The undersigned serves as special land use counsel to Brotherhood of Electrical Workers, Inc., a Florida not for profit corporation {the "Applicant"). This request is submitted in accordance with the requirements applicable to the City of Miami's Rezoning Cycle for the Spring of 2021. The Applicant respectfully submits the attached application to amend the Future Land Use Map of the Miami Comprehensive Neighborhood Plan (the "MCNP") for properties located at 1649 NW 16 Terrace, 1700 NW 15 Street Road, 1644 NW 16 Terrace and 1650 NW 16 Terrace (collectively referred to hereinafter as the "Subject Properties"). The Subject Properties collectively comprise approximately 0.91 acres or 39,687+ square feet in area. The Applicant is the fee owner of the Subject Properties. The Subject Properties comprise the local union hall and apprenticeship for the International Brotherhood of Electrical Workers ("IBEW"), LocaI No. 349. The envisioned redevelopment program, provided that the above -referenced application is approved, will include a comprehensive improvement package that will substantially enhance the area with the introduction of a mixed -use product comprised of a newly designed union hall, electrical apprenticeship school, professional office space, convention space, structured parking and affordable/senior living and workforce residential units. As described in more particularity below, the Subject Properties are owned and operated under a single form of ownership that has been the home to the IBEW since 1948, over seven decades ago when the membership first constructed the union hall. The IBEW membership has served as one of the primary components of the workforce within the City of Miami throughout those years and has been a staple of the Allapattah community. As development trends continue throughout the urban core and surrounding neighborhoods within the City of Miami, including Allapattah, accessibility to moderately priced residential products are becoming scarce. The adoption of the application will serve to accommodate the increasing need for attainable housing for the union membership as well as to permit the expansion of the existing uses of the Subject Properties with trade union/apprenticeship uses within the podium of future mid - rise mixed -use building(s), a functionality that does not currently exist due to competing land use designations and zoning classifications. • REOUESTED LAND USE AMENDMENT AND CONSISTENCY ANALYSIS In addition to the Subject Properties, the Applicant is the fee owner of a larger assemblage of contiguous lands that encompasses 1657 NW 17 Avenue, 1601 NW 17 Avenue, and 1667 NW 17 Avenue (collectively the Subject Properties and the additional contiguous properties that comprise the assemblage are hereinafter referred to as the "Assemblage"). While located in the Health District Regional Activity Center, where employment centers are encouraged, the MCNP bifurcates the Assemblage into two separate, distinct and competing land use designations. The western section of the Assemblage, those fronting along NW 17 Avenue, are designated Restricted Commercial on the Future Land Use Map while the Subject Properties, all of which have been under a single form of ownership for decades, are designated High Density Multifamily Residential. The Applicant is proposing an amendment to the City's Future Land Use Map to create consistency among proximate land uses by amending the designation assigned to the Subject Properties from High Density Multifamily Residential to Restricted Commercial. The requested amendments will create a uniform future land use pattern throughout the Assemblage without increasing residential density, since both the High Density Multifamily Residential and Restricted Commercial designations support redevelopment at a rate of 150 dwelling units per acre. Instead, what the proposed land use amendment affords is the eligibility to seek a uniform mixed -use development with general office and commercial activities comprising the podium of mixed -use towers. Such uses are reflected and supportive of the existing development trends within the area. The surrounding area is characterized by a mixture of Restricted Commercial, High Density Multifamily and Major PUB, FAC land use designations. The Restricted Commercial designation occupies the majority of the neighborhood including the entirety of NW 17 Avenue corridor, all areas south of NW 14 Street to the Miami River and all areas situated east of NW 15 Street to the health care district. The High -Density Multifamily designation currently occupies a block and a half in width, bifurcating the Restricted Commercial designations existing on both NW 17 Avenue and NW 15 Avenue. The Applicant's proposed land use amendments are consistent with the City's vision and plans for the area. At a minimum, the information below supports the Applicant's proposal as one that is consistent with the Goals, Objectives and Policies of the MCNP. Goal LU-1: Maintain a land use pattern that (1) protects and enhances the quality of life in the City's neighborhoods; (2) fosters redevelopment and revitalization of blighted or declining areas; (3) promotes and facilitates economic development and the growth of job opportunities in the city; (4) fosters the growth and development of downtown as a regional center of domestic and international commerce, culture and entertainment; (5) promotes the efficient use of land and minimizes land use conflicts while protecting and preserving residential sections within neighborhoods; (6) protects and conserves the city's significant natural and coastal resources; and (7) protects the integrity and quality of the City's existing neighborhoods by insuring public notice, input and appellant rights regarding changes in existing zoning and land use regulations. Policy LU-1.1.7: Land development regulations and policies will allow for the development and redevelopment of well -designed mixed -use neighborhoods that provide for the full range of residential, office, live/work spaces, neighborhood retail, and community facilities in a walkable area and that are amenable to a variety of transportation modes, including pedestrianism, bicycles, automobiles, and mass transit. Policy LU-1.1.11: The City hereby adopts designation of the City, excluding Virginia Key, Watson Island and the uninhabited islands of Biscayne Bay, that have a land use and zoning classification of Conservation, as an Urban Infill Area pursuant to Miami -Dade County's designation of an Urban Infill Area lying generally east of the Palmetto Expressway and including all of the City of Miami. Within this area, the concentration and intensification of development around centers of activity shall be emphasized with the goals of enhancing the livability of residential neighborhoods and the viability of commercial areas. Priority will be given to infill development on vacant parcels, adaptive reuse of underutilized land and structures, the redevelopment of substandard sites, downtown revitalization and the development of projects that promote public transportation. Maintenance of transportation levels of service within this designated Urban Infill Transportation Concurrency Exception Area shall be in accordance with the adopted Transportation Corridors level of service standards and the City of Miami Person Trip Methodology as set forth in Policies TR-1. 1.2 and 1.1.3 of the Transportation Element of the MCNP. Declining neighborhoods are defined as areas characterized by the prevalence of structures having minor deficiencies, a general need for improvements in real property, significant declines in real property values, high vacancy rates in commercial structures and increasing difficulty in obtaining insurance. Neighborhoods threatened with decline are defined as areas characterized by significant but infrequent property maintenance neglect, an aging housing stock, declining property values, general exodus of traditional residents and influx of lower income households. Policy LU-1.2.2: The City's land development policies will be consistent with affordable housing objectives and policies adopted in the Housing Element of the MCNP. Objective LU-1.3: The City will continue to encourage commercial, office and industrial development within existing commercial, office and industrial areas; increase the utilization and enhance the physical character and appearance of existing buildings; encourage the development of well -designed, mixed -use neighborhoods that provide for a variety of uses within a walkable area in accordance with neighborhood design and development standards adopted as a result of the amendments to the City's land development regulations and other initiatives; and concentrate new commercial and industrial activity in areas where the capacity of existing public facilities can meet or exceed the minimum standards for Level of Service (LOS) adopted in the Capital Improvement Element (CIE). Policy LU-1.3.7: The City will continue to use the City's Enterprise Zone, Empowerment Zone, Commercial Business Corridors, and Brownfield Redevelopment Area strategies to stimulate economic revitalization, and encourage employment opportunities. (Policy PA-3.3.10) Policy LU-1.3.15: The City will continue to encourage a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other.
