Ya llevo cuatro aflos en Este problema con una considerable

nueva Crdenanza tenia otro bete ( S. 12,GC0; me to tuve ^ue
llevar para otro lugar y regalarlo en S 3,5C0.
Como Ud comprendera es una situaci5n bastante dura Para mi
y para los riles y miles de duenos de botes cue to tienen

Yo tenis mi bote parqueado frente a mi Casa#sintiendome feliz de
poder salir a pescar con mi senora los fines de semana.Una buena
msfisna as aparec16 por mi casa un inspector del Zonning llamado
Jhon Glass y me entreg6 uns notificaci6n (copia adjunts) an Is
c6al me comunicaba qua debia remover mi botete incluso mi camio-
nete con la cual me gano el sustento junto con mi hijo.
Removi mi bote y mi camioneta y acto aeguido me present6 an el
Zonning pars qua se me aclarars mi situacl6n.E Sr. Gonzalez qua
me atendi6 me dijo que todo pudiera oar producto de una denuncia
y que estabs prohibido por la ordenanza parquear botes frente a
lam casas.Le dije que on Miami hay cientos de miles de botes on
las mismas circunstancias aue las miss y porque se permitia,y me
contest6 que cada caso era individual que to que podia hacer era
it a ver al Sr Aurelio E.P6rez del Planning and ,'conning Admon.

Reco jo mis planos y vuelvo de nuovo a ver a la Sra Reed,la cual
me explic6 qua no tenia derecho a aplicar pars Is Variante ya que
la ordenenza dice que no me permiten botes frente a mi casa.
Me recomend6 aue fuera al Plannig Dpt que as el que puede cambiar
Is ordenanza. 7-a por todo to antes expuesto que me encuentro aqui

Miami residents who illegally
park boats in their front yards
would be allowed to keep them
there under a proposal considered
Wednesday by the Miami Planning
Advisory Board.
"The City Commission passed a
hot potato to us," said Board
Chairman Herbert Lee Simon.
The city doesn't know just how
many people keep boats in their
front yards. Miami Planning Di-
rector Sergio Rodriguez guessed
that many do because of the
limited number of available moor-
ing spaces. Miami residents own
about 10.000 boats, he estimated.
Under the proposal, a rule
prohibiting people from keeping
small craft in front yards would be
lifted, but the boat owners would
have to get a special city permit.
"If it's something that would be
an eyesore, we probably won't
permit it," said Joseph Genuardi,
the city's zoning administrator.
The city would reserve the right
to reinstate the ban after a
one-year trial. It also would pro-
hibit boat repairs in front yards.
The board twice tried to take a
stand on the issue. A motion to
reject the proposal failed by a 4.5
vote. A move to approve it then
placed
ermits
lost by a 7- 2 vote.
The City Commission is sched-
uled to discuss the matter April 23.
This is the second time the
planning board has considered the
measure. In November 1985. it
opposed it.
When the commission took up cn
the board's negative recommenda- ;
tion. it was unable reach a y
conclusion and sent it back to the
board. That was in April 1986. 9
Commissioner Joe Carollo, who
favors the measure, recently res-
urrected the issue by having it
scheduled before the planning m
board.
At Wednesday's meeting, Simon
slid. "If I had aboat and I couldn't
keep it in the back. I'd want to put "
it in the front. The problem is with
appearances. It's OK if it's in your
neighborhood, but not in mine." T

It is recommended by the Planning Advisory
Board that amendments to the text of
Ordinance 9500, the coning Ordinance of the
City of Miami by amending ARTICLE 20.
GENERAL AND SUPPLEMENTARY REGULATIONS,
Section 2020 be denied.
The Planning Advisory Board, at its meeting of November 20, 1985, Item 1,
following an advertised hearing adopted Resolution PAB 64-85 by a 6 to 0 vote,
recommending approval of amendments to the text of Ordinance 95CO, as amended,
the Zoning Ordinance of the City of Miami except for a recommendation of
denial of amendments to Section 2020 Parking and/or storage of certain
vehicles prohibited or limited to specified districts; limitations on
occupancy, Subsections 2020.2.1 Major recreational equipment defined and
2020.2.2 Parking or storage of major recreational equipment as accessory use
in residential districts, by permitting boats and boat trailers in front yards
in the RS and RG-1 districts, subject to limitations and renumbering
paragraphs.
At the Commission meeting of December 19, 1985, Amendment "Q" was continued
pending further dis.:ussion of the proposed amendment to Sections 2020.2.1 and
2020.2.2 pertaining to the parking or storage of boats and ')oat trailers in
front yard areas of residential zoning districts.
As an administrative expediency, Amendment "Q" has now been divided into two
proposed amendments: Amendment "Q-1" is former Amendment "Q" less the
amending language pertaining to Sections 2020.2.1 and 2020.2.2 (boats and boat
trailers) and Amendment "Q-2" pertains only to Sections 2020.2.1 and 2020.2.2
(boats and trailers).
Backup information is included for your information.
An ORDINANCE to provide for the above has been prepared by the City Attorney's
Office and submitted for consideration of the City Commission.

Amendment "Q", Zoning Ordinance 9500, Agenda Item PZ-11, City Commission
Meeting of December 19, 1985, was deferred by Motion 85-1253 5ecause one of
the Commissioners took exception to one provision of the proposed amendment,
i.e. the proposal to allow storage and parking of boats and boat trailers in
front yards in residential districts.
Per agreement with the Law Department, Amendment "0" is now being divided into
two proposed amendments for the City Commission Planning and Zoning Agenda of
January 23, 1986: Amendment "Q-1" includes previous amendment "0" except for
the controversal provis'ons for boats and boat trailers and Amendment -2"
contains only the language on boats and boat trailers. The purpose of this
division Ts to separate a controversial item from other non -controversial
items.
Please be assured that this division is a change in format only and does not
represent a substantive change from the item as reviewed anddeferred by the
City Commission on December 19, 1985 or as recommended, with an execption, by
the Planning Advisory Board on November 20, 1985.

BACKGROUND The Planning Department has met with the Zoning
Division, Fire, Rescue and Inspection Services
Department to review various problems in
administering Zoning Ordinance 9500.
ANALYSIS These proposed amendments would:
1. By Class B special permit, allow boats and
boat trailers in front of homes in t e

restrictions on space available (50' x 20'),
boat and trailer numbers (1) and maximum
sizes (24' x 8'). They could not be parked
parallel to the front of the house and all
masts would have to be down.

PAB 64-85, by a 5 to 0 vote, RECOMMENDING APPROVAL of amending Ordinance No.
9055, as amended, with the exception of Section 2020 herein pertaining tb
parking and storage of boats and boat trailers, which received, within P.AB 64-
85, a RECOMMENDATION OF DENIAL; and
'WHEREAS, the City Commission, after consideration of this matter, deems
it advisable and in the best interest of the general welfare of the City of
Miami and its inhabitants to grant these amendments, as hereinafter set forth;
NOW, -THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Ordinance No. 9500, the Zoning Ordinance of the City of
Miami, Florida, is hereby amended by amending the text of said Ordinance as
fol1ows:1/

2020.2.1. Major recreational equipment defined. Por purposes of
these regulations, major recreational equipment is
defined as boats and boat trai1 ers and other major
recreational equipment including travel trailers,
pickup campers, converted trucks or buses, motorized
homes, tent campers, tents, or other short term
housing or shelter arrangements and devices,--boi:z
And Kos% combinations thereof, and other
similar equipment, and trailers, cases, and boxes for
transporting recreational equipment, whether occupied
by such equipment or not.
2020.2.2. Parking or Storage of Major Recreational Equipment as
Accessory Use in Residential Districts.
Parking or storage of major recreational equipment
shall be permitted as an accessory use in residential
districts only in accordance with the following
limitations:
( a ) Such aqwipmemt rmhaoll

permitted anywhere on the premises or on
adjacent
streets or
alleys (if otherwise
lawful)
for not
to exceed
twelve (12) hours
during
loading and unloading;
(b) Boats and boat trailers may be parked or stored
in front of a principal structure in the RS and
RG-1 districts only, provided that there is a
twenty (20) foot deep by fifty (50) foot wide
minimum area available with five (5) feet clear
of obstructions within the fifty (50) foot wide
Area and on either side and limited to one (1)
boat and trailer per lot with maximum dimensions
of twenty-four (24) feet long by eight (8) feet
wide; not parked or stored parallel to the front
of the principal structure, and all removable
masts are down, subject to Class 8 special

permit. Other major recreational equipment is

excluded from this arovision;
(c) In all other residential districts, except the
RS and RG-1 districts, major recreational
equipment shall be parked or stored behind the
nearest portion of any building to the street;
(d) 4 .� Major recreational equipment may be parked
or stored Lin any required yard not adjacent to
a street but not ---rh equipment may he Parked
or_.c:ocod if it exceeds a height of six (6) feet
above the ground; provided, however, that masts,
antennas, vent stacks, windshields, or other
minor accessories may exceed this height limit;
(e) 4 -1 Equipment exceeding the limitations set
forth in 4.b4 and (d), above, may be parked
outdoors only in portions of side yards within
the buildable area of the lot, or in rear yards;
(f) 444. Unless such equipment is in usable
condition and carries all required licenses and
inspection stickers, such equipment shall not be
parked or stored other than in completely
enclosed buildings.
These provisions shall not be construed as
prohibiting the docking of boats, or storage in
boathouses, in legally authorized locations in
residential districts.
Section 2. All ordinances, Code Sections, or parts thereof in conflict
herewith are hereby repealed insofar as they are in conflict.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole.
