easements by separate instruments listed in the Opinion of Title must be plotted and annotated on tentative plat. Otherwise, the tentative plat is NOT permitted to be used for Building permitting purposes under the provisions of City Code Section 55-10(i). 14. Execution of Covenant for Postponement of Subdivision Improvements is required in cases where the required subdivision improvements are not completed. 15. Any covenants applicable to the subject property, as required for the Building permit application and/or as captured in the Opinion of Title submitted prior to Final Plat submittal, will need to be annotated in the Final Plat. 16. A letter from Comcast is required to determine if any adjustments to their facilities or easements are required. 17. Verify with Miami -Dade County that the proposed plat name is acceptable. 18. All encroachments across proposed tract and/or lot lines, must be removed prior to fmal plat submittal. 19. An Opinion of Title, in the City of Miami Opinion of Title form, must be provided at the time of final plat submittal. 20. Current backup documentation will be required for all who execute the final plat. A resolution for authority to execute documents and a Certificate of Good Standing from the Secretary of State are required, if applicable. 21. Tentative plat application must be made with Miami -Dade County after receiving approval from the City of Miami Plat and Street Committee. 22. Be advised that an incomplete final plat package will not be accepted by the City of Miami. It is the owner's responsibility to work with his/her surveyor and attorney to assure that everything is in order before submitting the fmal plat package. 23. Be advised that if all requirements for scheduling the fmal plat for City Commission action are not in order, the final plat will not be scheduled for a City Commission meeting. 24. A letter of concurrency from Miami -Dade County School Board is required prior to the final plat submittal. 25. A letter from the Miami -Dade Water and Sewer Department is required to determine if any adjustments to their facilities or easements are required. 26. A letter from Miami -Dade Water and Sewer Department is required to release the final plat in connection with water and sewer service agreements. 27. Provide two 8 'A" x 11" sketches of the division of the land; one sketch of the existing divisions before the plat is recorded and one sketch of the divisions after the plat is recorded. 28. Existing utilities located within the street to be closed and vacated must be relocated or easements provided. 29. Provide a legal opinion as to if any claim has been filed prior to July 1, 1972 for reversionary rights to the street to be closed and vacated, pursuant to Florida Statutes Chapter 177, Section 177.085(2). Subdivider is to comply with the requirements of City of Miami Code, Chapter 55, Section 55- 15(a). 31. An opinion of title as to the reversionary rights for the right-of-way to be closed and vacated will be required by the Planning, Zoning and Appeals Board. The opinion of title must also address whether or not there are individuals, in addition to the abutting property owners, having an interest in the right-of-way to be closed and vacated. A copy of the opinion of title must be provided to the Resilience and Public Works Department. 32. The Planning, Zoning and Appeals Board will require a sketch and legal description with a square footage, on an 8 '/: x 11" paper, for the proposed closure. Contact the Office of the Hearing Boards, at 305-416-2030. Provide a copy to the Resilience and Public Works Department. 33. The Plat and Street Committee has reviewed the tentative plat of Little River Heights and determined that all technical requirements contained in the Miami City Code Subdivision Regulations have been met and has approved the tentative plat. The members of the Plat and Street Committee have further considered the request for vacation and closure of the street with respect to Miami City Code Requirements and have voted six (6) in favor and zero (0) in denial of this vacation and closure request. In addition to the above requirements, you should be aware of the following: I. State and local laws require the installation of various physical improvements in the public rights - of -way when property is platted. These subdivision improvements include paving, drainage, landscaping, sidewalks, etc. In some cases, this could represent a substantial investment on your part. REQUIRED: The submission of an electronic file of the tentative plat, in an AutoCAD, to the City of Miami Resilience and Public Works Department, Development and Roadway Plans Section will EXPEDITE the preparation and enhance the ACCURACY of the subdivision improvement letter required for the final plat approval. 2. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric, telephone, water, etc., caused by this plat will be at the property owner's expense. Also, utility easements may be required on the property being platted. 3. A building permit will not be issued on the property being platted until the final plat is recorded or as authorized by the City of Miami Code Section 55-10(i). Also, the Temporary Certificate Occupancy and/or Certificate of Occupancy for any building construction will be issued only after all the required subdivision improvements have been completed. 4. Approval for fire flow requirements must be obtained from the Fire -Rescue Department prior to the issuance of a building permit. 5. The results of the Committee's review of the public interest findings concerning the closure are summarized as follows: "LITTLE RIVER HEIGHTS" Tentative Plat #2003 (N.E. 83 Lane between Biscayne Boulevard and dead end to the east) 1. N.E. 83 Lane is a "dead-end" street which is not designed according to present day standards and requirements. The applicant is the owner of all the properties abutting N.E. 83 Lane, and is a mixed used commercial and residential development consistent with the area's Comprehensive Plan and Zoning designations. The vacation and closure of the right-of-way and the proposed development will be a considerable improvement to the area, and will add to the City's tax base. 2. The entire length of N.E. 83 Lane is only being utilized by the applicant and its tenants. The general public is not utilizing N.E. 83 Lane as it does not connect with any other street. The only public service vehicles which utilize N.E. 83 Lane are the ones servicing the applicant and its tenants. 3. Police, fire, and emergency services will not be adversely affected by the proposed vacation and closure of the right-of- way since the street proposed to be vacated and closed does not connect with any other street. 4. The vacation and closure of N.E. 83 Lane would have a beneficial effect on pedestrian and vehicular circulation in the area, in that a "dead-end" condition will be terminated, and the sidewalks and streetscapes in the proposed development will be considerable improvement over existing conditions. The Plat and Street Committee members voted to recommend 6 in favor and 0 in denial of this alley vacation and closure request.
