HomeMy WebLinkAboutO-14167City of Miami Ordinance 14167 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13540 Final Action Date: 4/27/2023 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ("MIAMI 21 CODE"), BY AMENDING ARTICLE 5, SECTION 5.6.2 OF THE MIAMI 21 CODE, TITLED "SPECIFIC TO ZONES/BUILDING CONFIGURATIONS (T6)"; AND ILLUSTRATION 5.6, TITLED "URBAN CORE TRANSECT ZONES", TO ALLOW ADDITIONAL FLEXIBILITIES IN OFFICE AND COMMERCIAL FLOORPLATE AREA ABOVE THE EIGHTH FLOOR; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. SPONSOR(S): Mayor Francis X. Suarez WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114 as the Zoning Ordinance of the City of Miami, as amended ("Miami 21 Code"); and WHEREAS, an amendment is necessary to allow additional flexibilities in Office and Commercial floorplate dimensions above the eighth floor in the "T6" Transect Zone that reflects changing market conditions and requirements; and WHEREAS, the proposed design flexibilities respond to global financial institutions and technology companies that require workspaces featuring increased visibility, flexibility, efficiency, volumetric space, and strategic co -location; and WHEREAS, the Planning, Zoning and Appeals Board ("PZAB"), at its meeting on February 15, 2023, following an advertised public hearing, adopted Resolution No. PZAB-R- 23- 022 by a vote of nine to zero (9-0), Item No. PZAB. 9, recommending approval of the zoning text change as stated herein; and WHEREAS, the City Commission has considered whether the proposed amendments will further the goals, objectives and policies of the Miami Comprehensive Neighborhood Plan ("MCNP"), the Miami 21 Code, and other City of Miami ("City") regulations; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City and its citizens to amend the Miami 21 Code as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated herein as if fully set forth in this Section. The Miami 21 Code is hereby amended by amending Article 5 in the following particulars': "ARTICLE 5. SPECIFIC TO ZONES 5.6 URBAN CORE TRANSECT ZONES (T6) 5.6.2 BUILDING CONFIGURATION (T6) a. Development within Private Frontages shall comply with Article 4, Table 2 and 6 and Illustration 5.6. b. Above the eighth floor, the Building Floorplate dimensions shall be limited as follows: 1. 15,000 square feet maximum for Residential Uses in T6-8, T6-12 and T6-24 2. 18,000 square feet maximum for Residential Uses in T6-36, T6-48, T6-60 and T6-80 3. 30,000 square feet maximum for Commercial Uses and for parking 43. 180 feet maximum length for Residential Uses 5. 215 feet maximum length for Commercial Uses 64. Balconies or any other exterior projections shall not project by a distance greater than seven (7) feet beyond the Building Floorplate maximum length in any direction �5. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4.
