Restrictive Covenant located at 1775
Biscayne Blvd

ENCLOSURES:
On October 20, 2022, the City of Miami's Release Review Committee ("RRC")
recommended approval by the City Commission of the release of restrictive covenant recorded
on August 10, 2007, in Official Records Book 25849, Page 4009 of the Public Records of Miami
Dade County, Florida ("Covenant") against the property located at approximately 1775 Biscayne
Boulevard ("Property"). The Covenant was proffered in connection with an amendment to the
City's zoning atlas related to a Master Use Special Permit ("MUSP") approval which was granted
for the Property under the previous zoning code, Ordinance 11000. The Covenant restricted the
Property as follows:
1. The Property was limited toa maximum Floor Area Ratio ("FAR") of 5.0.
The RRC recommends approval of a release of the Covenant for the following reasons:
1. The City repealed and replaced Ordinance 11000 with the City's current zoning code
("Miami 21"), which replaced the FAR standard with a new Floor Lot Ratio ("FLR")
standard.
2. The Property was rezoned in 2013 to the T6-36B-O transect zone, which allows a FLR of
22.0 on the Property by right.
