R-23-0376 ("ADOPTED CAPITAL PLAN"), AS SUBSEQUENTLY AMENDED, AND TO RE -APPROPRIATE, DE -APPROPRIATE, AND APPROPRIATE FUNDING FOR THE EXISTING AND ADDED PROJECTS IN ACCORDANCE WITH EXHIBIT "A", ATTACHED AND INCORPORATED; RATIFYING, APPROVING, AND CONFIRMING CERTAIN NECESSARY ACTIONS BY THE CITY MANAGER AND DESIGNATED CITY OFFICIALS AND DEPARTMENTS IN ORDER TO UPDATE THE RELEVANT FINANCIAL CONTROLS AND COMPUTER SYSTEMS IN CONNECTION THEREWITH FOR ONGOING CAPITAL PROJECTS, PROJECT CLOSE-OUTS, AND FOR GRANTS AND OTHER FUNDING SOURCES IN PROGRESS IN CONNECTION HEREWITH; PROVIDING AN EFFECTIVE DATE. WHEREAS, except for such changes as set forth herein, all previous appropriations remain authorized to continue as previously approved City of Miami ("City") capital projects (new, revised, and continued projects collectively, "Projects") according to the Fiscal Year 2023- 2024 Multi -Year Capital Plan adopted on September 9, 2023 pursuant to Resolution No. R-23- 0376, as subsequently amended ("Adopted Capital Plan"); and WHEREAS, as set forth in the Capital Budget Amendment, attached and incorporated as Exhibit "A," it is necessary to close-out projects, reprogram projects, approve additional projects, and approve additional appropriations, de -appropriations, and re -appropriations for existing sources of revenues for the Fiscal Year 2023-24 Capital Plan, and to add to available balances in Capital Project Funds as set forth below: 31000 - General Government Projects 32000 - Public Safety 33000 - Disaster Recovery 34000 - Public Facilities-CIP 35000 - Parks & Recreation 36000 - Streets & Sidewalks 37000 - Sanitary Sewers 38000 - Storm Sewers 39000 - Solid Waste-CIP 39900 - Mass Transit Previous Amount 97,117,446.72 17,715,262.63 374,380.39 99,887,670.97 140.258.818.22 85,166,743.14 2,273,597.66 142,235,845.99 519,338.12 6,017,763.93 Amendment Amount Final Amount (200,000.00) 96.917.446.72 - 17,715,262.63 374.380.39 4.261.000.00 104,148,670.97 1.704.949.18 141.963.767.40 2,077,355.53 67.244.098.67 - 2.273.597.66 229..695.29 142,465,541.28 200.000.00 719,338.12 - 6.017.763.93 $ 591,566,867.77 $ 8 273,000.00 $599.839,867.77 WHEREAS, American Rescue Plan Act of 2021 ("ARPA") Funds are also included in this re -appropriation; and WHEREAS, the Secretary of the United States Department of the Treasury issued the final rule (31 CFR Part 35) to implement the Coronavirus State Fiscal and Local Fiscal Recovery Funds ("ARPA Funds") established under the American Rescue Plan ("Final Rule"); and WHEREAS, the Final Rule establishes the guidance and eligible uses of the ARPA Funds; and WHEREAS, as listed in Exhibit "A," attached and incorporated, the re -appropriation of the ARPA Funds to OCI Project No. 40-B193515 is conditional and subject to the prior written approval by the City's ARPA Consultants as an eligible use of ARPA Funds under the Final Rule; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission hereby approves, directs, and authorizes' the City Manager to add capital projects to the Adopted Capital Plan, revise current appropriations among approved projects, and further de -appropriate, re -appropriate, and appropriate funding for existing and added projects, all as set forth in Exhibit "A," attached and incorporated, subject to final written approval by the City's ARPA Consultants. Section 3. Certain necessary actions by the City Manager and designated City officials and departments made in order to update the City's relevant financial controls and computer systems for ongoing capital projects, project close-outs, and for grants and other funding sources in progress in connection with the Adopted Capital Plan, the Capital Budget Amendment, attached and incorporated as Exhibit "A," and the City's Final Operating Budget, 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. as amended, to implement the Projects in connection herewith are ratified, approved, and confirmed. Section 4. This Resolution shall become effective immediately upon its adoption and signature by the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
