RE: AMENDED Letter of Intent — Rezoning Request for
3030 SW 22 Street, City of Miami
Dear Ms. Hull:
This law firm represents Coral Rock Development
Group, LLC (the "Applicant"), owner of the property
located at 3030 SW 22 Streets (the "Property") in the City
of Miami (the "City"). The Miami -Dade County Property
Appraiser's Office identifies the Property with Folio No.
01-4116-009-0265. See Exhibit A, Property Appraiser
Summary Report. This letter shall serve as the amended
letter of intent and analysis in support of a rezoning the
Property from T5-O and T4-R to T5-O and T4-O (the
"Application"). The Applicant's goal is to reduce the
development challenges created by the City's split
zoning of the Property in 2010, especially related to
ancillary parking, and provide an appropriate transitional
zoning.
Property Description. The Property is located on
the southeast corner of Coral Way and SW 31 Avenue.
See Figure 1. Aerial, below. The Property also fronts the
Coral Way Established Setback Area ("Coral Way ESA")
and is subject to the Coral Way Design Guidelines as the
Property is located within Zone 5 of the Coral Way
Beautification Master Plan ("Coral Way BMP"). The

Existing Structures and Use. According to microfilm on file with the City's Building
Department, the Property is improved with a two-story commercial/office building and
eighteen (18) parking spaces on the north half, and a one-story duplex building with
fourteen (14) parking spaces and a recreational area on the south half. See Exhibit B,
Building Permit Records No. BD19022427001. The overall use of the Property is
Education. Additionally, there are approximately ten (10) on -street parking spaces on SW
31 Avenue.
Future Land Use Map. The Future Land Use Map ("FLUM") of the City's
Comprehensive Neighborhood Plan ("MCNP") designates the Property for "Restricted
Commercial." See Figure 2, FLUM Excerpt, below.

Zoning. The Property has split zoning transect designations. The Miami 21 Zoning
Code ("Miami 21") GIS Atlas designates the southern portion of the Property as within the
T4 General Urban Transect Zone and the "R" or "Restricted" designation and the northern
portion of the Property as within the T5 Urban Center Transect Zone and the "0" or
"Open" designation. As stated above, the Property also fronts the Coral Way ESA and is
subject to the Coral Way Design Guidelines as the Property is located within Zone 5 of
the Coral Way BMP. See Figure 3, Zoning Excerpt, below.

Application. Article 7, Section 7.1.2.8(c) of Miami 21 states that a rezoning
will only be considered where the proposal involves an extension of an existing transect
boundary, unless the rezoning involves at least 40,000 square feet of land area or 200 feet
of street frontage on one street. Here, the proposed rezoning would be an extension of
the abutting T5-O transect boundary and Open function to the north which satisfies the
rezoning criteria set forth in Section 7.1.2.8(c), Miami 21. Additionally, the Property has
over 200 feet of frontage on SW 31 Avenue. Thus, the Applicants' requested change is
consistent with successional rezoning requirement and meets the minimum frontage
required.

will only be considered where the proposal involves an extension of an existing transect
boundary, unless the rezoning involves at least 40,000 square feet of land area or 200 feet
of street frontage on one street. Here, the Property has approximately 250 feet of
frontage on SW 31 Avenue. Additionally, the proposed rezoning would be an extension
of the existing and abutting T5-O transect boundary and Open function to the north, and
will provide a fifty (50) foot wide T4-O transition area that abuts T3-O Transect, which
satisfies the rezoning criteria set forth in Section 7.1.2.8(c), Miami 21 and minimizes any
potential impacts to the duplex residential area to the south. Thus, the proposed rezoning
is appropriate and meets the criteria established in Article 7, Section 7.1.2.8 of Miami 21.

goals, objectives and policies of the MCNP:
Objective LU-1.3: The City will continue to encourage commercial, office and
industrial development within existing commercial, office and industrial areas;
increase the utilization and enhance the physical character and appearance of
existing buildings; encourage the development of well -designed, mixed -use
neighborhoods that provide for a variety of uses within a walkable area in
accordance with neighborhood design and development standards adopted as a
result of the amendments to the City's land development regulations and other
initiatives; and concentrate new commercial and industrial activity in areas where

Approval of the Application will continue to encourage commercial develo
within an existing commercial area. The Property fronts a major roadway, Coral Way, and
is surrounded by commercial uses to the north, east and west. Approval of the Application
will encourage the development of a well -designed, mixed -use neighborhood that
provides a walkable commercial area for residents to enjoy.

Policy LU-1.3.15: The City will continue to encourage a development
pattern that enhances existing neighborhoods by developing a balanced
mix of uses including areas for employment, shopping, housing, and
recreation in close proximity to each other.
Approval of the Application will continue to encourage a development pattern of
commercial redevelopment along Coral Way, a major roadway, which offers a wide
number and type of employment opportunities. Further, by addressing the split zoning,
the Application will protect and enhance the quality of life of the growing neighborhood
by providing commercial opportunities in close proximity to a major corridor and
commercial area. The remaining T4-O portion will serve as a buffer to the T3-O Transect
to the south. Overall, the proposed rezoning will contribute to the continued
improvement of the surrounding area.
Objective LU-1.6:: Regulate the development or redevelopment of real
property within the city to insure consistency with the goals, objectives and
policies of the Comprehensive Plan.
Approval of this application will allow the redevelopment of the Property in a
manner that advances many of the goals, objectives and policies of the MCNP as outlined
here, as well as the minimum rezoning requirements provided in Miami 21. The
Application is forward thinking investment, consistent with the Coral Way BMP design
standards.
Additionally, fronting SW 22 Terrance is a mix of zoning districts transitioning from
the more intense uses at the activity nodes at the intersections to the duplex residential
area to the south. More specifically, between SW 32 Avenue and SW 27 Avenue the sites
fronting the Avenues are zoned T6-8-O, T4-R, T4-L, and T5-O. Therefore, T5-O fronting
SW 31 Avenue is transitionary and compatible.

Section 7.1.2.8(f)(1)(b) of Miami 21 provides that that for all amend
consideration of the need and justification for the proposed change, includin
changing conditions that make the passage of the proposed change necessary. T
rezone criteria does not specify that the changed condition justifying a rezone occur su
to the enactment of Miami 21. There are many scenarios, two in this case, that are change
conditions that make passage of the Application necessary as a correction to the enactment of
Miami 21.

Previous Zoning. Under Ordinance 11000, the Property was zoned C-1, Restricted
Commercial and within the SD-23, Coral Way Special Overlay District. The C-1 designation
permitted structures used as any type of residential facility except for rescue missions, to a
maximum density equivalent to R-4, and mixed -use or commercial activities which generally serve
the daily retailing and service needs of the public, typically requiring easy access by pedestrians
and private automobiles. The C-1 category was intended for areas directly served by arterial or
collector roadways, or directly accessible via mass transportation system. The SD-23 was
described as a very diverse urban corridor containing residential developments, office
developments, and predominantly one-story retail and service establishments. Also, it was
specifically described as having numerous instances of different land uses occurring on opposite
sides of the corridor creating a unique blend of retail, office and residential uses with a great deal
of pedestrian activity. With the adoption of Miami 21, the southern portion of the Property was
downzoned and restricted to T4-R, which drastically limits the possible commercial uses. The
proposed rezoning would correct the discrepancies created by Miami 21, and return to the
Property a consistent zoning category that was available under Ordinance 11000. It will also
maintain a fifty (50) foot wide T4-0 transition area.
Coral Way Beautification Master Plan. Rezoning will also allow the Applicant to
redevelop the Property in accordance with the Coral Way Beautification Master Plan (the
"Master Plan"). The intent of the guidelines and standards established in the Master Plan
is to enhance and protect the unique image and character that Coral Way. The Master
Plan included specific improvements, such as sidewalk treatments, crosswalk design,
gateway design, corner layouts, lighting, landscape, art in public places, and street
furniture that can come to fruition approval of this rezoning and redevelopment of the
Property. The findings and commendations provided in the Master Plan included,
upgrading the existing zoning overlay SD-23 in order to facilitate pedestrian oriented
development, which is inconsistent with the current zoning. The Property is located in
Zone 5 of the Master Plan Study Area, which is the more commercialized area of the Coral
Way corridor. Compliance with the Master Plan solidifies the need for a pedestrian -
friendly beautification project fronting Coral Way.
Conclusion. This Application satisfies the rezoning requirements provided in Miami
21, with a successional zoning classification that responds to the existing conditions of
the City, and is consistent with the goals, objectives and policies of the MCNP. Further,

of Miami 21.
The images provided below are an analysis of the properties within a 1/2 mile radius of the Property,
the existing conditions, current Zoning and Future Land Use Designations of the properties. This
analysis includes photos of building elevations of both sides of the street, extending 300 feet beyond
all boundaries of sites.
The existing split -zoning of the Property, T4-R and T5-O, is inappropriate because it is inconsistent
with the "Restricted Commercial" Future Land Use Map designation provided on the Correspondence
Table of the City's Comprehensive Neighborhood Plan. The Rezoning to a cohesive T5-O will more
closely resolve this inconsistency and will further the goals, objectives and policies of the
Comprehensive Plan. The existing split -zoning of the Property is also inappropriate when compared
to the existing development context and former zoning designations pursuant to Ordinance 11000.
Under Ordinance 11000, pursuant to C-1, Restricted Commercial and within the SD-23, Coral Way
Special Overlay District, the Property would have been permitted a variety of neighborhood serving
commercial and multi -family uses. Under Miami 21, the T4-R portion of the Property is limited to
residential. Additionally, the zoning change is appropriate to redevelop the Property consistent with
the guidelines and standards established in the Coral Way Beautification Master Plan.

Have you conducted any community outreach? While not required it is
important. A nearby property received a recommendation of denial from
PZAB in April of last year (PZAB-R-21-018). The resolution referenced
the 2010 rezoning of the northern portion of your property (0-13237),
which down -zoned the transect from T6-8-0 to T5-0 after feedback
from neighbors and the neighborhood associations. While the feedback
that led to 0-13237 was over 10 years ago, it is important to be aware
of as the neighborhood associations may hold the same sentiments
today.
Exhibit B surveys with the Batch Stamp for BD19022427001 list a
change of use from office to educational. Educational Uses are allowed
under the existing T4-R by an Exception. According to our records, an
Exception and Warrant were passed under PZAB-R-19-035 on July 31,
2019. Your Exception may not have expired since it appears you've
pulled permits within two years of the Exception. Does the contract
purchaser wish to build the school? If so, the rezone most likely is not
required.
Your LOI is missing information regarding the justification for the rezone
(i.e. changing conditions). See Article 7, Section 7.1.2.8.f.1.(b).
This information is not required to be included in your application,
however, it is helpful for the Planning Department's recommendation to
PZAB.
Your LOI states the existing use of the Property is Office, however, the
Property has an active CU for Education (Cert. # 2006-000512).

1. The Department of Resilience and Public Works, Transportation, Coordinated Review Com
and County agencies review zoning public hearing requests and provide input, which may of

2. Filing fees may not be the total cost of a hearing. Some requests require notices to be mailed to property
owners up to a mile from the subject property and I am responsible for paying the additional radius mailing
costs. In addition to mailing costs, I am responsible for additional fees related to application changes, plan
revisions, deferrals, re -advertising, etc. that may be incurred. I understand that fees must be paid promptly. The
only fees that will be refunded after the submission and acceptance of an application for public hearing has
occurred will be the surcharge fees related to appeals, as expressly listed in Chapter 62 of the City Code
(Code).
3. Requests for public hearing will be scheduled by the Hearing Boards in accordance with the scheduling timeline
set forth in the Code and the Zoning Ordinance of the City of Miami (Miami 21), as applicable. I must submit any
requests to reschedule, continue or defer my hearing date to the attention of the decision -making body for its
consideration and vote at the public hearing on which my application is scheduled to be heard. I understand that
any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, as per the Code.
4. Applicable Florida Building Code requirements, or other applicable requirements, may affect my ability to obtain
a building permit even if my zoning application is approved; and a building permit will probably be required. I am
responsible for obtaining any required permits and inspections for all structures and additions proposed, or built,
without permits. In addition, a Certificate of Use (C.U.) must be obtained for the use of the property after it has
been approved at a zoning public hearing. Failure to obtain the required permits and/or C.U., Certificates of
Completion (C.C.), or Certificate of Occupancy (C.O.) will result in an enforcement action against any occupant
and owner. Submittal of the zoning public hearing request may not forestall enforcement action against the
property.
5. If my request is denied, deferred, or otherwise not approved, I understand that I will not be reimbursed for any
fees paid.
6. Any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, as per the Code.
7. Any covenant to be voluntarily proffered must be submitted in word format to the Planning Department and to
the Office of the City Attorney through ePlan for review and comments from the Planning Department, Office of
the City Attorney, and any other City departments as deemed necessary. The covenant will be reviewed in
ePlan and the applicant will be notified of any necessary changes, corrections or comments through ePlan.
Once the covenant receives a recommendation of approval from the Planning department and as to legal form,
Hearing Boards staff will extract the approved covenant directly from ePlan to include as part of the agenda.
The applicant is responsible to submit to the Hearing Boards the signed covenant with a current Opinion of Title
no later than two (2) weeks prior to the initial public hearing. I understand that any requests by the applicant to
reschedule, continue or defer the hearing date that are granted shall incur a $1,000.00 fee, per instance, as per
the Code.

Welcome to the City of Miami! This package is intended to provide you with all open
Code Enforcement violations and liens attached to the subject property, or properties,
as of the current date and time the following report was created. Closed violations and

A violation may become a lien when the property owner does not timely remedy the
violation. This report may include two types of liens: Certified liens and non -certified
liens. Certified liens have a set amount to be paid. Conversely, most non -certified liens
continue to accrue interest or a per diem fine; therefore, those liens must be satisfied
with the City as quickly as possible.
All outstanding violations and liens must be satisfactorily resolved before the City can
issue a Certificate of Use (CU); however, the City inspects all properties prior to the
