9. I am the property owner of Apartment 208 at Brickett Lofts I, 1528 Brickell Avenue,
PZA Miami, FL 33129. I oppose the rezoning of 1500 Brickett Avenue to allow for a Large,
B 80-person outdoor commercial dining area directly adjacent to Brickett Lofts I. An

I write as an owner of a unit at Lofts on Brickell I, a 24-unit residential building; my
unit abuts the proposed outside commercial dining at 1500 Brickell Ave. The warrant
before the Board imposes a significant precondition that the owner "prevent any
spillover of light and noise to its abutting residential neighbors," according to the
Analysis for Warrant, Staff Analysis Report No. PZ-21-10881 ("Staff Report") at page
20. But the physical proximity of the contemplated commercial dining on the second
floor terrace makes satisfaction of this condition seemingly impossible, even without
any amplified music. The restaurant's noise study report concludes that the proposed
trellis system will reduce only about 12 decibel levels of noise (although it is unclear
whether that reduction would apply to outdoor restaurant sounds heard from our
units). And even this conclusion from the noise study appears to have been reached
without considering the impact of amplified outdoor music, as reflected in the study's
premise, on page 7, that "There will be no exterior audio system located on the
project exterior site, including the Outdoor Dining Area 2, which is the 2nd floor
1. outside terrace." Moreover, this premise raises concerns given the restaurant's
File indication at the last Board meeting that it might give up amplified music only on the
ID 2nd floor terrace. All of these circumstances —along with material in the Agenda
1371 packet, stating and underlining by hand, that the initial restaurant tenant "is loud"
3 — (see Analysis for Special Certificate of Appropriateness, at page 2, contained in
1500 Meeting Submittal Document) —give us cause for very real and disturbing concern. In No
BRI addition, with regard to concerns raised at the previous Board meeting: No resident
CKE on one of our building's very small balconies could possibly make noise approaching
LL that of crowded outside dining operating every day and night, and any resident doing
AVE so would be evicted; nor could a school, given its limited hours and lack of ongoing
NUE outdoor music even during its limited hours, make comparable noise. No resident at
Lofts on Brickell I could reasonably have anticipated outdoor commercial dining so
dose to our open balconies, which look out from each apartment's bedroom and
Living room. Importantly, the restaurant was on notice before the warrant was ever
issued of objections to the warrant reflecting our concerns, submitted as "collective
concerns" and listed on pages 15 and 17 of the Staff Report. Any cost or
inconvenience to the restaurant's owners for a new, modified application would be
relatively minimal, when compared to the serious threat of harm to our residents'
privacy and ability to enjoy our lives, as welt as to our investments, which for many
of us represent life savings that would be jeopardized by obstacles to renting or
selling posed by the unusually dose proximity —only 19.6 feet away —of so many
people eating, laughing, taking, with music playing and employees working aft day,
every day, and late into the night —a situation that would give pause to anyone,
whether a potential renter or buyer, or ourselves as current owners, seeking to pursue
and maintain a quality of life to which aft homeowners are entitled.

Concerns regarding this issue were included in Builders Association of South Florida
Letter dated May 17, 2023 and sent via email to Planning Director and Zoning
Director
Since 2019, I have joined the Brickell Homeowners Association, and other Brickell
residents, in meetings with the City Mayor, and members of the Planning department
to express our concerns regarding outdoor dining at 1500 Brickell. We have been very
1. consistent in our requests that dining should not be allowed on the terrace adjacent
Fite to the Sky Lofts condominium, and that amplified music, or sound from special
ID events should not be allowed outside the restaurant interior. To our dismay, these
1371 conditions have not been included in the Planning Department's approval of the
3 — outdoor dining warrant. The zoning for this property does not allow for the operation
1500 of a restaurant. This use is only attowed by exception granted in the interest of
BRI preserving a historic site. I believe it is reasonable to include special restrictions on
CKE outdoor dining to prevent noise from 1500 Brickell affecting nearby properties. I have
LL lived in my home on Brickett since 1987. The BHA and residents have always been
AVE successful in keeping Brickett Avenue, south of 15th Road, a quieter, commercial free
NUE area of Brickett. Please support our appeal of this warrant, and request the Planning
Department to include the conditions that we have requested. This restaurant can be
successful, and a good neighbor, by keeping its music and special event noise
indoors.

As a member of the community for 34 years, I do not support the rezoning of this
space because it doesn't align with the overall vision for the community. The
impression I felt after attending the community meeting that happened on May 4th is
that the owners of the space do not have the best interest of the community at the
forefront of their actions and their history with the residents of Wynwood and
Clemente Park speaks to that as weft. I do not know of one child that fives in
Wynwood Norte who currently attends or could even afford attending that school..
There were no guarantees that the space wilt continue to stay a school. Long term or
support for the residents who currently five in the neighborhood with any scholarships
opportunities. Clemente Park is the heart of Wynwood Norte and has been used by
the school. in the past, but despite that there was no mention of funding for the park No
to help renovate it white knowing the conditions that is currently in. I attended all of
the community meetings that helped build the NRD-2 along with numerous
community stakeholders and business owners and not once did I see the owners of
that space attend a meeting to voice their opinions on the future of Wynwood Norte
and how their Location would be affected. It would be a huge disservice to everyone
who did their part to contribute to implementation of the NRD-2 to allow the rezoning
of one space and set a precedent that wilt drastically affect the entire neighborhood
as a whole. Thank you for allowing me to voice my opinion and I hope the
community of Wynwood Norte is at the forefront of your minds when making your
decision.
