A RESOLUTION OF THE MIAMI CITY COMMISSION DENYING THE APPEAL FILED
BY PENNY TANNENBAUM OF INTENDED DECISION PWO22-247 ISSUED ON
NOVEMBER 29, 2022, FOR THE MEDIAN LOCATED ACROSS FROM 1750 SOUTH
BAYSHORE LANE, MIAMI, FLORIDA.
WHEREAS, the City of Miami Resilience and Public Works Department requested to
remove trees located in the median along South Bayshore Lane, Miami, Florida as the trees
posed a life safety risk to pedestrians, vehicles, and property due to their height, confined
planting space, and weight of the fronds and the velocity at which they fall; and
WHEREAS, two (2) of the trees were also found to create a site visibility obstruction at
both ends of the median; and
WHEREAS, due to their sizes, the subject trees were not viable candidates for
relocation; and
WHEREAS, on November 29, 2022, the Building Department issued Intended Decision
PWO 22-247 pursuant to Chapter 17 of the Code of the City of Miami, Florida, as amended,
("City Code") for the trees in the median; and
WHEREAS, Intended Decision PWO 22-247 encompassed the following approval for
tree activity:
• The removal of five (5) Royal palms from the median;
• The tree replacement with eight (8) Sabal palms and 6-12 hardwoods trees (equating to
12" DBH) within the median; and
WHEREAS, Penny Tanennbaum ("Appellant") appealed Intended Decision PWO 22-
247; and
WHEREAS, after notice and an opportunity to be heard, the City Commission finds that
there is competent substantial evidence to deny the appeal of Intended Decision PWO 22-247
filed by Appellant;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The appeal of Intended Decision PWO 22-247 is denied.
Section 3. This Resolution shall be effective immediately upon its adoption.
