Purpose of Item:
A Resolution of the Miami City Commission, with attachment, authoring the City
Manager to accept, budget, allocate, and appropriate the Statewide Flooding and Sea
Level Rise Resilience Plan 2023 — 2024 funds in an amount not to exceed $18,452,925
(`GRANT FUNDS') from the Florida Department of Environment Protection ('FDEP')
Grant Awards Specified in Attachment "A," Attached and Incorporated, for resilience
activities; establishing a new capital fund project and appropriating the funds; authoring
the City Manager to execute a grant agreement with FDEP in a form acceptable to the
City Attorney; further authoring the City Manager to negotiate and execute any and all
necessary documents, including, but not limited to, amendments, extensions, renewals,
and modifications, all in forms acceptable to the City Attorney, for the acceptance and
administration of the grant awards, implementation of, and compliance with the grant
agreements and program requirements.
Background of Item:
The City of Miami ("City") submitted grant applications and was awarded four (4)
Statewide Flooding and Sea Level Rise Resilience Plan 2023 — 2024 grants from
FDEP. The City Administration recommends the acceptance, allocation, and
appropriation of FDEP funds in an amount not to exceed $18,452,925 for grant awards
specified in attachment "A", for resilience activities.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO ACCEPT, BUDGET, ALLOCATE, AND
APPROPRIATE FUNDS FROM THE FLORIDA DEPARTMENT OF ENVIRONMENTAL
PROTECTION ("FDEP") STATEWIDE FLOODING AND SEA LEVEL RISE
RESILIENCE PLAN FOR 2023 — 2024 IN AN AMOUNT NOT TO EXCEED
($18,452,925) ("GRANT FUNDS") AS SPECIFIED IN EXHIBIT "A," ATTACHED AND
INCORPORATED HEREIN, FOR FLOODING AND RESILIENCE ACTIVITIES
("PURPOSE"); ESTABLISHING A NEW CAPITAL FUND PROJECT AND
APPROPRIATING THE GRANT FUNDS FOR THE PURPOSE STATED HEREIN;
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL
NECESSARY DOCUMENTS, INCLUDING BUT NOT LIMITED TO, AMENDMENTS,
EXTENSIONS, RENEWALS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE
TO THE CITY ATTORNEY, FOR THE ACCEPTANCE OF THE GRANT FUNDS,
ADMINISTRATION, IMPLEMENTATION AND COMPLIANCE OF ALL APPLICABLE
LAWS, RULES, AND REGULATIONS, FOR SAID PURPOSE.
WHEREAS, the City of Miami ("City") submitted grant applications to Florida Department
of Environmental Protection ("FDEP") for the Statewide Flooding and Sea level Rise Resilience
Plan component and was awarded four (4) 2023 — 2024 grant awards; and
WHEREAS, FDEP has awarded the City the 2023-2024 grant awards for an amount not
to exceed ($18,452,925) ("Grant Funds"); and
WHEREAS, the Grant Funds will help prepare coastal as well as inland areas for the
adverse impacts of flooding, sea -level rise, and storm surge; and
WHEREAS, the City wishes to accept, budget, allocate, and appropriate the Grant
Funds from FDEP, as specified in Exhibit "A," attached and incorporated; and
WHEREAS, the Grant Funds will support improvements to the locations specified in
Exhibit "A," attached and incorporated, by enhancing their resilience to future natural disasters
("Purpose"); and
WHEREAS, it is appropriate for the City to accept the Grant Funds, establish a Capital
Fund Project, and authorize the City Manager to negotiate and execute any and all necessary
documents, including but not limited to, amendments, extensions, renewals, and modifications,
all in forms acceptable to the City Attorney, for the acceptance of the Grant Funds,
administration, implementation, and compliance with all applicable laws, rules, and regulations,
for said Purpose;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby authorized' to accept the Grant Funds to be
utilized for flood mitigation.
Section 3. The new Capital Fund Project is established, and the Grant Funds are
appropriated as described in Exhibit "A," attached and incorporated.
Section 4. The City Manager is authorized' to negotiate and execute any and all
necessary documents, including but not limited to, amendments, extensions, renewals, and
modifications, all in forms acceptable to the City Attorney, for the acceptance of the Grant
Funds, administration, implementation, and compliance with all applicable laws, rules, and
regulations, for said Purpose.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
2 If the mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
