("Bird") and HELBIZ FL LLC ("Helbiz") for the provision of Shared Motorized Scooter Services, for the Department Of Resilience And Public Works ("RPW') for a period of three (3) years with the option to renew for two (2) additional one (1) year periods; authorizing the City Manager to execute the negotiated Professional Services Agreements ("PSA") with the two (2) highest ranked, responsive and responsible Proposers, Bird and Helbiz, in a form acceptable to the City Attorney, and to negotiate and execute any and all documents, including any amendments, renewals, and extensions, subject to all allocations, appropriations and budgetary approval having been previously made, compliance with applicable provisions of the Code of The City of Miami, Florida, as amended, ("City Code"), including, the City of Miami's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with all applicable laws and regulations, as may be necessary for said purpose. Background of Item: RPW is in need of Shared Motorized Scooter Services to provide micro -mobility and last -mile solutions in the City of Miami ("City"). The initial scope of the services will be confined to District Two (2) and the fleet size will be 1500 scooters, split evenly between Bird and Helbiz. Expansion of the geographical area of operation beyond District 2 is permitted pursuant to Section 3(s) of the solicitation which states: "the City retains the sole discretion to set and adjust the maximum overall actual geographic area of operation for Successful Proposer(s)." This program is anticipated to generate an annual revenue of approximately $1,931,875.00 payable to the City of Miami. Bird and Helbiz must adhere to the Amended Chapter 8 of the Code of the City of Miami ("City Code"), which regulates scooter operations (parking, riding, re -balancing), provides remedies for infractions of the City Code, and requires helmets for all users. WHEREAS, on June 18, 2021, the City of Miami ("City") Department of Procurement ("Procurement"), on behalf of the City's Department of Resilience and Public Works ("RPW'), issued Request for Proposals ("RFP") No. 1170387, under full and open competition, to obtain proposals from experienced and qualified firms for the provision of Shared Motorized Scooter Services; and WHEREAS, on October 15, 2021, a total of nine (9) proposals were received in response to the RFP, of which seven (7) proposals were deemed responsive, two (2) proposals were deemed nonresponsive for failure to provide required information, and one (1) other proposal was not considered for failure to submit prior to the submission deadline; and WHEREAS, the Commission desires to reject all proposals and is requesting the preparation of a new RFP; and WHEREAS, said new RFP would incorporate input from the whole of the Commission, inclusive of the current District Two Commissioner who had limited, if any, opportunity for input in this process, and address all of the safety related concerns of the same; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. All proposals received October 15, 2021, pursuant to RFP No. 1170387, for the provision of Shared Motorized Scooter Services, for RPW, are hereby rejected. Section 3.
