REFERENCES: N/A Department of Real Estate & Asset Management ("DREAM") ENCLOSURES: N/A The City of Miami is the owner of real property located at 970 SW 1 Street, Miami, FL, and has an active Revocable License Agreement ("RLA") with the current occupant of Room 300 and 302, La Unidad Cubana, Inc. ("Licensee"). The Licensee has advised that due to challenges brought on by the Covid-19 pandemic, they are unable to afford the current rent payments as agreed. Additionally, Licensee no longer utilizes Room 300 and are requesting the Room be removed from use in the RLA to further lower payments. The Licensee also owes approximately $90,332.53 in use fees exclusive of late fees or interest for the period of September 2014 — May 2023 and DREAM requests a settlement agreement to be negotiated and executed. Please confirm your recommendation that competitive negotiation methods and procedures are not practicable or advantageous to the City pursuant to the Code of the City of Miami, Florida, as amended due to the unique services and expertise provided Licensee which may be provided in connection with their use of the Property pursuant to the terms and conditions of the Agreement. Considering the above, DREAM respectfully requests approval of a waiver of the formal requirements of competitive sealed bidding methods as not being practicable or advantageous to the City as set forth in Section 18-85(a) of the City Code or Ordinances, as amended, the affirmation of these written findings, and recommendation to the City Commission for ratification by a four -fifths affirmative vote.
