To address these challenges, Florida must assist communities in adapting critical and regionally significant assets, develop a statewide vision for both coastal and inland communities, and prioritize state resources with a statewide data set and vulnerability assessment ("VA"). One way Florida will achieve those goals is through the Statewide Flooding and Sea Level Rise Resilience Plan ("State Plan") contained within this report. An excerpt from Section 380.093, Florida Statutes (F.S.), is shown below which establishes the basis for this report. (5) STATEWIDE FLOODING AND SEA LEVEL RISE RESILIENCE PLAN. — (a) By December 1, 2021, and each December 1 thereafter, the department shall develop a Statewide Flooding and Sea Level Rise Resilience Plan on a 3-year planning horizon and submit it to the Governor, the President of the Senate, and the Speaker of the House of Representatives. The plan must consist of ranked projects that address risks of flooding and sea level rise to coastal and inland communities in the state. All eligible projects submitted to the department pursuant to this section must be ranked and included in the plan. The statute provides required elements of the State Plan, which includes: • Overall Summary of Applications including: o The total number of project applications received and deemed eligible, o The total funding requested, and o The total funding requested for eligible projects. o A link to access a copy of each submitted project application form separated by eligible and ineligible projects. • State Plan Development Process, including: o A description of eligibility requirements o A detailed summary of the scoring criteria for project ranking • Project Application Form This report is not only intended to satisfy the statutory requirements of the Department of Environmental Protection (Department) and highlights other critical efforts implemented by the Resilient Florida Program to make our communities more resilient. Overall Summary of Applications On July 1, 2022, the Department opened a new application portal designed to collect project information consistent with Section 380.093, F.S., and Chapter 62S-8, Florida Administrative Code (F.A.C.). The portal remained open through September 1, 2022, consistent with statutory requirements. An outline of the online application form is provided in Appendix A. The Department received 269 applications totaling $2,751,403,939 in project costs. The total state funding requested for all applications is $1,473,343,759. After considering project eligibility using the methodology below, the total number of eligible projects 1 submitted by eligible entities is 223 and the funding requested for all eligible projects and entities is $760,662,475. A distribution of all the applications received during this cycle is shown in Figure 1. How the State Plan was developed The State Plan was created based on the eligibility requirements outlined in s. 380.093, F.S., and the project score in accordance with Chapter 62S-8, F.A.C., both outlined below. 2 Methodology (eligibility) To be eligible for the State Plan, a project must be an eligible type to address a flooding or sea level rise threat in current or future conditions and the local sponsor must be an eligible entity. To be an eligible entity, the entity must be identified in subsection 380.093(5), F.S. Eligible entities that can submit applications to address risks of flooding or sea level rise identified in vulnerability assessments include counties, municipalities, and special districts with certain responsibilities. In some cases, other established districts can submit applications that mitigate the risk of flooding or sea level rise on water supplies or water resources of the state. Consistent with the program's governing statute, special districts are those that are responsible for the management and maintenance of: • inlets and intracoastal waterways; • potable water facilities; • wastewater facilities; • airports; and • seaports. Other established districts include: • water management districts; • drainage districts; • erosion control districts; • flood control districts; and • regional water supply authorities. Statute requires that each project included in the plan have a minimum 50 percent cost share unless the project assists or is within a financially disadvantaged small community. Paragraph 380.093(5)(e), F.S., provides a match waiver for financially disadvantaged small communities as defined in the excerpt below: 1. A municipality that has a population of 10,000 or fewer, according to the most recent April 1 population estimates posted on the Office of Economic and Demographic Research's website, and a per capita annual income that is less than the state's per capita annual income as shown in the most recent release from the Bureau of the Census of the United States Department of Commerce that includes both measurements; or 2. A county that has a population of 50,000 or fewer, according to the most recent April 1 population estimates posted on the Office of Economic and Demographic Research's website, and a per capita annual income that is less than the state's per capita annual income as shown in the most recent release from the Bureau of the Census of the United States Department of Commerce that includes both measurements. Methodology (ranking) In 2022, following substantial public input, the program adopted Chapter 62S-8, F.A.C., "Statewide Flooding and Sea Level Rise Resilience Plan," to implement the scoring criteria outlined in subsection 380.093(5)(h), F.S. To satisfy rule requirements and earn 3 the corresponding points, project applicants were required to provide all supporting information and/or documentation needed to evaluate each application criteria to the Department. A scoring rubric summarizing the rule is provided in Table 1. Where required by the rule, the applicant was required to attach supporting documentation for their application. Projects that received the same score received equal rank. The full list of ranked projects can be found in Appendix B. Proposed Project Lists The applications received via the 2022 Resilient Florida grant portal were used to create the list of proposed projects for the State Plan in Appendix B. Paragraph 380.093(5)(i), F.S., requires that proposed funding for the State Plan (state funds) be no less than $100M per year. The Department developed the State Plan based on the projected balance for the Resilient Florida Trust Fund of $125M. Of the 223 eligible projects, 37 new projects and additional funding for five previously awarded projects are proposed for FY23-24 State funding. The Department also received an appropriation of $200M in FY22-23 Federal State and Local Fiscal Recovery Funds (SLFRF) funds for projects consistent with the State Plan requirements. The Department proposes to use $188,597,334 to completely fund 49 project applications. The balance of this funding was dedicated to complete planning grants for communities statewide and to complete preconstruction activities for financially disadvantaged small communities, consistent with proviso shown below from HB5001: General Appropriations Act (2022). RESILIENT FLORIDA GRANT PROGRAM The Chief Financial Officer shall transfer $200,000,000 from the General Revenue Fund to the Resilient Florida Trust Fund in the Department of Environmental Protection. The nonrecurring sum of $200,000,000 from the Resilient Florida Trust Fund is appropriated in Fixed Capital Outlay and placed in reserve for the Resilient Florida Program pursuant to section 380.093, Florida Statutes. The department is authorized to submit budget amendments to request the release of funds pursuant to chapter 216, Florida Statutes. Up to $20,000,000 may be used to provide grants for the Resilient Florida Grant Program. The remaining funds are provided for projects included in the Statewide Flooding and Sea Level Rise Resilience Plan to be submitted on December 1, 2022. SLFRF funds are required to be encumbered by December 1, 2024, and expended by December 31, 2026. In determining whether a project is proposed utilizing state funding 6 or the SLFRF appropriation, the Department considered project duration, construction start date, and construction completion date. Projects proposed utilizing SLFRF will be awarded this fiscal year, while those proposed for funding in the State Budget will be awarded next fiscal year. Upon notification of SLFRF award, if an entity appears to be unable to meet federal requirements, including timelines for completion, they may need to apply for state funding for later phases in future iterations of the State Plan. If possible, the Department may also exchange projects between the two funding sources to ensure encumbrance and expenditure of federal funds within the required deadlines. In total, the 2023-2024 State Plan proposes 86 new projects and additional funding for five previously awarded projects for $407,951,366 over 3 years. If approved, the 2023- 2024 State Plan would total $187,865,778 in the first year. Pursuant to paragraph 380.093(5)(a), F.S., the State Plan is designed with a 3-year planning horizon; therefore, the listed projects also commit $47,538,638 and $46,815,394 to the plans in 2024-2025 and 2025-2026, respectively, from the Resilient Florida Trust fund, and $62,865,778 each year from FY22-23 SLFRF, bringing years 2 and 3 to $110,404,416 and $109,681,172, respectively. This report also includes proposed awards for the balance of FY21-22 SLFRF funds shown in Appendix C. 7 Appendix A: Project Application Form The Department's Resilient Florida Program launched an application portal on July 1, 2022. To apply, applicants established an account and were able to begin the application, save it in draft form and return later, and complete their application with any necessary uploads all through the online portal. The Department looks forward to improving users' experiences in the future. The applications were submitted via online form, recreated below.
