Purpose of Item:
APPROVING AN AMENDMENT TO THE CITY OF MIAMI ("CITY") LOCAL HOUSING
ASSISTANCE PLAN ("LHAP"), ATTACHED AND INCORPORATED, FOR THE FISCAL
YEAR ("FY') 2019-2022 AND FISCAL YEAR ("FY") 2022-2025, TO INCORPORATE
THE CHANGES MADE TO THE SINGLE FAMILY REHABILITATION PROGRAM, THE
SINGLE FAMILY REPLACEMENT HOME PROGRAM AND THE EMERGENCY HOME
REPAIR ASSISTANCE PROGRAM, RESPECTIVELY; AUTHORIZING THE CITY
MANAGER TO SUBMIT THE CHANGES IN THE PLAN FOR REVIEW AND
APPROVAL BY THE FLORIDA HOUSING FINANCE CORPORATION; FURTHER,
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL
NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY,
FOR SAID PURPOSE.
Background of Item:
In July 1992, the State of Florida enacted the William E. Sadowski Affordable Housing
Act ("Sadowski Act"), which provides for the allocation of a portion of new and existing
documentary stamp taxes on deeds on real estate transactions to local governments for
the development and maintenance of affordable housing.
The Sadowski Act provided a dedicated revenue source for affordable housing and
created the State Housing Initiative Partnership ("SHIP") Program.
Pursuant to Section 420.9072(2)a of Florida Statute, a county or eligible municipality
must submit to the corporation its local housing assistance plan describing the local
housing assistance strategies to be eligible to receive funds under the program.
On April 11, 2019, pursuant to Resolution No. 19-0140 the Miami City Commission
approved the City's LHAP for the period of July 1, 2019, through June 30, 2022.
Pursuant to Resolution No. 22-0203, on June 9, 2022, the Miami City Commission
approved the City's LHAP for the period of July 1, 2022, through June 30, 2025.
On July 27, 2023, pursuant to Resolution No. R-23-0330 the Miami City Commission
approved the amendment the City of Miami's Department of Housing and Community
Development's Housing Program Policies, Single Family Rehabilitation Program from
$70,000 to $100,000, and Single Family Replacement Home Program from $250,000 to
$300,000.
The Emergency Home Repair Assistance Program is part of the LHAP strategies and
there is also a need to change the maximum amount of benefit from $20,000 to
$50,000.
To incorporate this change in the LHAPs an amendment needs to be approved by the
Miami City Commission and later sent to Florida Housing Finance Corporation for
review and final approval.
The City Administration recommends the amendment of the City's Local Housing
Assistance Plan ("LHAP"), attached, and incorporated, for FY2019-2022 and FY2022-
2025, to incorporate the changes made to the Single -Family Rehabilitation program, the
Single -Family Replacement Home program, and the Emergency Home Repair program.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City's Amended LHAP, attached and incorporated, for FY 2019-2022
and FY 2022-2025, to incorporate the changes made to the Single -Family Rehabilitation
program, the Single -Family Replacement Home program, and the Emergency Home Repair
program, is authorized.'
Section 3. The City Manager is authorized' to submit the plan to the Florida Housing
Finance Corporation for review and approval.
Section 4. The City Manager is further authorized to negotiate and execute all
necessary documents, in a from acceptable to the City Attorney, to implement the terms and
conditions of the SHIP program and the LHAP.
Section 5. This Resolution shall become effective immediately upon its adoption.
APPROVED AS TO FORM AND CORRECTNESS:
1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code provisions.
