A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO ACCEPT, BUDGET, ALLOCATE, AND APPROPRIATE A TOTAL OF
SIX HUNDRED EIGHTY SEVEN THOUSAND SIX HUNDRED FIFTY NINE AND
00/100 DOLLARS ($687,659.00) IN FUNDS APPROPRIATED BY THE UNITED
STATES OF AMERICA DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT,
FROM THE COMMUNITY DEVELOPMENT FUND, TO THE CITY OF MIAMI ("CITY")
PURSUANT TO H.R. 2471, PUBLIC LAW 117-103: FEDERAL CONSOLIDATED
APPROPRIATIONS ACT, 2022, AND AS MORE PARTICULARLY IDENTIFIED
HEREIN ("FEDERAL APPROPRIATED FUNDS"); FURTHER AUTHORIZING THE
CITY MANAGER TO NEGOTIATE AND EXECUTE AGREEMENTS WITH THE
FEDERAL GOVERNMENT, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY,
TO IMPLEMENT THE ACCEPTANCE, ADMINISTRATION, AND USE OF THE
FEDERAL APPROPRIATED FUNDS; FURTHER AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER NECESSARY
DOCUMENTS, INCLUDING, BUT NOT LIMITED TO, AMENDMENTS, EXTENSIONS,
RENEWALS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY
ATTORNEY, FOR THE ACCEPTANCE, IMPLEMENTATION OF, AND COMPLIANCE
WITH THE AGREEMENTS FOR THE FEDERAL APPROPRIATED FUNDS;
RATIFYING, APPROVING, AND CONFIRMING CERTAIN NECESSARY ACTIONS BY
THE CITY MANAGER AND DESIGNATED CITY DEPARTMENTS IN ORDER TO
UPDATE THE OPERATING BUDGET, CAPITAL PLAN, RELEVANT FINANCIAL
CONTROLS AND COMPUTER SYSTEMS IN CONNECTION THEREWITH, FOR
PROJECT CLOSE-OUTS, AND FOR GRANTS AND OTHER FUNDING SOURCES IN
PROGRESS IN CONNECTION THEREWITH.

STATES OF AMERICA DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT,
FROM THE COMMUNITY DEVELOPMENT FUND, TO THE CITY OF MIAMI ("CITY")
PURSUANT TO H.R. 2471, PUBLIC LAW 117-103: FEDERAL CONSOLIDATED
APPROPRIATIONS ACT, 2022, AND AS MORE PARTICULARLY IDENTIFIED
HEREIN ("FEDERAL APPROPRIATED FUNDS"); FURTHER AUTHORIZING THE
CITY MANAGER TO NEGOTIATE AND EXECUTE AGREEMENTS WITH THE
FEDERAL GOVERNMENT, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY,
TO IMPLEMENT THE ACCEPTANCE, ADMINISTRATION, AND USE OF THE
FEDERAL APPROPRIATED FUNDS; FURTHER AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER NECESSARY
DOCUMENTS, INCLUDING, BUT NOT LIMITED TO, AMENDMENTS, EXTENSIONS,
RENEWALS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY
ATTORNEY, FOR THE ACCEPTANCE, IMPLEMENTATION OF, AND COMPLIANCE
WITH THE AGREEMENTS FOR THE FEDERAL APPROPRIATED FUNDS;
RATIFYING, APPROVING, AND CONFIRMING CERTAIN NECESSARY ACTIONS BY
THE CITY MANAGER AND DESIGNATED CITY DEPARTMENTS IN ORDER TO
UPDATE THE OPERATING BUDGET, CAPITAL PLAN, RELEVANT FINANCIAL
CONTROLS AND COMPUTER SYSTEMS IN CONNECTION THEREWITH, FOR
PROJECT CLOSE-OUTS, AND FOR GRANTS AND OTHER FUNDING SOURCES IN
PROGRESS IN CONNECTION THEREWITH.
WHEREAS, on March 15, 2022, President Joseph R. Biden signed H.R. 2471, Public
Law 117-103, the Consolidated Appropriations Act, 2022, into law ("P.L. 117-103"); and
WHEREAS, pursuant to Resolution No. R-23-0180, adopted on April 13, 2023, the City
Commission authorized the City Manager to accept, budget, allocate, and appropriate a total of
Four Million and 00/100 Dollars ($4,000,000.00) in Federal appropriated funds from H.R. 2617,
Public Law 117-328: Consolidated Appropriations Act, 2023 ("P.L. 117-328") for the Phase 2
Simonhoff Floral Park Improvements/COVID-19 Memorial, Office of Capital Improvements
Project No. 40-6183507; and
WHEREAS, Section 2, Division L-Transportation, Housing and Urban Development, and
Related Agencies Appropriations Act, 2023, Title II -Department of Housing and Urban
Development of P.L. 117-328 provides that all appropriations made in the Department of
Housing and Urban Development Appropriations Act, 2022, P.L. 117-103 shall remain available
for reimbursement of eligible expenses; and
WHEREAS, P.L. 117-103, through the United State Department of Housing and Urban
Development ("HUD"), from the Community Development Fund, appropriated Six Hundred
Eighty Seven Thousand Six Hundred Fifty Nine and 00/100 Dollars ($687,659.00) to the City of
Miami ("City") for Phase 1 Simonhoff Floral Park Improvements/COVID-19 Memorial, Office of
Capital Improvements Project No. 40-B183507 ("Project"); and
WHEREAS, the City Commission finds it is in the best interest of the City to accept,
budget, allocate, and appropriate the funds appropriated to it in P.L. 117-103 and to authorize
the City Manager to negotiate and execute any and all agreements and other necessary related
documents with the Federal government, all in forms acceptable to the City Attorney, to
implement the acceptance, administration, and use of the funds appropriated to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to accept, budget, allocate, and appropriate
the Six Hundred Eighty Seven Thousand Six Hundred Fifty Nine and 00/100 Dollars
($687,659.00) ("Federal Appropriated Funds") to the City for the Project.
Section 3. The City Manager is further authorized' to negotiate and execute agreements
with the Federal government, all in forms acceptable to the City Attorney, to implement the
acceptance, administration, and use of the Federal Appropriated Funds.
Section 4. The City Manager is further authorized' to negotiate and execute any and all
other necessary documents, including, but not limited to, amendments, extensions, renewals,
and modifications, all in forms acceptable to the City Attorney, for said purpose.
Section 5. Certain necessary actions by the City Manager and designated City officials
and departments made in order to update the City's Operating Budget, Capital Plan, relevant
financial controls and computer systems in connection therewith, for project close-outs, and for
grants and other funding sources in progress in connection herewith are ratified, approved, and
confirmed.
Section 6. This Resolution shall become effective upon its adoption and signature by
the Mayor.2

1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including, but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
