SUMMARY LIST; MAKING FINDINGS; CONTAINING A SEVERABILITY
CLAUSE; PROVIDING FOR VESTING; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114
as the Zoning Ordinance of the City of Miami, Florida, which has been amended from time to
time ("Miami 21 Code"); and
WHEREAS, Waivers permit minor deviations from the Miami 21 Code in certain
specified circumstances as provided in the various Articles of the Miami 21 Code and as
consistent with the Guiding Principles in Article 2 of the Miami 21 Code; and
WHEREAS, the Miami 21 Task Force, appointed by the City Commission, made
recommendations to simplify the review, permitting, and public hearing processes leading to
increased consistency and predictability; and
WHEREAS, this Ordinance proposed to amend the Miami 21 Code to provide applicants
and City of Miami ("City") staff with increased clarity and a more streamlined process as
summarized below:

• Waiver 1. Parking reductions for Elderly Housing or for Adaptive Uses in Community
Redevelopment Areas ("CRA") (Article 3, Section 3.6.1 and 3.6.7). This amendment
clarifies parking requirements for Adaptive Reuse in CRAs as per Article 7 of the Miami
21 Code. For Elderly Housing parking reductions, this amendment clarifies eligibility,
updates criteria, and replaces the Waiver process with a Warrant process.
• Waiver 10. Substitution of loading berths (Article 4, Table 5). This amendment removes
the Waiver and allows existing loading berth substitutions By Right. This amendment
also introduces new loading berth substitutions for projects greater 500,000 square feet
by process of Warrant. The revised text reduces the required Drive Aisle widths and
clarifies that no further adjustments to the Drive Aisle or Loading dimensional standards
are allowed. In addition, the updated text removes unnecessary loading berth Setbacks
as this is regulated elsewhere in the Miami 21 Code.
• Waiver 11. Required parking within one thousand feet of the site that it serves (Article 4,
Table 4). This amendment introduces a requirement for a covenant for the sending and
receiving sites and also clarifies that a sending site shall not be within 500 feet of a T3
Transect Zone. This amendment aims to ensure adequate parking will be maintained at
the receiving site and mitigate impacts on adjacent neighborhoods.
• Waiver 14. Service and Parking access from Principal Frontage (Article 5, Sections
5.4.2.e, 5.5.2.e and 5.6.2.f). This amendment clarifies the location of loading and
service entries and situations when they may be allowable on Primary Frontages.
• Waiver 15. Pedestrian and vehicular entry spacing. (Article 5,
Sections 5.5.1.f, 5.5.4.e, 5.6.1.f and 5.6.4.g). This amendment provides a new definition
for Pedestrian Entrance and clarifies that emergency exits do not fulfill requirement
frequency of Pedestrian Entrances with the aim of improving streetscape design and
activation of the public realm. Amendment also removes duplicative Vehicular Entry
requirement.
• Waiver 19. Primary and Secondary Frontage Parking placement (Article 5,
Sections 5.5.4.d, 5.5.4.e, 5.6.4.d and 5.6.4.e). This amendment adjusts garage
screening requirements depending on parking configuration and Frontage. The
amendment maintains the existing one-story Waiver option and introduces a new By
Right option requiring two -stories of habitable space that incentivizes higher quality
design on Frontages. The proposed amendment also removes the automatic referral to
the Urban Development Review Board ("UDRB").
• Waiver 20. Reduction of reservoir parking space (Article 6, Table 13). This amendment
removes the Waiver for reservoir parking reductions to ensure adequate reservoir
parking is provided on -site and minimizes potential for vehicular queuing within the
adjacent right-of-way.
• Waiver 26. Modification to nonconforming Off-street Parking facilities involving
restoration or rehabilitation of an existing Building or an adaptive Use (Article 7, Section
7.2.8). This amendment incentivizes existing nonconforming properties to come into
greater conformance with the Miami 21 Code. The revised text modifies thresholds for
when a Waiver is required.
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB"), at its meeting on June
14, 2023, following an advertised public hearing, adopted Resolution No. PZAB-R-23-067 by a
vote of nine to zero (9 - 0), Item No. PZAB. 8, recommending approval of the Zoning Text
Change; and

WHEREAS, the City Commission has considered whether the proposed text amendment
as stated herein will further the goals, objectives, and policies of the Miami Comprehensive
Neighborhood Plan ("MCNP"), the Miami 21 Code, and other City regulations; and
WHEREAS, the City Commission has considered the need and justification for the
proposed text amendment, as stated herein, including changed and changing circumstances;
and
WHEREAS, the City Commission finds that it is in the best interest of the City and its
residents to amend the Miami 21 Code as stated herein; and
WHEREAS, the City Commission approves the Miami 21 Code text amendment, as
stated herein;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Article 1 of the Miami 21 Code is hereby amended in the following
particulars.'
"ARTICLE 1. DEFINITIONS
1.2 DEFINITIONS OF TERMS
Vehicle Rental Facility: An establishment where motor vehicles are kept and maintained for
lease, where such vehicles are dropped off or picked up and where customers complete all
transactions necessary for the short term lease of such vehicles. See Article 6.
Vehicular Entrance/Entry: The route by which vehicles access Lots or Buildings from the
Right -of -Way. Vehicular Entries facilitate ingress and egress for parking, loading, service, drop-
off, valet, or similar functions.
Section 3. Article 3 of the Miami 21 Code is hereby amended in the following particulars.2
"ARTICLE 3. GENERAL TO ZONES

3.6 OFF-STREET PARKING AND LOADING STANDARDS
3.6.1 Off-street Parking Standards
a. Off-street Parking requirements for the individual Transect Zones shall be as set
forth in Article 4, Table 4. Where required off-street parking is based on square
footage of Use, the calculation shall only include Habitable Rooms and Habitable
Space occupied by such Use.
b. Off-street Parking dimensions and Shared Parking (mixed -use) reduction table shall
be as set forth in Article 4, Table 5.
c. Required Parking for Adaptive 1Uses shall be as set forth in Article 7, Section
7.2.8. Nonconforming Site Improvements may be reduced or exempted by Waiver
for properties located in a Community Redevelopment Area, or in areas where a
Perking Tn st F ind has boon ectabliched or for historic cites and contribi sting
Structures within designated historic districts.
3.6.7 Off-street Parking Reductions by Use
a. Parking reductions for Elderly Housing.
1. Housing for the Elderly, in relation to this regulation, is not to be construed as
homes or institutions for the aged which are primarily convalescent or Nursing
Homes.
2. Off-street Parking space requirements in connection with Housing for the Elderly
conforming to the requirements of state or federal programs may be reduced by
Waiver process of Warrant to a minimum maximum of one (1) parking space per
every two (2) Ddwelling U4nits.
3. The applicant shall submit a parking management plans which demonstrates
how the remaining parking deficiency will be mitigated accommodated in the
event that the housing becomes market rate housing at some time in the future.
The following criteria shall apply:
(a) The premises shall be used as Housing for the Elderly, subject to the exceptions
and limitations set forth in (a) above, until the parking requirements for a different
Use have been met-; and
(b) The applicant shall demonstrate that the reduction in Off-street Parking reduction
shall be permitted upon a finding by the Planning Director that, in is justified in view
of location of such housing, the economic status of anticipated occupants, and other
pertinent considerations as specified in the permit, the nature and type of prospective
occupancy and the economic circumstances involved, that the impacts from such
reduction are not likely to unduly burden traffic and parking facilities in the
neighborhood, and there will be adequate Off-street Parking for occupants, visitors,
and staff; and
(c) Applicant shall submit written certification from the applicable City, Sstate or
#Federal agency in charge of the program.

5.4 GENERAL URBAN TRANSECT ZONES (T4)
5.4.2 Building Configuration (T4)
e. Loading and service entries shall be at the Third Layer and shall be accessed from Alleys
when available and otherwise from the Secondary Frontage. When a Lot has only Principal
Frontages, vVehicular eEntries; and Loading Docks and service areasSpaces shall be as within
the Third Layer and access shall be permitted on Principal Frontages. Where a Lot is located
on one (1) or more State or County Thoroughfares and is within 200 feet of a T3 Transect Zone
on the same side of such Thoroughfare, all Wehicular eEntries; and Loading Docks, a
cervicc ar s Spaces shall be from the Principal Frontage.
5.5 URBAN CENTER TRANSECT ZONES (T5)
5.5.1 Building Disposition (T5)
a. Newly platted Lots shall be dimensioned according to Illustration 5.5.
b. Lot GCoverage by any Building shall not exceed that shown in Illustration 5.5.
c. Buildings shall be disposed in relation to the boundaries of their Lots according to
Illustration 5.5.
d. Buildings shall have their principal Ppedestrian Eentrances on a Frontage Line or from a
Courtyard at the Second Layer.
e. For the minimum Height, Facades shall be built parallel to the Principal Frontage Line
along a minimum of seventy percent (70%) of its length on the Setback Line as shown
in Illustration 5.5 or as modified pursuant to Appendix B — Waterfront Design Guidelines,
Section 2.3(a) for Frontages along a Waterfront. In the absence of a Building along the
remainder of the Frontage Line, a Streetscreen shall be built co -planar with the Facade
to conceal parking and service areas.
f. At the first Story, Facades along a Frontage Line shall have frequent doors and
windows_Pedestrian Eentrances shall occur at a maximum spacing of seventy-five
(75) feet and vchicular cntrics shall occur at a minimum spacing of sixty (60) feet, unless
approved by Waiver.
5.5.2 Building Configuration (T5)
a. Development within Private Frontages shall comply with Article 4, Tables 2 and 6 and
Illustration 5.5.
b. Encroachments shall be as follows: At the First Layer, cantilevered Awnings and entry
canopies may encroach up to one hundred percent (100%) of the depth of the Setback;
except as may be further allowed by Chapter 54 of the City Code; above the first Story,
cantilevered balconies, bay windows, roofs and Facade components promoting energy
efficiency such as shading and Screening devices that are non -accessible, may
encroach a maximum of three (3) feet into the Setback. Other cantilevered portions of
the Building shall maintain the required Setback. In the event an existing Building is
raised in order to bring the finished floor elevation above the Base Flood Elevation plus

Freeboard, stairs and ramps required for vertical circulation may encroach one hundred
percent (100%) of the Setback by process of Waiver. At the Second and Third Layers,
no encroachments are permitted.
c. Galleries and Arcades shall be a minimum fifteen (15) feet deep and may encroach up to
one hundred percent (100%) of the depth of the Setback by process of a Special Area
Plan.
d. Screen enclosures shall be located within the Second or Third Layer only and shall have
a five (5) feet minimum side and rear Setback when Abutting T3 or T4.
e. Loading and service entries shall be at the Third Layer and shall be accessed from
Alleys when available and otherwise from the Secondary Frontage. When a Lot has only
Principal Frontages, Wehicular eEntries, Loading Docks and service areas Spaces shall
be a4within the Third Layer and access shall be permitted on Principal Frontages. Where
a Lot is located on one or more State or County Thoroughfares and is within 200 feet of
a T3 Transect Zone on the same side of such Thoroughfare, all Wehicular Entries and
Loading Docks and service areas Spaces shall be accessed from a single access point
on the Principal Frontage.
5.5.4 Parking Standards (T5)
a. Vehicular parking and loading shall be required as shown in Article 4, Tables 4 and 5.
b. On -street parking available along the Frontage Lines that correspond to each Lot shall
be counted toward the parking requirement of the Building on the Lot.
c. Parking should be accessed by an Alley. Parking shall be accessed from the Secondary
Frontage when available. Where Lots have only Principal Frontages, parking may be
accessed from the Principal Frontages.
d. Primary Frontage: All pParking including drop-off drives and porte-cocheres, open
parking areas, covered parking, Parking gGarages, Loading space and service areas
shall be located within the Third Layer and shall be masked from the Frontage by a Liner
Building or Streetscreen as illustrated in Article 4, Table 8. Ground Level pParking may
extend into the Second Layer a maximum of twenty five percent (25%) of the length of
the Primary Frontage or up to a maximum of fifty (50) feet, whichever is less. A Liner
shall be provided for the length of the Pedestal, as shown in Illustration 5.5. Alternative
Parking options shall be as follows:
i_ Aabove the first Story, Parking may extend into the Second Layer by Waiver if an
art or glass treatment of a design to be approved by the Planning Director with
the recommendation of the Urban Development Review Board is provided for
one hundred percent (100%) of that portion of the Pedestal Facade. Surface
parking may extend into the Second Layer a maximum of twenty five percent
(25%) of the length of the Primary Frontage up to a maximum of fifty (50) feet.
ii. Above the second Story, Parking may extend into the Second Layer By Right if
Liners are provided at the ground and second stories which fully conceal the
parking and if an art or glass treatment, of a design to be approved by the
Planning Director, is provided for one hundred percent (100%) of that portion of
the Pedestal Facade where there is no Liner.
e. Secondary Frontage. All Parking, open parking areas, covered parking, Parking
Ggarages, Loading Spaces, and service areas shall be located in the Third Layer_
Parking may extend into the Second Layer a maximum of fifty percent (50%) of the
length of the Frontage, as shown in Illustration 5.5. and shall be masked from the
Frontage by a A Liner Building or Streetscreen shall be provided for a minimum of fifty

underground and does not require raising first -floor elevation of the First and Second
Layers above that of the Sidewalk. Ramps to underground parking shall be only within
the Second and Third Layers.
g. The A vVehicular ent eEntry of a parking lot or garage on a Frontage shall be no
wider than twenty-five (25) feet and the minimum distance between Wehicular
ent ecEntries shall be sixty (60) feet, unless approved by Waiver.
h. Pedestrian eEntrances to all parking lots and parking structures shall be directly from a
Frontage Line. Underground parking structures should be entered by pedestrians
directly from a Principal Building.
i. Buildings mixing Uses shall provide parking for each Use. Shared Parking shall be
calculated according to Article 4, Table 5.
5.6 URBAN CORE TRANSECT ZONES (T6)
5.6.1 Building Disposition (T6)
a. Newly platted Lots shall be dimensioned according to Illustration 5.6.
b. Lot coverage by any Building shall not exceed that shown in Illustration 5.6.
c. Buildings shall be disposed in relation to the boundaries of their Lots according to
Illustration 5.6.
d. Buildings shall have their principal Ppedestrian Eentrances on a Frontage Line or from a
courtyard at the Second Layer.
e. For the minimum Height, Facades shall be built parallel to the Principal Frontage Line
along a minimum of seventy percent (70%) of its length on the Setback Line as shown
in Illustration 5.6. In the absence of Building along the remainder of the Frontage Line, a
Streetscreen shall be built co -planar with the Facade to shield parking and service
areas. In the case of two (2) or three (3) Principal Frontages meeting at Thoroughfare
intersections, the Building corner may recede from the designated Setback up to twenty
percent (20%) of the Lot length.
f. At the first Story, Facades along a Frontage Line shall have frequent doors and
windows_pPedestrian Eentrances shall occur at a maximum spacing of seventy-five
(75) feet and vchicular cntrics shall occur at a minimum spacing of sixty (60) feet, unless
approved by Waiver.
5.6.2 Building Configuration (T6)
a. Development within Private Frontages shall comply with Article 4, Table 2 and 6 and
Illustration 5.6.
b. Above the eighth floor, the Building Floorplate dimensions shall be limited as follows:

c. Encroachments shall be as follows: At the First Layer, cantilevered Awnings and entry
canopies may encroach up to one hundred percent (100%) of the depth of the Setback,
except as may be further allowed by Chapter 54 of the City Code. Above the first Story,
cantilevered balconies, bay windows, roofs, or Facade components promoting energy
efficiency, such as shading and Screening devices, that are non -accessible may
encroach up to three (3) feet of the depth of the Setback. Other cantilevered portions of
the Building shall maintain the required Setback. Above the eighth Story when additional
setbacks are required as detailed in Illustration 5.6, Facade components promoting
energy efficiency such as shading and Screening devices, that are non -accessible or
balconies may encroach a maximum of three (3) feet. In the event an existing Building is
raised in order to bring the finished floor elevation above the Base Flood Elevation plus
Freeboard, stairs and ramps required for vertical circulation may encroach one hundred
percent (100%) of the Setback by process of Waiver.
d. Galleries and Arcades shall be minimum fifteen (15) feet deep, shall encroach one
hundred percent (100%) of the depth of the Setback and shall overlap the whole width of
the Sidewalk to within two (2) feet of the curb. Permitted by process of a Special Area
Plan.
e. All outdoor storage, electrical, plumbing, mechanical, and communications equipment
and appurtenant enclosures shall be located within the Second or Third Layer and
concealed from view from any Frontage or Sidewalk by Liner Buildings, walls,
Streetscreens, or opaque gates. These s5.5.2hall not be allowed as Encroachments.
f Loading and service entries shall be at the Third Layer and shall be accessed from
Alleys when available and otherwise from the Secondary Frontage. Loading spaces and
service areas shall be internal to the building. When a Lot has only Principal Frontages,
vVehicular eEntries, Loading Docks and service areas Spaces shall be atwithin the Third
Layer and access shall be permitted on Principal Frontages. Where a Lot is located on
one or more State or County Thoroughfares and is within 200 feet of a T3 Transect Zone
on the same side of such Thoroughfare, Wehicular eEntries; and Loading Docks and
service areas Spaces shall be accessed from a single access point on the Principal
Frontage.
5.6.4 Parking Standards (T6)
a. Vehicular parking and loading shall be required as shown in Article 4, Tables 4 and 5.
b. On -street parking available along the Frontage Lines that correspond to each Lot shall
be counted toward the parking requirement of the Building on the Lot.
c. Parking should be accessed by an Alley. Parking shall be accessed from the Secondary
Frontage when available. Where Lots have only Principal Frontages, parking may be
accessed from the Principal Frontages.
d. Primary Frontage: All pParking including drop-off drives and porte-cocheres, open
parking areas, covered parking, Parking gGarages, Loading space and service areas

shall be located within the Third Layer and shall be masked from the Frontage by a Liner
Building or Streetscreen as illustrated in Article 4, Table 8. Ground Level pParking may

the Primary Frontage or up to a maximum of fifty (50) feet, whichever is less. A Liner
shall be provided for the length of the Pedestal, as shown in Illustration 5.6. Alternative
Parking options shall be as follows:
i. Aabove the first Story, Parking may extend into the Second Layer by Waiver, if
an art or glass treatment of a design to be approved by the Planning Director

gGarages, Loading Spaces, and service areas shall be located in the Third Layer.
Parking may extend into the Second Layer a maximum of fifty percent (50%) of the
length of the Frontage, as shown in Illustration 5.6. and shall be masked from the
Frontage by a A Liner Building or Streetscreen shall be provided for a minimum of fifty
percent (50%) of the length of the frontage or height of the pPedestal„ as shown in
Illustration 5.6. Where open parking areas are not masked by a Liner they shall be

Where legal nonconforming site improvements exist, such as Off-street Parking and loading,
access, fences, walls, lighting, landscaping, or similar site improvements, such
nonconformities may continue and the site may be altered only as provided below.
a. Non -conforming site improvements shall be required to conform to the provisions of this
Code if fifty percent (50%) or more of the Floor Area on a Lot is demolished or removed.

b. No change shall be made +to any non -conforming site improvement which increases

placeholder to vest a substantially different project will be permitted to vest under the previous
Miami 21 Code provisions that existed prior to, and were modified by, this Ordinance.
Section 11. It is the intention of the City Commission that the provisions of this
Ordinance shall become and be made a part of the Zoning Ordinance of the City of Miami,
Florida, which provisions may be renumbered or relettered and that the word "ordinance" may
be changed to "section", "article", or other appropriate word to accomplish such intention.
Section 6. This Ordinance shall become effective ten (10) days after final reading and
adoption thereof.8
8 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein. whichever is later.
