HomeMy WebLinkAboutPZAB (13937) ResolutionCity of Miami PZAB Resolution Enactment Number: PZAB-R-23-067 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File ID: 13937 Date Rendered: 6/23/2023 A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD RECOMMENDING APPROVAL TO THE MIAMI CITY COMMISSION OF AN ORDINANCE AMENDING ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ("MIAMI 21 CODE") SPECIFICALLY BY AMENDING ARTICLE 1, TITLED "DEFINITIONS," TO ADD NEW DEFINITIONS, AMENDING ARTICLE 3, TITLED "GENERAL TO ZONES," TO CLARIFY AND AMEND THE WAIVER PROCESSES RELATING TO ELDERLY HOUSING OR FOR ADAPTIVE USES IN COMMUNITY REDEVELOPMENT AREAS ("CRA"), AMENDING ARTICLE 4, TITLED "STANDARDS AND TABLES," TO CLARIFY AND AMEND THE WAIVER PROCESSES RELATING TO SUBSTITUTION OF LOADING BERTHS AND OFF -SITE PARKING PLACEMENT, AMENDING ARTICLE 5, TITLED "SPECIFIC TO ZONES," TO CLARIFY AND AMEND THE WAIVER PROCESSES RELATING TO SERVICE AND PARKING ACCESS FROM A PRINCIPAL FRONTAGE AND PEDESTRIAN AND VEHICULAR ENTRY SPACING, AMENDING ARTICLE 6, TITLED "SUPPLEMENTAL REGULATIONS," TO CLARIFY AND AMEND THE WAIVER PROCESSES RELATING TO RESERVOIR PARKING SPACES, AND AMENDING ARTICLE 7, TITLED "PROCEDURES AND NONCONFORMITIES," TO CLARIFY AND AMEND THE WAIVER PROCESSES RELATING TO NONCONFORMING PROPERTIES AND UPDATE THE WAIVERS SUMMARY LIST; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114 as the Zoning Ordinance of the City of Miami, Florida, which has been amended from time to time ("Miami 21 Code"); and WHEREAS, Waivers permit minor deviations from the Miami 21 Code in certain specified circumstances as provided in the various Articles of the Miami 21 Code and as consistent with the Guiding Principles in Article 2 of the Miami 21 Code; and WHEREAS, the Miami 21 Task Force, appointed by the City Commission, made recommendations to simplify the review, permitting, and public hearing processes leading to increased consistency and predictability; and WHEREAS, this ordinance amends the Miami 21 Code to provide applicants and City of Miami ("City") staff with increased clarity and a more streamlined process as summarized below: • Waiver 1. Parking reductions for Elderly Housing or for Adaptive Uses in Community Redevelopment Areas ("CRA") (Article 3, Section 3.6.1 and 3.6.7). This amendment clarifies parking requirements for Adaptive Reuse in CRAs as per Article 7 of the Miami Date Rendered: 6/23/2023 City of Miami Page 1 of 79 File ID: 13937 (Revision:) Printed On: 6/23/2023 21 Code. For Elderly Housing parking reductions, this amendment clarifies eligibility, updates criteria, and replaces the Waiver process with a Warrant process. • Waiver 10. Substitution of loading berths (Article 4, Table 5). This amendment removes the Waiver and allows existing loading berth substitutions By Right. This amendment also introduces new loading berth substitutions for projects greater 500,000 square feet by process of Warrant. The revised text reduces the required Drive Aisle widths and clarifies that no further adjustments to the Drive Aisle or Loading dimensional standards are allowed. In addition, the updated text removes unnecessary loading berth Setbacks as this is regulated elsewhere in the Miami 21 Code. • Waiver 11. Required parking within one thousand feet of the site that it serves (Article 4, Table 4). This amendment introduces a requirement for a covenant for the sending and receiving sites and also clarifies that a sending site shall not be within 500 feet of a T3 Transect Zone. This amendment aims to ensure adequate parking will be maintained at the receiving site and mitigate impacts on adjacent neighborhoods. • Waiver 14. Service and Parking access from Principal Frontage (Article 5, Sections 5.4.2.e, 5.5.2.e and 5.6.2.f). This amendment clarifies the location of loading and service entries and situations when they may be allowable on Primary Frontages. • Waiver 15. Pedestrian and vehicular entry spacing. (Article 5, Sections 5.5.1.f, 5.5.4.e, 5.6.1.f and 5.6.4.g). This amendment provides a new definition for Pedestrian Entrance and clarifies that emergency exits do not fulfill requirement frequency of Pedestrian Entrances with the aim of improving streetscape design and activation of the public realm. Amendment also removes duplicative Vehicular Entry requirement. • Waiver 19. Primary and Secondary Frontage Parking placement (Article 5, Sections 5.5.4.d, 5.5.4.e, 5.6.4.d and 5.6.4.e). This amendment adjusts garage screening requirements depending on parking configuration and Frontage. The amendment maintains the existing one-story Waiver option and introduces a new By Right option requiring two -stories of habitable space that incentivizes higher quality design on Frontages. The proposed amendment also removes the automatic referral to the Urban Development Review Board ("UDRB"). • Waiver 20. Reduction of reservoir parking space (Article 6, Table 13). This amendment removes the Waiver for reservoir parking reductions to ensure adequate reservoir parking is provided on -site and minimizes potential for vehicular queuing within the adjacent right-of-way. • Waiver 26. Modification to nonconforming Off-street Parking facilities involving restoration or rehabilitation of an existing Building or an adaptive Use (Article 7, Section 7.2.8). This amendment incentivizes existing nonconforming properties to come into greater conformance with the Miami 21 Code. The revised text modifies thresholds for when a Waiver is required. WHEREAS, the Planning, Zoning, and Appeals Board ("PZAB") has considered whether the proposed text amendment as stated herein will further the goals, objectives, and policies of City of Miami Page 2 of 79 File ID: 13937 (Revision:) Printed On: 6/23/2023 the Miami Comprehensive Neighborhood Plan ("MCNP"), the Miami 21 Code, and other City regulations; and WHEREAS, the PZAB has considered the need and justification for the proposed text amendment, as stated herein, including changed and changing circumstances; and WHEREAS, the PZAB finds that it is in the best interest of the City and its residents to amend the Miami 21 Code; and WHEREAS, the PZAB recommends approval to the City Commission of the proposed text amendment, as stated herein; NOW, THEREFORE, BE IT RESOLVED BY THE MIAMI PLANNING, ZONING AND APPEALS BOARD OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The PZAB recommends that the City Commission amend Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended, ("Miami 21 Code") by amending Article 1, titled "Definitions," in the following particulars: "ARTICLE 1. DEFINITIONS 1.2 DEFINITIONS OF TERMS Vehicle Rental Facility: An establishment where motor vehicles are kept and maintained for lease, where such vehicles are dropped off or picked up and where customers complete all transactions necessary for the short term lease of such vehicles. See Article 6. Vehicular Entrance/Entry: The route by which vehicles access Lots or Buildings from the Right -of -Way. Vehicular Entries facilitate ingress and egress for parking, loading, service, drop- off, valet, or similar functions. Section 3. The PZAB recommends approval to the Miami City Commission of an ordinance to amend the Miami 21 Code by amending Article 3, titled "General to Zones," in the following particulars.2 1 Words and/or figures stricken through shall be deleted. Off-street Parking requirements for the individual Transect Zones shall be as set forth in Article 4, Table 4. Where required off-street parking is based on square footage of Use, the calculation shall only include Habitable Rooms and Habitable Space occupied by such Use. b. Off-street Parking dimensions and Shared Parking (mixed -use) reduction table shall be as set forth in Article 4, Table 5. c. Required Parking for Adaptive Uses shall be as set forth in Article 7, Section 7.2.8. Nonconforming Site Improvements may be reduced or exempted by Waiver for properties located in a Community Redevelopment Area, or in areas where a Parking Trust Fund has been established, or for historic sites and contributing Structures within designated historic district. 3.6.7 Off-street Parking Reductions by Use a. Parking reductions for Elderly Housing. 1. Housing for the Elderly, in relation to this regulation, is not to be construed as homes or institutions for the aged which are primarily convalescent or Nursing Homes. 2. Off-street Parking space requirements in connection with Housing for the Elderly conforming to the requirements of state or federal programs may be reduced by Waiver process of Warrant to a minimum maximum of one (1) parking space per every two (2) Dowelling U4nits. 3. The applicant shall submit a parking management plans which demonstrates how the remaining parking deficiency will be mitigated accommodated in the event that the housing becomes market rate housing at some time in the future. The following criteria shall apply: (a) The premises shall be used as Housing for the Elderly, subject to the exceptions and limitations set forth in (a) above, until the parking requirements for a different Use have been met-; and (b) The applicant shall demonstrate that the reduction in Off-street Parking reduction shall be permitted upon a finding by the Planning Director that, in is justified in view of pertinent considerations as specified in the permit, the nature and type of prospective occupancy and the economic circumstances involved, that the impacts from such reduction are not likely to unduly burden traffic and parking facilities in the neighborhood, and there will be adequate Off-street Parking for occupants, visitors, and staff; and (c) Applicant shall submit written certification from the applicable City, Sstate or (Federal agency in charge of the program. *11 City of Miami Page 4 of 79 File ID: 13937 (Revision:) Printed On: 6/23/2023 Section 4. The PZAB recommends approval to the Miami City Commission of an ordinance to amend the Miami 21 Code by amending Article 4, Table 4, titled "Standards and Tables"/"Table 4 Density, Intensity and Parking," in the following particulars.3 "ARTICLE 4. STANDARDS AND TABLES TABLE 4 DENSITY, INTENSITY AND PARKING TABLE 4 DENSITY. INTENSITY AND PARK DENSITY (UPA) RESIDENTIAL ING (T5) RESTRICTED LIMITED OPEN 65 UNITS PER ACRE Residential Uses are permissible as listed in Table 3, limited by compliance with: • Minimum of 1.5 parking spaces per Dwelling Unit. • Minimum of 1 additional visitor parking space for every 10 Dwelling Units. • Adult Family -Care Homes - Minimum 1 space per staff member and 1 space per 4 residents. • Community Residence - Minimum of 1 parking space per staff member in addition to the parking required for the principal Dwelling Unit(s). 65 UNITS PER ACRE Residential Uses are permissible as listed in Table 3, limited by compliance with: • Minimum of 1.5 parking spaces per Dwelling Unit. • Maximum of 1 parking space per Micro Dwelling Unit, with a maximum of 1 additional visitor parking space for every 10 Micro Dwelling Units. • Minimum of 1 additional visitor parking space for every 10 Dwelling Units. • Live -work - Work component shall provide parking as required by the non- residential use in addition to oarkina 65 UNITS PER ACRE Residential Uses are permissible as listed in Table 3, limited by compliance with: • Minimum of 1.5 parking spaces per Dwelling Unit. • Maximum of 1 parking space per Micro Dwelling Unit, with a maximum of 1 additional visitor parking space for every 10 Micro Dwelling Units. • Minimum of 1 additional visitor parking space for every 10 Dwelling Units. • Live -work - Work component shall provide parking as required by the non- residential use in addition to parking required for the Dwelling Unit. 3 Words and/or figures stricken through shall be deleted.
