Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), authorizing the City
Manager to execute a Combined Voluntary Cooperation and Operational Assistance
Mutual Aid Agreement, in substantially the attached form, between the City of Miami
("City") and Miccosukee Tribe of Indians ("Miccosukee") to receive and extend mutual
aid in the form of law enforcement services and resources to ensure public safety and
ability to adequately respond to intensive situations, including but not limited to natural
and man-made disasters and emergencies as defined in Part 1, Chapter 23, Florida
Statutes, the "Florida Mutual Aid Act;" further authorizing the City Manager to negotiate
and execute any and all other documents related to the Mutual Aid Agreement, in a
form acceptable to the City Attorney, as may be necessary for said purpose.
Background of Item:
There are natural and man-made challenges faced by the City of Miami's ("City") Police
Department ("MPD") and the Miccosukee Tribe of Indians ("Miccosukee") that are, or
are likely to be, beyond the control of the services, personnel, equipment, or facilities of
Miccosukee.
The City and Miccosukee wish to enter into a Combined Voluntary Cooperation and
Operational Assistance Mutual Aid Agreement ("MAA") to ensure that preparation and
resources from both respective law enforcement agencies will be adequate to address
natural and man-made challenges, protect public peace and safety, and to preserve the
lives and property of the people of the City and Miccosukee.
The City and Miccosukee have the authority under the Florida Mutual Aid Act, Chapter
23, Part 1, Sections 23.12-23.127, Florida Statutes, to enter into the MAA.
Prior to any City of Miami officer taking any enforcement action on tribal land must first
obtain approval from the Miccosukee Police Chief or his designees, before conducting
any investigations.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A COMBINED VOLUNTARY
COOPERATION AND OPERATIONAL ASSISTANCE MUTUAL AID AGREEMENT, IN
SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("CITY")
AND THE MICCOSUKEE TRIBE OF INDIANS ("MICCOSUKEE") TO RECEIVE AND
EXTEND MUTUAL AID IN THE FORM OF LAW ENFORCEMENT SERVICES AND
RESOURCES TO ENSURE PUBLIC SAFETY AND ABILITY TO ADEQUATELY
RESPOND TO INTENSIVE SITUATIONS, INCLUDING BUT NOT LIMITED TO
NATURAL AND MAN-MADE DISASTERS AND EMERGENCIES AS DEFINED IN
PART 1, CHAPTER 23, FLORIDA STATUTES, TITLED "FLORIDA MUTUAL AID ACT";
FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE
ANY AND ALL OTHER DOCUMENTS RELATED TO THE MUTUAL AID
AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE
NECESSARY FOR SAID PURPOSE.
WHEREAS, there are natural and man-made challenges faced by the City of Miami's

WHEREAS, the City and the Miccosukee wish to enter into a Combined Voluntary
Cooperation and Operational Assistance Mutual Aid Agreement ("MAA") to ensure that

address natural and man-made challenges, protect public peace and safety, and to preserve the
lives and property of the people of the City and Miccosukee; and
WHEREAS, the City and the Miccosukee have the authority under the Florida Mutual Aid
Act, Chapter 23, Part 1, Sections 23.12-23.127, Florida Statutes, to enter into the MAA; and
WHEREAS, prior to any MPD officer taking any enforcement action on tribal land, MPD
must first obtain approval from the Miccosukee Police Chief or his designees, before conducting
any investigations;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to execute a MAA, in substantially the
attached form, between the City and the Miccosukee to receive and extend mutual aid in the
form of law enforcement services and resources to ensure public safety and the ability to
adequately respond to intensive situations, including but not limited to natural or manmade
disasters or emergencies as defined in Chapter 23, Part 1, Florida Statutes.
Section 3. This Resolution shall become effective immediately upon its adoption.
