HomeMy WebLinkAboutPZAB (13926) ResolutionCity of Miami PZAB Resolution Enactment Number: PZAB-R-23-064 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File ID: 13926 A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD ("PZAB") RECOMMENDING APPROVAL OF AN ORDINANCE OF THE MIAMI CITY COMMISSION TO AMEND ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, MORE SPECIFICALLY BY AMENDING ARTICLE 4, DIAGRAM 11, TITLED "DIAGRAM 11 TRANSIT ORIENTED DEVELOPMENT - TOD," TO PROVIDE AND ALLOW FOR THE TRANSFER OF RESIDENTIAL DENSITY FROM HISTORICALLY DESIGNATED SITES TO CERTAIN PROPERTIES WITHIN TRANSIT ORIENTED DEVELOPMENT ZONES ZONED CI -HD; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 22, 2009, the City of Miami adopted Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended ("Miami 21 Code"); and WHEREAS, the City permits the transfer of residential density from historically designated sites to transit oriented development ("TOD") zones in order to aggregate Density in close proximity to mass transit options; and WHEREAS, the City's health district, one of the largest employment centers in the City, is designated CI -HD and is located within a TOD zone; and WHEREAS, the transfer of residential density from historically designated sites is currently not permitted in the CI -HD Transect Zone; and WHEREAS, permitting the transfer of residential density from historically designated sites to the CI -HD Transect Zone will decrease vehicle dependency, reduce urban sprawl, and increase the efficient use of land; and WHEREAS, the Planning Director recommends approval of the modifications to Miami 21 Code to allow for the transfer of residential density from historically designated sites to TOD zones with a CI -HD Transect Zone designation; and WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") has considered the Planning Director's recommendations; and WHEREAS, the PZAB has conducted a public hearing on the proposed text amendment; and WHEREAS, the PZAB has considered whether the proposed amendment will further the goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan ("MCNP"), the Miami 21 Code, and other City regulations; and City of Miami Page 1 of 2 File ID: 13926 (Revision:) Printed On: 5/26/2023 WHEREAS, the PZAB has considered the need and justification for the proposed change, including changed or changing conditions that make the passage of the proposed change necessary; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING AND APPEALS BOARD OF THE CITY OF MIAMI, FLORIDA, AS FOLLOWS: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The PZAB recommends that the City Commission amend Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida by amending Article 4, Diagram 11 of the Miami 21 Code in the following particulars: "ARTICLE 4. STANDARDS AND TABLES DIAGRAM 11 TRANSIT ORIENTED DEVELOPMENT - TOD TOD RESIDENTIAL DENSITY TRANSFER AREA — Up to a fifty percent (50%) increase above allowable Density in a T4, T5, a4 T6, and CI -HD is permitted through the Historic Preservation Transfer of Development Density program established in Chapter 23 of the City Code. This increase is allowable within three-quarters (3/4) of a mile of a transit station. Density transfer into T4 allowed by Exception with City Commission approval. *„ Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance should not be affected. Section 4.
