HomeMy WebLinkAboutExhibit AEXHIBIT A CERTIFICATION AND DECLARATION OF RESULTS FOR THE CITY OF MIAMI RUN-OFF ELECTION HELD ON NOVEMBER 21, 2023 STATE OF FLORIDA MIAMI-DADE COUNTY CITY OF MIAMI I, Todd B. Hannon, City Clerk of the City of Miami, Florida, do hereby certify that all necessary legal steps were taken in connection with the conduct of the City of Miami Run - Off Election held on November 21, 2023, including, though not limited to, the following: I. Wednesday, November 15, 2023: A. Commencing at approximately 2:00 p.m., the Miami -Dade County Supervisor of Elections (hereinafter referred to as "Supervisor of Elections") conducted a logic and accuracy test of the touch screen and optical scan voting systems to be used for vote -by -mail, early voting, and precinct ballots, and automated independent audit system for the November 21, 2023 City of Miami Run -Off Election at the Miami -Dade Elections Department located at 2700 NW 87th Avenue, Doral, Florida (hereinafter "Elections Department"). B. A member from the City of Miami's Canvassing Board (hereinafter "Canvassing Board") compared the test results with the predetermined totals for each candidate used for the Logic and Accuracy Test and pursuant to the requirements established in Section 101.5612, Florida Statutes, observed the performance and results of all required tests and verified the correctness of the programs and equipment. C. I further certify that on Wednesday, November 15, 2023, two sets of documents containing the results of the Logic and Accuracy Tests validated that the tabulating equipment was functioning correctly and that said documents were signed off by the Supervisor of Elections and City Clerk. These documents were then placed in a sealed canvass bag using seal number 0051320. II. Friday, November 17, 2023 through Monday, November 27, 2023: A. The Supervisor of Elections allowed the public to inspect vote -by -mail ballots from 8:00 a.m. to 8:30 a.m. B. The Supervisor of Elections allowed daily opportunity for candidates, political party officials, political committee officials, or authorized designees to inspect vote -by -mail ballot and ballot materials from 8:30 a.m. to 9:00 a.m. (only Page 1 of 4 Certification and Declaration of Results — November 21, 2023 Run -Off Election provided if a written request was received no later than 48 hours prior to the scheduled inspection). III. Friday, November 17, 2023: A. Commencing at approximately 10:00 a.m., a majority of the members of the Canvassing Board met to commence various tasks that included authorizing the Supervisor of Elections to begin the opening and processing of vote -by -mail ballots and, if needed, duplication of ballots. These tasks were continued on an as -needed basis. B. Commencing at approximately 10:00 a.m., a majority of the members of the Canvassing Board authorized the Supervisor of Elections to begin the scanning of ballots into an automated independent audit system on an as -needed basis. IV. Tuesday, November 21, 2023: A. The Supervisor of Elections allowed the public to inspect vote -by -mail ballots from 11:30 a.m. to 12:00 p.m. B. The Supervisor of Elections allowed daily opportunity for candidates, political party officials, political committee officials, or authorized designees to inspect vote -by -mail ballot and ballot materials from 12:00 p.m. to 12:30 p.m. (only provided if a written request was received no later than 48 hours prior to the scheduled inspection). C. At approximately 5:00 p.m. the Canvassing Board met to perform various tasks that included canvassing of presumed invalid vote -by -mail ballots and the duplication of ballots (as needed). D. At approximately 8:53 p.m., the tabulation of results was completed, and the Supervisor of Elections provided the UNOFFICIAL election results for the November 21, 2023 Run -Off Election. Pursuant to Sections 101.68(4) and 101.048(6), Florida Statutes, persons casting vote -by -mail and provisional ballots have the right to present written evidence supporting his or her eligibility to vote to the Supervisor of Elections by no later than 5:00 p.m. on the second day following the election. The deadline to provide said evidence was Thursday, November 23, 2023, by 5:00 p.m. V. Monday, November 27, 2023: A. The Canvassing Board met at the Elections Department at approximately 2:00 p.m. to canvass vote -by -mail ballots and provisional ballots as needed. Pursuant to Sections 101.68(4) and 101.048(6), Florida Statutes, persons casting vote -by -mail and provisional ballots have the right to present written evidence supporting his or her eligibility to vote to the Supervisor of Elections by no later than 5:00 p.m. on the second day following the election. The deadline to provide said evidence was Thursday, November 23, 2023, by 5:00 p.m. After the Canvassing Board reviewed presumed invalid vote -by -mail ballots in addition to provisional ballots cast on Election Day, I received the Page 2 of 4 Certification and Declaration of Results — November 21, 2023 Run -Off Election certified OFFICIAL election results for the Run -Off Election from the Supervisor of Elections. The official election results are on file with the Office of the City Clerk. VI. I further certify and declare that for: • District 1 Commissioner, Miguel Angel Gabela received the greatest number of votes cast and is hereby declared to have been elected as Miami City Commissioner for District 1. • District 2 Commissioner, Damian Pardo received the greatest number of votes cast and is hereby declared to have been elected as Miami City Commissioner for District 2. VIII. Wednesday, November 29, 2023: On Wednesday, November 29, 2023, a majority of the members of the Canvassing Board met at the Elections Department at approximately 2:00 p.m. to conduct an automated post -election audit in accordance with Florida Division of Elections Rule Page 3 of 4 Certification and Declaration of Results — November 21, 2023 Run -Off Election 1 S-5.026. The Elections Department used the Clear Ballot automated independent audit system to conduct the post -election audit for all ballots cast in every precinct associated with the two races involved in the November 21, 2023 Run -Off Election. Upon the completion of the audit, I received the Voting System Post -Election Audit Report and Post -Election Audit Comparison Report.
