HomeMy WebLinkAboutR-23-0401City of Miami Resolution R-23-0401 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14494 Final Action Date: 9/14/2023 A RESOLUTION OF THE MIAMI CITY COMMISSION ACCEPTING, ALLOCATING, BUDGETING, AND APPROPRIATING GRANT FUNDS FROM THE MIAMI-DADE COUNTY ("COUNTY") GENERAL GOVERNMENT IMPROVEMENT FUND, IN AN AMOUNT NOT TO EXCEED FOUR MILLION ONE HUNDRED SEVENTY THOUSAND DOLLARS ($4,170,000.00), FOR SIDEWALKS AND STREET IMPROVEMENTS ON FLAGLER STREET FROM BISCAYNE BOULEVARD TO WEST FIRST AVENUE IN THE CITY OF MIAMI ("CITY"), PROJECT NO. 40-B30606, COUNTY PROJECT NO. 3002113; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN INTERLOCAL AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE COUNTY FOR ACCEPTANCE OF THE GRANT FUNDS AND COMPLIANCE WITH THE GRANT REQUIREMENTS ("AGREEMENT"); FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL RENEWALS, EXTENSIONS, MODIFICATIONS, AND AMENDMENTS TO THE AGREEMENT, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE. SPONSOR(S): Commissioner Sabina Covo, Commissioner Manolo Reyes WHEREAS, on September 20, 2022 the, the Board of County Commissioners of Miami - Dade County ("County") adopted the Fiscal Year ("FY") 2022-2023 Operating Budget and Multi - Year Capital Plan which approved an allocation of Four Million One Hundred Seventy Thousand Dollars ($4,170,000.00) to the City of Miami ("City") for the reconstruction of Flagler Street; and WHEREAS, the aforementioned County Operating Budget and Capital Plan includes a General Government Improvement Fund ("GGIF") for municipalities and unincorporated municipal service areas undertaking capital improvements that promote investment, new development and permanent job creating businesses; and WHEREAS, the Flagler Street Reconstruction project, which is City Project No. 40- B30606 and County Project No. 3002013 (collectively "Project"), is eligible for County funding from the GGIF proceeds in a total amount not to exceed Four Million One Hundred Seventy Thousand Dollars ($4,170,000.00) ("Grant Funds"); and WHEREAS, the City is undertaking the Project for completion of improvements to Miami's downtown central business district on Flagler Street between Biscayne Boulevard and West First Avenue, within the City, which consists of sidewalks and street repairs, ADA ramps, new signage and markings, decorative lighting and landscaping, which the County has approved to receive funding from the GGIF and has been approved for funding in Fiscal Year 2022-2023; and City of Miami Page 1 of 2 File ID: 14494 (Revision:) Printed On: 7/11/2025 File ID: 14494 Enactment Number: R-23-0401 WHEREAS, the County has agreed to allocate the Grant Funds in Fiscal Year 2022- 2023 from the GGIF proceeds for the Project, fully subject to and contingent upon the approval the approval of the City Commission for this Project, by the Board of County Commissioners to fund this Project from the GGIF, and the availability of the County Funds; and WHEREAS, the Board of County Commissioners has previously authorized its representatives to negotiate, execute, and enter into an agreement with the City; and WHEREAS, it is in the best interest of the City for the City Commission to accept, allocate, budget, and appropriate the Grant Funds to be included in the City's Capital Plan and to authorize the City Manager to negotiate, execute, and enter into an interlocal agreement, in a form acceptable to the City Attorney, with the County for acceptance of the Grant Funds and compliance with the grant requirements; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. Grant Funds, in an amount not to exceed Four Million One Hundred Seventy Thousand Dollars ($4,170,000.00), consisting of funds from the County's GGIF, for the Project, are accepted, allocated, budgeted, and appropriated for the Project and shall be included in the City's Capital Plan. Section 3. The City Manager is authorized' to negotiate and execute an interlocal agreement, in a form acceptable to the City Attorney, with the County for acceptance of the Grant Funds and compliance with the grant requirements. Section 4. The City Manager is further authorized' to negotiate and execute any and all renewals, extensions, modifications, and amendments, all in forms acceptable to the City Attorney, as may be deemed necessary for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 4ndez, ity (tor 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
