HomeMy WebLinkAboutR-23-0351City of Miami Resolution R-23-0351 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14401 Final Action Date: 7/27/2023 A RESOLUTION OF THE MIAMI CITY COMMISSION ADOPTING A CITY OF MIAMI ("CITY") PARKS FENCE AND WALL MASTER PLAN, AS A GUIDING TOOL FOR THE FUTURE IMPROVEMENT AND DEVELOPMENT OF FENCES AND WALLS IN CITY PARKS ERECTED OR MAINTAINED IN CONNECTION WITH ACTIVE RECREATIONAL USES INCLUDING BUT NOT LIMITED TO SPORTS FIELDS, COURTS, OR OTHER ACTIVE RECREATIONAL USES REQUIRING TALLER FENCES, WALLS, OR NETTING TO ENSURE PUBLIC SAFETY IN CONNECTION WITH SUCH USES; DIRECTING THE CITY MANAGER TO TAKE ANY AND ALL ACTIONS NECESSARY TO IMPLEMENT THIS RESOLUTION; FURTHER DIRECTING THE CITY MANAGER TO INCORPORATE THE PARKS FENCE AND WALL MASTER PLAN INTO THE NEXT UPDATE TO THE CITY OF MIAMI'S PARKS AND PUBLIC SPACES MASTER PLAN; PROVIDING FOR AN EFFECTIVE DATE. SPONSOR(S): Commissioner Manolo Reyes WHEREAS, the City of Miami ("City") recognizes the importance of providing safe and enjoyable spaces for residents recreation and open spaces; and WHEREAS, the City acknowledges the need for a comprehensive Parks Fences and Walls Master Plan to assist the development and maintenance of parks within its jurisdiction; and WHEREAS, the City aims to ensure the operations, safety, accessibility, and sustainability of parks, while enhancing the quality of life of its users; and WHEREAS, the City Commission hereby approves the Parks Fences and Walls Master Plan as a guiding tool for the improvement and development of City Parks as provided for herein; and WHEREAS, in accordance with Section 2-33(f) of the Code of the City of Miami, Florida, as amended, the City Commission, by a majority vote, hereby deems this Resolution to be of an emergency nature; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission hereby adopts the Parks Fences and Walls Master Plan for its parks, which includes the following provisions: City of Miami Page 1 of 2 File ID: 14401 (Revision:) Printed On: 7/10/2025 File ID: 14401 Enactment Number: R-23-0351 1. Safe and Accessible Location: The City of Miami, Parks and Recreation Department ("Department") shall identify suitable locations for fences and walls that prioritize safety, for active recreational uses including but not limited to sports fields, courts, or other active recreational uses requiring taller fences, walls, or netting to ensure public safety. 2. Chain Link Fence and Double Door Feature: Pursuant to Section 5.7.1.4 of Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended ("Miami 21 Code"), the Department may install fences, walls, and netting in excess of the applicable height and setback restrictions at any park which contains active recreational uses including but not limited to sports fields, courts, or other active recreational uses requiring taller fences, walls, or netting to ensure public safety and containment of any activity to such field or court (including but not limited to containment of baseballs, tennis balls, and the like). Section 3. The City Manager is directed to take any and all actions necessary to implement this Resolution. Section 4. The City Manager is directed to incorporate the Walls and Fences Parks Master Plan into the next update to the City of Miami's Parks and Public Spaces Master Plan. Section 5. This Resolution shall become effective upon its adoption and signature by the Mayor.'
