Please let the following serve as the Applicant's letter of intent in support of two (2) Exceptions and one (1) Warrant related to the Property. Property Information. The Property is located on the west side of NW 2 Avenue, between NW 28 Street and NW 29 Street. Miami -Dade County's Property Appraiser identifies the Property by Folio No. 01-3125-024-3040. The Property is an aggregation of a number of previously separate parcels and includes a number of existing one and two-story structures. The City's Planning Department approved the site plan for the Property in 2017 via Warrant Final Approval No. 2017-0044 ("2017 Site Plan Approval"). The City approved building permit plans consistent with the 2017 Site Plan Approval in 2018 via Building Permit No. M2017011936. Subject Parcel Only a portion of the Property is subject to the instant application. The S includes an existing, 17,952 square foot building ("Existing Building") that was 1 the 2017 Site Plan Approval.1 It should be noted that this space is currently unoc and has not included a use since the Property's renovation. In addition, the Property is zoned T6-8 and T5-O, within the Wynwood Neighborhood Revitalization District ("Wynwood NRD- 1").2 According to Appendix J, Section 2.2 of Miami 21, the intent of Wynwood NRD-1 is to allow for redevelopment of the existing Wynwood Industrial District into an active, diverse, mixed -use neighborhood, and to promote a 24-hour environment where people work, live, and play. Proposed Development. The Applicant intends to renovate the interior of the Existing Building to accommodate a well -designed indoor, mini -golfing establishment, inclusive of a restaurant and bar ("Puttery"). Puttery is consistent with the intent of the Wynwood NRD-1, as such an establishment will contribute toward the desired 24-hour work, live, and play environment and create both entertainment and dining in close proximity to the new residential projects along the 29 Street corridor. Puttery will occupy all the floor area associated with the Existing Building, all approximately 17,952 square feet of floor area. Request and Analysis. At this time, the Applicant seeks the following two (2) Exceptions and one (1) Warrant. Exception 1: Distance Separation. Pursuant to Chapter 4, Section 4-4 of the City of Miami Code of Ordinances (the "Code"), alcohol service establishments must be located a certain minimum distance from a similarly licensed establishment, as measured by the distance between their respective front doors along the route of ordinary pedestrian traffic. Pursuant to Section 4-4(g) of the Code, an Exception may be granted by the Planning, Zoning and Appeals Board ("PZAB"), with City Commission approval, for a reduction of up to fifty percent (50%) of such distance requirements. Section 4-5 of the Code specifies that the appropriate establishments located in the "Wynwood Cafe" area must be separated by a minimum distance of 500 feet. As previously noted, Puttery is consistent with the intent of the Wynwood NRD-1, as it will contribute toward the desired 24-hour work, live, and play environment and create both entertainment and dining in close proximity to the new residential projects. Exception 2.. Establishment Size. Pursuant to Article 6 of Miami 21 and Chapter 4 of the Code, alcohol service establishments occupying more than 5,000 square feet of floor area shall require an Exception with approval by the City Commission. Puttery will consist of a total floor area of up to 17,952 square feet, albeit including back of house spaces. Accordingly, the Applicant respectfully requests an Exception, with City Commission approval, to permit an alcohol service establishment with a total floor area in excess of 5,000 square feet. Exception applications are reviewed pursuant to the Design Criteria contained in Article 4, Table 12. Puttery meets the required criteria. The proposed use will operate in a manner that is respectful of its location and context: Puttery is a mini -golfing establishment and restaurant that brings activity and vibrancy to a currently vacant industrial building. The indoor mini -golf use is designed to merge seamlessly with the surrounding area context and integrate the proposed uses within the Existing Building. Puttery does not change the physical context or existing neighborhood form and contributes toward an active, diverse, mixed -use neighborhood, consistent with the intent of the Urban Center Zone, Wynwood NRD-1, and the guiding principles of Miami 21. Warrant. Outdoor Dining. Pursuant to Article 6, Section 6.3.2(1) of Miami 21, within open space, or partially open space, an outdoor dining area may be permitted subject to the Warrant process. Puttery contemplates an exterior lounge area to be located along the NW 28 Street frontage of the Property. PZ-22-14997 06/09/23 Article 7, Section 7.1.2.4(d) of Miami 21 indicates that review of a Warrant will be reviewed for compliance with Miami 21, the intent of the Transect, the guiding principles of the Miami 21 Code, and the manner in which the proposed use will operate given its specific location and proximity to less intense uses. The Applicant's proposed exterior lounge is compliant with Miami 21, as well as consistent with the intent of Wynwood N RD- 1. In general, the Puttery's mini -golf use will activate the Existing Building, will bring an underutilized site to life, and will bring vibrancy to the northern section of the Wynwood NRD-1. The exterior lounge will be an area of rest and relaxation that is in conformance with the intent of the T5-O Transect, as a component of permitted uses. The exterior lounge also satisfies the intent of Wynwood NRD-1 as it will provide private open space for patrons and Wynwood residents to enjoy. Most importantly, given the COVID-19 pandemic, outdoor dining has presented itself as the safest option for social interaction and economic viability of food and beverage establishments. Accordingly, the Applicant's proposed Outdoor Dining is compliant with Miami 21 and its guiding principles. It's important to note that Puttery will first and foremost be an indoor mini -golf establishment- a space for active recreation and enjoyment. While alcohol and some outdoor seating will be available, it is in the context of this unique and much -needed, active use. This is exactly the kind of contextually appropriate and active use that makes Wynwood a destination that residents and visitors will want to visit over and over. An operational/business plan that addresses hours of operation, n employees, menu items, business goals, and other operational character's pertinent to the application. Applicant intends to operate: o Monday -Wednesday 4 pm to 12 am, o Thursday 4 pm — 2 am, o Friday 12 pm to 2 am, o Saturday 11 am to 2 am, and o Sunday 12 pm to 12 am. • Number of employees. The operator intends to employ approximately 115 persons over two working shifts. • Menu items. See Exhibit A for sample Menu. • Business goals and information. Puttery is a modern spin on putting, which fuses high-tech gameplay with craft cocktails and curated cuisine. The establishment will offer adults an immersive experience unlike any other. Each unique putting course is designed to be an intricately detailed experience that transports guests to a wholly unexpected location. Additionally, chefs and bartenders have created a menu of delicious shareable eats and craft cocktails. 2. A parking plan which fully describes where and how the parking is to be provided an utilized, e.g., valet, self -park, shared parking, after -hour metered spaces, and the manner in which the parking is to be managed. The city commission or the PZAB, as applicable, may grant approval for 100 percent of the required parking to be located offsite within a distance of 600 feet from the subject alcohol service establishment if the proposed parking is to be "self -park" and a distance of 1,000 feet from the subject alcohol service establishment if the proposed parking is to be by "valet." The Project complies with the Miami 21 parking requirements. The Project is an adaptive use of a one-story warehouse structure which has existed on the Property for decades. Accordingly, pursuant to the principles of the NRD-1, Section 3.2.1.a.2 and Article 7, Section 7.2.8 of Miami 21, there is no legal parking requirement for the Project. Nonetheless, the Applicant has provided the requested Traffic Circulation Analysis. Further, consistent with the principles of the NRD-1, the Applicant intends to encourage Page #1 Puttery - Operations Information pedestrian access to the site, private ridesharing, and transit ridership via t local bus service. It should be noted that pursuant to the original site pia the Property, there were approximately thirty (30) on -street spaces alloc abutting the Property. For alcohol service establishments proposing capacities over 300 persons, an indoor/outdoor crowd control plan that addresses how large groups of people waiting to gain entry into the alcohol service establishment and already on the premises will be controlled. In order to minimize impacts on the public realm, the entrance to Puttery will be from the interior courtyard on the east side of the building. Groups will wait for admission within the private property and Puttery security will ensure that the public right of way is not impacted. Security will maintain an accurate count of patrons relative to permissible capacity and create clearly demarked queuing space. Additionally, crowds will be controlled on an operational basis through the reservation system. 4. A security plan for the alcohol service establishment and any parking facility. The Property employs security from 7AM to Midnight. The operator intends to utilize one security person between the hours of 7pm-1am Sunday -Wednesday and from 7pm to 2am Thursday -Saturday. There are no affiliated parking facilities. Security will be tasked with • Requiring proper identification; • Identifying overly intoxicated individuals and refusing entry, • Maintaining training in security related scenarios. 5. For alcohol service establishments proposing capacities over 300 persons, a traffic study and traffic circulation analysis and plan that details the impact of projected traffic on the immediate neighborhood and how this impact is to be mitigated. The Applicant provides the requested traffic analysis under separate cover. 6. A sanitation plan which addresses on -site facilities as well as off -premises issues resulting from the operation of the alcohol service establishment. The Applicant will contract Waste Management to have trash picked up 6 days per week from the hours of 7am — Noon. Additionally, Staff will maintain the premises and immediate area clean and in good order. Page #2 Puttery - Operations Information 7. Proximity of the proposed alcohol service establishment to districts — The Property is located within the Wynwood NRD-1. There are no residents the immediate vicinity of the Property. If the proposed alcohol service establishment is within 200 feet of any residential use, a noise attenuation plan that addresses how noise will be controlled shall be required, especially in the case of indoor/outdoor uses. There are currently no residential uses within 200 feet of the premises. However, mixed - use buildings, including residential uses are in the process of being completed and occupied. Residents moving to the area will be aware of the vibrant character of the NRD- 1 and of this portion of the district in particular. Nonetheless the Applicant has considered noise attenuation strategies to be implemented on the premises: • Life -safety occupancy levels will be strictly enforced to limits crowds and their requisite noise levels. • The outdoor seating is limited to the small courtyard on the south side of the property. The courtyard is surrounding by building walls on three sides. Seating within the courtyard is arranged in a way to minimize acoustic impacts on the surrounding area. • Proposed landscaping areas are anticipated to offer some noise buffering from the abutting right of way. • Music in outdoors areas will be limited to ambient levels, at a level that permits normal conversation. Art treatments for the existing buildings will con- tinue to be painted annually for art Basel by artists contracted and/or selected by the owner. Each building wilt be painted by a single artist with the intent of harmonizing with the use of that space, be it a Japanese restaurant (as depicted on building #1 in the included renderings) or some other use. The intent is to maintain the temporal and spontaneous feet of Wynwood while enhancing the urban experience. The new building (indicated as building #4) has a more specific intent of being a unique art piece in itself. Inspired by lenticular artists (see concept images and diagrams) and expanded to into the form of an entire structure the piece is a play on perspective. When seen from one viewpoint you find yourself looking at beautiful monochrome image of the native mangrove forests.
