Dear Mr. Garcia:
This law firm represents 2170 SBH, LLC, and 45 SBH, LLC (the
"Applicants") the owners of the properties located at 2170 NW Flagler Terrace and
45 NW 22 Avenue (collectively the "Property") within the City of Miami (the
"City"). See Exhibit A, Addresses and Legal Descriptions. In order to develop a
mixed -use, transient oriented project, the Applicants seek to rezone the portion of
the Property located at 2170 NW Flagler Terrace (the "West Parcel") from T6-8-0
to T6-8-L, and the portion of the Property located at 45 NW 22 Avenue (the "East
Parcel") from T4-R to T5-R. This rezoning will permit a compatible, mixed -use
project fronting the 22nd Avenue Established Setback Area. This letter shall serve
as the required letter of intent in connection with the request for a rezoning of the
Property.
Property Description. The Property is generally located at the confluence
of three (3) major roadways: West Flagler Street, NW 22nd Avenue, and Beacom
Boulevard. There is a City of Miami Police Station and a large supermarket within
two (2) blocks of the Property. Miami -Dade County's Office of the Property
Appraiser identifies the West Parcel with Folio No. 01-4103-013-0620 and the East
Parcel with Folio No. 01-4103-013-0610. See Exhibit B, Property Appraiser
Summary Report. Combined, the Property is approximately 40,927 square feet in
size. The West Parcel is approximately 22,993 square feet in size, and developed
with an approximately 2,700 square foot, one-story building fronting NW 22

Land Use. The West Parcel is included in the City's Restricted Commercial
Future Land Use category together with all the properties fronting NW 22 Avenue,
Glenn Royal Parkway, and West Flagler Street. The East Parcel is included in the
City's Medium Density Multi -family Residential Future Land Use category, and
abuts the Restricted Commercial category on two sides. See Figure 1 below, Future
Land Use Plan Map Excerpt.

Zoning. The West Parcel is located within the T6-8-O zoning transect, and
the East Parcel is located within the T4-R zoning transect. See Figure 2 below,
Zoning Map Excerpt. Pursuant to the Miami Neighborhood Comprehensive Plan
("MNCP") Correspondence Table, a T5-R zoning designation for the East Parcel is
more consistent with the corresponding Medium Density Multi -family Residential
Future Land Use category.

Rezoning Request. The Applicants are seeking to rezone the Property in order
to activate NW 22 Avenue with additional retail and residential uses. The Applicant's
rezoning request from zoning transects of T6-8-O and T4-R to T6-8-L and T5-R,
respectively effectively limits the as -of -right permitted uses for the West Parcel, and
is a slight increase in intensity for the East Parcel. This change will allow for viable
redevelopment of the Property with a quality mixed -use development that is
complimentary to the surrounding area. The increase in density will permit an
additional twenty-nine (29) dwelling units per acre on the East Parcel.
Analysis. Section 7.1.2.8(a) of Miami 21 provides the City's growth and
evolution over time will inevitably require changes to the boundaries of certain
Transect Zones. In this case, one of the changes proposed is within the same
Transect Zone and the other is to the next higher Transect Zone. The Property is
located near the intersection two (2) major, section line roads, one of which is
Flagler Street, a city -designated Transit Corridor, where new development and
higher intensity is preferred. This request, also, satisfies the successional zoning
requirements provided in Section 7.1.2.8(a).
Section 7.1.2.8(f) of Miami 21 provides the criteria for amendments to
Miami 21. Part 1 of the provision provides as follows " [f]or all amendments:
(a) The relationship of the proposed amendment to the goals, objectives and
policies of the Comprehensive Plan, with appropriate consideration as to

whether the proposed change will further the goals, objectives an

The request is consistent with and furthers the goals, objectives and policies
of MCNP. Specifically, Policy LU-1.1.7 of the MCNP provides that the
"[1]and development regulations and policies will allow for the
development and redevelopment of well -designed mixed -use
neighborhoods that provide for the full range of residential, office,
live/work spaces, neighborhood retail, and community facilities in
a walkable area and that are amenable to a variety of transportation
modes, including pedestrianism, bicycles, automobiles, and mass
transit."
The Applicants are proposing a mixed -use development, along two (2)
major section line roads. The rezoning will foster bus and MetroRail use as there
is an existing Miami -Dade County bus stop, Route 22, abutting the Property that
stops at both the Earlington Heights Metrorail Station and the Coconut Grove
Metrorail Station. This will improve connectivity and incentivize mass -transit use.
Policy LU-1.3.1.4 provides that the "City will continue to encourage a
development pattern that enhances existing neighborhoods by developing a
balanced mix of uses include areas for employment, shopping, housing, and
recreation in close proximity to each other." This rezoning request will further this
policy by increasing residential development capacity at this commercial
intersection thereby bringing more residents within walking distance to shopping
and transit. As previously mentioned, there is a large supermarket located two (2)
blocks south from the Property. This area has also experienced a number of recent
developments that are compatible with the proposed rezoning. The Altos De
Miami building directly across from the Property on SW 22nd Avenue is a sixteen
(16) story mixed use development with 135 residential units. Recently, the Jasmine
Apartments, an eight -story multi -family residential building, is being constructed
at 100 SW 22nd Avenue.
The successional change in zoning designations for this Property is
necessary to address the growing need for additional housing and employment

opportunities in the City. With regards to the East Parcel, a rezoning is n
for its zoning designation to be more consistent with its Future Lan
designation. This rezoning is compatible with the developments on the west side
of NW 22 Avenue and the projected future development along West Flagler Street
and along the 22nd Avenue Established Setback Area.1

Part 2 of Section 7.1.2.8(f) specifically applies to rezonings, and provides
that a "change may be made only to the next intensity Transect Zone or by a
Special Area Plan, and in a manner which maintains the goals of this Miami 21 to
preserve Neighborhoods and to provide transitions in intensity and Building
Height." As mentioned, the two proposed changes comply with successional
zoning. The proposed change to the West Parcel is exclusively a change to the "L"
or Limited use classification, and the transect zone is the same. The proposed
change for the East Parcel is to the next intense transect zone from T4-R to T5-R
and maintains the "R" or Restricted use classification. This is compatible with the
growing area of Little Havana and East Little Havana neighborhoods. For
example, the properties located on the west side of NW 22 Avenue are zoned T6-
8 and T5. As similar pattern is proposed for the Property. Therefore, the changes
satisfy successional zoning and will preserve the surrounding neighborhood.
Covenant. In order to assure a mix of housing prices, the Applicant is
proffering a covenant. The covenant requires ten percent (10%) of the housing
units as a part of any multifamily residential rental or condominium development
on the Property shall be owner occupied and/or rental housing with a purchase
cost, value, or monthly rental, as applicable, equal to or less than the amounts
established by the applicable standards for those individuals whose income is at
or below eighty percent (80%) of Area Median Income based on City of Miami
standards and certified by the City of Miami Department of Community
Development.
Conclusion. The goal of this rezoning application is to enhance the area
with new housing opportunities and commercial establishments for the local
residents. It will foster a more pedestrian friendly community and build the
connectivity between NW 22 Avenue and West Flagler Street.
1 Pursuant to Section 3.3.6 of Miami 21, new buildings within an Established Setback areas must
maintain the provided setback. Within the 22nd Avenue Established Setback Area the required
setback is zero (0) feet with a Gallery. A Gallery is defined as a covered pedestrian area adjoining
the side of a building, without floors above. This is typical of and encourages urbanistic design
along major thoroughfares, such as 22nd Avenue. Otherwise, the required principal front setback
in the T6-8 Transect is ten (10) feet, and twenty (20) feet above the eighth -story.

in the Little Havana neighborhood. This is a mixed -use area consisting of single and
multifamily residential. NW 22nd Avenue is a major roadway, and designated an
Established Setback Area. The properties located along the major thoroughfares are
within Restricted Commercial category of the Miami Neighborhood Comprehensive Plan
Future Land Use Map. This area also contains a few Major Public Facilities, such as
Miami High School, Citrus Grove Middle School, and Marlins Park.

North of the Property is zoned T6-8-0, and is currently an automobile sales
establishment, a vacant lot, and single-family housing. East of the Property is zoned T4-
R, and is a variety of multifamily residential housing. South of the Property is zoned T6-
8-0, and contains individual retail and commercial establishments in a single structure
facing West Flagler Street. West of the Property is zoned T6-8-0, and is developed with
a 16-story multi -family residential structure, and a single -story commercial structure.
This is a diverse community, and the current zoning does not permit compatible
projects along the 22nd Avenue Established Setback Area. See Letter of Intent for analysis
of Miami 21 Section 7.1.2.8.f, and how this rezoning satisfies the goals objectives and

I hope you are doing well. As a follow up to our phone conversation, and in response to your request, I am
including a copy of the letter of intent submitted with our client's application for a rezoning. Our client intends
to develop a mixed -use building on the property with commercial on the ground floor and multi -family
residential units making up the rest of the building. They do not have final architectural plans yet, as the first
step for them is to obtain the rezoning approval.
Nevertheless, I will also share with you a conceptual site study that provides approximately 102 units and 152
parking spaces. The setback from the east property line, abutting your property, is 6 feet as required by the
Miami 21 Code. Also, the maximum height of any building abutting your property is 5 stories or approximately
81 feet. The building closer to 22 Avenue is 8 stories.
This study represents a potential redevelopment scenario that our client is considering. However, as I
indicated, the rezoning application would not require redevelopment in accordance with this plan. In addition,
the redevelopment described would require a subsequent waiver approval which will require notice to you as
an abutting property owner.

Pursuant to State Statutes and the Interlocal Agreements for Public School Facility Planning in Miami -Dade
County, the above -referenced application was reviewed for compliance with Public School Concurrency.
Accordingly, enclosed please find the School District's Preliminary Concurrency Analysis (Schools Planning
Level Review).
As noted in the Preliminary Concurrency Analysis (Schools Planning Level Review), the proposed development
would yield a maximum residential density of 26 multifamily units, which generates 7 students; 3 elementary,
2 middle and 2 senior high students. At this time, all levels have sufficient capacity available to serve the
application. However, a final determination of Public School Concurrency and capacity reservation will only be

1. The Department of Resilience and Public Works, Transportation, Coordinated Review Committee and other City
and County agencies review zoning public hearing requests and provide input, which may affect the scheduling
and outcome of my hearing. These reviews may require additional hearings before other City and County
boards, which may result in the modification of plans, studies and/or the proffering of agreements to be
recorded. The submission and acceptance of a request for public hearing means that the application is ready to
be scheduled for public hearing. I am also aware that I must comply promptly with any City or County conditions
and notify the Hearing Boards (Hearing Boards) in writing if my public hearing application will be withdrawn.
2. Filing fees may not be the total cost of a hearing. Some requests require notices to be mailed to property
owners up to a mile from the subject property and I am responsible for paying the additional radius mailing
costs. In addition to mailing costs, I am responsible for additional fees related to application changes, plan
revisions, deferrals, re -advertising, etc. that may be incurred. I understand that fees must be paid promptly. The
only fees that will be refunded after the submission and acceptance of an application for public hearing has
occurred will be the surcharge fees related to appeals, as expressly listed in Chapter 62 of the City Code
(Code).
3. Requests for public hearing will be scheduled by the Hearing Boards in accordance with the scheduling timeline
set forth in the Code and the Zoning Ordinance of the City of Miami (Miami 21), as applicable. I must submit any
requests to reschedule, continue or defer my hearing date to the attention of the decision -making body for its
consideration and vote at the public hearing on which my application is scheduled to be heard. I understand that
any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, as per the Code.
4. Applicable Florida Building Code requirements, or other applicable requirements, may affect my ability to obtain
a building permit even if my zoning application is approved; and a building permit will probably be required. I am
responsible for obtaining any required permits and inspections for all structures and additions proposed, or built,
without permits. In addition, a Certificate of Use (C.U.) must be obtained for the use of the property after it has
been approved at a zoning public hearing. Failure to obtain the required permits and/or C.U., Certificates of
Completion (C.C.), or Certificate of Occupancy (C.O.) will result in an enforcement action against any occupant
and owner. Submittal of the zoning public hearing request may not forestall enforcement action against the
property.
5. If my request is denied, deferred, or otherwise not approved, I understand that I will not be reimbursed for any
fees paid.
6. Any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, as per the Code.
7. Any covenant to be voluntarily proffered must be submitted in word format to the Planning Department and to
the Office of the City Attorney through ePlan for review and comments from the Planning Department, Office of
the City Attorney, and any other City departments as deemed necessary. The covenant will be reviewed in
ePlan and the applicant will be notified of any necessary changes, corrections or comments through ePlan.
Once the covenant receives a recommendation of approval from the Planning department and as to legal form,
Hearing Boards staff will extract the approved covenant directly from ePlan to include as part of the agenda.
The applicant is responsible to submit to the Hearing Boards the signed covenant with a current Opinion of Title
no later than two (2) weeks prior to the initial public hearing. I understand that any requests by the applicant to
reschedule, continue or defer the hearing date that are granted shall incur a $1,000.00 fee, per instance, as per
the Code.

permits prohibited, non- homestead properties", permits shall not be issued for a non -homestead property with any
outstanding code enforcement violations, building violations, or any relevant city lien or invoice due and owing to the
