However, offstreet parking facilities, parking garages, or other similar facilities and mass transportation systems must be approved by vote of a majority of the affected property owners. Any municipality which is legally obligated for providing capital improvements for water, alternative water supplies, including, but not limited to, reclaimed water, water from aquifer storage and recovery, and desalination systems, or sewer facilities within an unincorporated area of the county may recover the costs of the capital improvements by levying and collecting special assessments for the purposes authorized in this section on the specially benefited property; however, collections of the special assessment shall not take place until the specially benefited property connects to the capital improvement. (2) Special assessments may be levied only for the purposes enumerated in this section and shall be levied only on benefited real property at a rate of assessment based on the special benefit accruing to such property from such improvements when the improvements funded by the special assessment provide a benefit which is different in type or degree from benefits provided to the community as a whole. (3) Any municipality, subject to the approval of a majority of the affected property owners, may levy and collect special assessments against property benefited for the purpose of stabilizing and improving: (a) Retail business districts, (b) Wholesale business districts, or (c) Nationally recognized historic districts, or any combination of such districts, through promotion, management, marketing, and other similar services in such districts of the municipality. This subsection does not authorize a municipality to use bond proceeds to fund ongoing operations of these districts. (4) Notwithstanding any other provision of law, a municipality may not levy special assessments for the provision of fire protection services on lands classified as agricultural lands under s. 193.461 unless the land contains a residential dwelling or nonresidential farm building, with the exception of an agricultural pole barn, record for item(s) RE.7, on 04-13-2023, City Clerk www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0100-0199/0170/0170.html 2/8 4/5/23, 11:49 AM Statutes & Constitution :View Statutes : Online Sunshine provided the nonresidential farm building exceeds a just value of $10,000. Such special assessments must be based solely on the special benefit accruing to that portion of the land consisting of the residential dwelling and curtilage, and qualifying nonresidential farm buildings. As used in this subsection, the term "agricultural pole barn" means a nonresidential farm building in which 70 percent or more of the perimeter walls are permanently open and allow free ingress and egress. '— w 170.03 Resolution required to declare special assessments. —When the governing authority of any *= municipality may determine to make any public improvement authorized by s. 170.01 and defray the whole or any a part of the expense thereof by special assessments, said governing authority shall so declare by resolution stating N the nature of the proposed improvement, designating the street or streets or sidewalks to be so improved, the location of said sanitary sewers, storm sewers, and drains, the location of said water mains, water laterals, and other water distribution facilities, the location of the utilities, the location of the recreational facilities, the location of the seawalls, the location of the drainage project, or the location of the retail or wholesale business districts or nationally recognized historic districts to be improved, and the part or portion of the expense thereof to be paid by special assessments, the manner in which said assessments shall be made, when said assessments are to be paid, what part, if any, shall be apportioned to be paid from the general improvement fund of the municipality; and said resolution shall also designate the lands upon which the special assessments shall be levied, and in describing said lands it shall be sufficient to describe them as "all lots and lands adjoining and contiguous or bounding and abutting upon such improvements or specially benefited thereby and further designated by the assessment plat hereinafter provided for." Such resolution shall also state the total estimated cost of the improvement. Such estimated cost may include the cost of construction or reconstruction, the cost of all labor and materials, the cost of all lands, property, rights, easements, and franchises acquired, financing charges, interest prior to and during construction and for 1 year after completion of construction, discount on the sale of special assessment bonds, cost of plans and specifications, surveys of estimates of costs and of revenues, cost of engineering and legal services, and all other expenses necessary or incident to determining the feasibility or practicability of such construction or reconstruction, administrative expense, and such other expense as may be necessary or incident to the financing herein authorized. History.—s. 3, ch. 9298, 1923; CGL 3024; s. 2, ch. 59-396; s. 2, ch. 67-552; s. 1, ch. 78-330; s. 2, ch. 87-103; s. 40, ch. 91-45; s. 2, ch. 92-156; s. 3, ch. 94-344. 170.04 Plans and specifications, with estimated cost of proposed improvement required before adoption of resolution. —At the time of the adoption of the resolution provided for in s. 170.03, there shall be on file with the town or city clerk, or like officer, of the municipality adopting said resolution, an assessment plat showing the area to be assessed, with plans and specifications, and an estimate of the cost of the proposed improvement, which assessment plat, plans and specifications and estimate shall be open to the inspection of the public. History.—s. 4, ch. 9298, 1923; CGL 3025; s. 3, ch. 59-396. 170.05 Publication of resolution. —Upon the adoption of the resolution provided for in s. 170.03, the municipality shall cause said resolution to be published one time in a newspaper of general circulation published in said municipality, and if there be no newspaper published in said municipality, the governing authority of said municipality shall cause said resolution to be published once a week for a period of 2 weeks in a newspaper of general circulation published in the county in which said municipality is located. record for item(s) RE.7, on 04-13-2023, City Clerk www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0100-0199/0170/0170.html 3/8 4/5/23, 11:49 AM Statutes & Constitution :View Statutes : Online Sunshine History.—s. 5, ch. 9298, 1923; CGL 3026. U 170.06 Preliminary assessment roll. —Upon the adoption of the resolution aforesaid, the governing authority of the municipality shall cause to be made a preliminary assessment roll in accordance with the method of s assessment provided for in said resolution, which assessment roll shall be completed as promptly as possible; said c assessment roll shall show the lots and lands assessed and the amount of the benefit to and the assessment against .E each lot or parcel of land, and, if said assessment is to be paid in installments, the number of annual installments in which the assessment is divided shall also be entered and shown upon said assessment roll. History.—s. 6, ch. 9298, 1923; CGL 3027; s. 3, ch. 67-552; s. 4, ch. 87-103. 3 N 170.07 Publication of preliminary assessment roll. —Upon the completion of said preliminary assessment roll, the governing authority of the municipality shall by resolution fix a time and place at which the owners of the property to be assessed or any other persons interested therein may appear before said governing authority and be heard as to the propriety and advisability of making such improvements, as to the cost thereof, as to the manner of payment therefor, and as to the amount thereof to be assessed against each property so improved. Thirty days' notice in writing of such time and place shall be given to such property owners. The notice shall include the amount of the assessment and shall be served by mailing a copy to each of such property owners at his or her last known address, the names and addresses of such property owners to be obtained from the records of the property appraiser or from such other sources as the city or town clerk or engineer deems reliable, proof of such mailing to be made by the affidavit of the clerk or deputy clerk of said municipality, or by the engineer, said proof to be filed with the clerk, provided, that failure to mail said notice or notices shall not invalidate any of the proceedings hereunder. Notice of the time and place of such hearing shall also be given by two publications a week apart in a newspaper of general circulation in said municipality, and if there be no newspaper published in said municipality the governing authority of said municipality shall cause said notice to be published in like manner in a newspaper of general circulation published in the county in which said municipality is located; provided that the last publication shall be at least 1 week prior to the date of the hearing. Said notice shall describe the streets or other areas to be improved and advise all persons interested that the description of each property to be assessed and the amount to be assessed to each piece or parcel of property may be ascertained at the office of the clerk of the municipality. Such service by publication shall be verified by the affidavit of the publisher and filed with the clerk of said municipality. History.—s. 7, ch. 9298, 1923; CGL 3028; s. 4, ch. 59-396; s. 1, ch. 77-102; s. 5, ch. 87-103; s. 914, ch. 95-147; s. 1, ch. 98-52. 170.08 Final consideration of special assessments; equalizing board to hear complaints and adjust assessments; rebate of difference in cost and assessment. —At the time and place named in the notice provided for in s. 170.07, the governing authority of the municipality shall meet and hear testimony from affected property owners as to the propriety and advisability of making the improvements and funding them with special assessments on property. Following the testimony, the governing authority of the municipality shall make a final decision on whether to levy the special assessments. Thereafter, the governing authority shall meet as an equalizing board to hear and consider any and all complaints as to the special assessments and shall adjust and equalize the assessments on a basis of justice and right. When so equalized and approved by resolution or ordinance of the governing authority, a final assessment roll shall be filed with the governing authority of the municipality, and such assessments shall stand confirmed and remain legal, valid, and binding first liens upon the property against which such assessments are made until paid; however, upon completion of the improvement, the municipality shall credit to each of the assessments the difference in the assessment as originally made, approved, and confirmed and the proportionate part of the actual cost of the improvement to be paid by special assessments as finally determined upon the completion of the improvement, but in no event shall the final assessments exceed the amount of benefits originally assessed. Promptly after such confirmation, the assessments shall be recorded by the city clerk in a special book, to be known as the "Improvement Lien Book," and the record of the lien in this book shall constitute prima facie evidence of its validity. The governing authority of the municipality may by resolution grant a discount equal to all or a part of the payee's proportionate share of the cost of the project consisting of bond record for item(s) RE.7, on 04-13-2023, City Clerk www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0100-0199/0170/0170.html 4/8 4/5/23, 11:49 AM Statutes & Constitution :View Statutes : Online Sunshine financing costs, such as capitalized interest, funded reserves, and bond discount included in the estimated cost of the project, upon payment in full of any assessment during such period prior to the time such financing costs are incurred as may be specified by the governing authority. U a s O 170.09 Priority of lien; interest; and method of payment. —The special assessments shall be payable at the.E time and in the manner stipulated in the resolution providing for the improvement; shall remain liens, coequal with the lien of all state, county, district, and municipal taxes, superior in dignity to all other liens, titles, and claims, until paid; shall bear interest, at a rate not to exceed 8 percent per year, or, if bonds are issued pursuant to this chapter, at a rate not to exceed 1 percent above the rate of interest at which the improvement bonds authorized pursuant to this chapter and used for the improvement are sold, from the date of the acceptance of the improvement; and may, by the resolution aforesaid and only for capital outlay projects, be made payable in equal installments over a period not to exceed 30 years notwithstanding any special act to the contrary, to which, if not paid when due, there shall be added a penalty at the rate of 1 percent per month, until paid. However, the assessments may be paid without interest at any time within 30 days after the improvement is completed and a resolution accepting the same has been adopted by the governing authority. History.—s. 9, ch. 9298, 1923; CGL 3030; s. 6, ch. 59-396; s. 1, ch. 61-349; s. 4, ch. 67-552; s. 3, ch. 80-318; s. 74, ch. 81-259; s. 5, ch. 82-195; s. 2, ch. 82-198; s. 33, ch. 83-204; s. 29, ch. 99-378. 170.10 Legal proceedings instituted upon failure of property owner to pay special assessment or interest when due; foreclosure; service of process. —Each annual installment provided for in s. 170.09 shall be paid upon the dates specified in said resolution, with interest upon all deferred payments, until the entire amount of said assessment has been paid, and upon the failure of any property owner to pay any annual installment due, or any part thereof, or any annual interest upon deferred payments, the governing authority of the municipality shall cause to be brought the necessary legal proceedings by a bill in chancery to enforce payment thereof with all accrued interest and penalties, together with all legal costs incurred, including a reasonable solicitor's fee, to be assessed as part of the costs and in the event of default in the payment of any installment of an assessment, or any accrued interest on said assessment, the whole assessment, with the interest and penalties thereon, shall immediately become due and payable and subject to foreclosure. In the foreclosure of any special assessment service of process against unknown or nonresident defendants may be had by publication, as now provided by law in other chancery suits. The foreclosure proceedings shall be prosecuted to a sale and conveyance of the property involved in said proceedings as now provided by law in suits to foreclose mortgages; or, in the alternative, said proceeding may be instituted and prosecuted under chapter 173. History.—s. 10, ch. 9298, 1923; CGL 3031; s. 7, ch. 59-396. • E z 170.11 Bonds may be issued to an amount not exceeding the amount of liens assessed for the cost of improvements to be paid by special assessment. —After the equalization, approval and confirmation of the levying of the special assessments for improvements as provided by s. 170.08 and as soon as a contract for said improvement has been finally let, the governing authority of the municipality may by resolution or ordinance authorize the issuance of bonds, to be designated "Improvement bonds, series No. ," in an amount not in excess of the aggregate amount of said liens levied for such improvements. Said bonds shall be payable from a special and separate fund, to be known as the "Improvement fund, series No. ," which shall be used solely for the payment of the principal and interest of said "Improvement bonds, series No. " and for no other purpose. Said fund shall be deposited in a separate bank account; and all the proceeds collected by the city from the principal, interest, and penalties of said liens shall be deposited and held in said fund. Said bonds so issued shall never exceed the amount of liens assessed, and said bonds shall mature not later than 2 years after the maturity of the last installment of said liens. Said bonds shall bear certificates signed by the clerk of the municipality certifying that the amount of liens levied, the proceeds of which are pledged to the payment of said bonds, are equal to the amount of the bonds issued. Said bonds shall not be a general obligation of the city, but shall be payable solely out of said assessments, installments, interest, penalties, provided that said bonds may be secured by any other revenues that a may be legally available for such purpose. Any surplus remaining after payment of all bonds and interest thereon s shall revert to the city and be used for any municipal purpose. Bonds issued under this section may be refunded 0 from time to time as provided in this section. History.—s. 11, ch. 9298, 1923; CGL 3032; s. 8, ch. 59-396; s. 5, ch. 67-552; s. 1, ch. 78-330; s. 3, ch. 92-156; s. 915, ch. 95-147. 170.14 Governing authority of municipality required to make new assessments until valid assessment is made if special assessment is omitted or held invalid. —If any special assessment made under the provisions of N this chapter to defray the whole or any part of the expense of any said improvement shall be either in whole or in part annulled, vacated or set aside by the judgment of any court, or if the governing authority of any municipality shall be satisfied that any such assessment is so irregular or defective that the same cannot be enforced or collected, or if the governing authority of a municipality shall have omitted to make such assessment when it might have done so, the governing authority of the municipality shall take all necessary steps to cause a new assessment to be made for the whole or any part of any improvement or against any property benefited by any improvement, following as nearly as may be the provisions of this chapter and in case such second assessment shall be annulled, said governing authority of any municipality may obtain and make other assessments until a valid assessment shall be made. History.—s. 14, ch. 9298, 1923; CGL 3035; s. 11, ch. 59-396. 170.15 Expenditures for improvements. —The governing authority of any municipality may pay out of its general funds or out of any special fund that may be provided for that purpose such portion of the cost of any improvement as it may deem proper. History.—s. 15, ch. 9298, 1923; CGL 3036; s. 12, ch. 59-396. 170.16 Assessment roll sufficient evidence of assessment and other proceedings of this chapter; variance not material unless party objecting materially injured thereby. —Any informality or irregularity in the proceedings in connection with the levy of any special assessment under the provisions of this chapter shall not affect the validity of the special assessment where the assessment roll has been confirmed by the governing authority. The assessment roll as finally approved and confirmed shall be competent and sufficient evidence that the assessment was duly levied, that the assessment was duly made and adopted, and that all other proceedings adequate to the adoption of the assessment roll were duly had, taken, and performed as required by this chapter, and no variance from the directions hereunder shall be held material unless it be clearly shown that the party objecting was materially injured thereby. However, nothing in this section shall relieve the governing authority from notifying the affected property owners of the special assessments as required by this chapter. History.—s. 16, ch. 9298, 1923; CGL 3037; s. 7, ch. 87-103; s. 41, ch. 91-45. 170.17 Denomination of bonds; interest; place of payment; form; signatures; coupons; and delivery. —All bonds issued under this chapter shall be the denomination of $500, or some multiple thereof, and shall bear interest as provided in s. 215.84 until paid in full, payable annually or semiannually, and both principal and interest shall be payable at such place or places as the governing authority may determine. The form of such bonds shall be fixed by resolution of the governing authority of the municipality, and said bonds shall be signed by the mayor or chief executive officer of the municipality and the clerk or other like officers thereof, under the seal of the municipality; the coupons, if any, shall be executed by the facsimile signatures of said officers. The delivery of any bond and coupon so executed at any time thereafter shall be valid although before the date of delivery the person signing such bond or coupons shall cease to hold office. O s O c E z 170.19 Construction and authority of chapter. —This chapter shall, without reference to any other law of Florida, be full authority for the issuance and sale of the bonds by this chapter authorized, and shall be construed as an additional and alternative method for the financing of the improvements referred to herein. No ordinance, resolution, election or proceeding in respect of the issuance of any bonds hereunder shall be necessary, except such as is required by this chapter, and no publication of any resolution, ordinance, election, notice or proceeding relating to the issuance of the bonds provided for by this chapter shall be required, except such as required by this chapter. History.—s. 19, ch. 9298, 1923; CGL 3040; s. 14, ch. 59-396. 170.20 Bonds negotiable. —Bonds issued under s. 170.11 shall have all the qualities of negotiable paper under the law merchant, and shall not be invalid for any irregularity or defect in the proceedings for the issue and sale thereof, and shall be incontestable in the hands of bona fide purchasers or holders thereof for value. History.—s. 20, ch. 9298, 1923; CGL 3041; s. 15, ch. 59-396. 170.201 Special assessments.— (1) In addition to other lawful authority to levy and collect special assessments, the governing body of a municipality may levy and collect special assessments to fund capital improvements and municipal services, including, but not limited to, fire protection, emergency medical services, garbage disposal, sewer improvement, street improvement, and parking facilities. Without limiting the foregoing, a municipality that has a population of fewer than 100 persons for the previous year's taxing year may also levy and collect special assessments to fund special security and crime prevention services and facilities, including guard and gatehouse facilities for the current taxing year. However, if prior to the levy of the assessment, the cost of the services and facilities are funded by ad valorem taxes, the taxes shall be abated annually thereafter, in an amount equal to the full amount of the special assessment. The governing body of a municipality may apportion costs of such special assessments based on: (a) The front or square footage of each parcel of land; or (b) An alternative methodology, so long as the amount of the assessment for each parcel of land is not in excess of the proportional benefits as compared to other assessments on other parcels of land. (2) Property owned or occupied by a religious institution and used as a place of worship or education; by a public or private elementary, middle, or high school; or by a governmentally financed, insured, or subsidized housing facility that is used primarily for persons who are elderly or disabled shall be exempt from any special assessment levied by a municipality to fund any service if the municipality so desires. The proposed BID area upon which the special assessments shall be levied, subject to the approval of a majority of affected property owners, shall incorporate the total area set forth in the map attached and incorporated herein as Exhibit A-1 and shall reflect the geographic boundaries description as set forth in Exhibit A-2, both attached hereto and incorporated herein. Section 6. The special assessment shall be levied and collected for a ten (10) year period and another vote of the affected property owners would be required prior to the termination of such ten (10) year period to determine whether to continue or discontinue the special assessment or include additional properties in the district or change the boundaries of the district. Section 7. In accordance with Chapter 170, there is on file with the City Clerk at the time of the adoption of this Resolution, an assessment plat showing the area to be assessed, with plans and specifications, and an estimate of the cost of the proposed improvement, the details of the proposed programs, services, and projects, and a cost estimate as indicated in the Business Plan and Budget attached hereto as composite Exhibit B, which shall be open to inspection by the public. Section 8 In accordance with Chapter 170, there is on file with the City Clerk at the time of the adoption of this Resolution, a Preliminary Assessment Roll showing the lots to be assessed, the amounts of benefits to the properties to be assessed, and the assessments against each lot, which shall be considered at a future duly advertised Public Hearing to be held by the City Commission following the approval of a majority of affected property owners, at a time and place to be set in a separate Resolution, at which time the City Commission shall hear as an equalizing board all parties in regard to the proposed assessment, and after making any adjustments that the City Commission may deem appropriate, the Final Assessment Roll will be confirmed by a Resolution of the City Commission. Section 9. This Resolution herein creating a special assessment district shall be advertised following its adoption. Section 10. Introduction Business Improvement Districts (BIDs) are an effective vehicle to cooperatively finance and maintain new levels of services and improvements that local government alone cannot accomplish. All revenues from the Wynwood Business Improvement District assessment will be directed back to the defined geographic area to finance a supplemental menu of enhanced services including security, sanitation, support of the arts, events, marketing, transportation, and advocacy with the municipal government on such district -specific matters as planning and zoning, capital improvements, and business development. Relationship with Wynwood Partner 501 (c ) 3 Organization By agreement of its Boards of Directors, the Wynwood Business Improvement District (BID) will work hand -in -hand with the Wynwood Arts District Association (WADA), an independent 501 (c)(3) organization,. This will benefit the Wynwood BID in two specific ways: 1. WADA would be able to submit grant proposals to government and foundations as well as to solicit tax deductible donations for proposed projects of the BID 2. As the precedent district arts association, WADA can provide expertise, skills, and services aimed at marketing Wynwood. Note however these services may have to be procured on a competitive basis through a recognized procurement process agreed to by the City of Miami. The procurement process would then be executed by members of the Wynwood BID Board or their designated Selection Committee. It is projected that this relationship between the BID and WADA will be synergistic and productive, and that it will strongly benefit both organizations and the Wynwood district as a whole. Advocacy Efforts The Wynwood BID will speak to the City and the County with a single unified voice. This partnership will seek a positive, productive and forward -looking relationship in all government related subjects, including but not limited to, baseline of services, infrastructure, zoning and land use regulation. 1. The Wynwood BID will make the case for the City of Miami to place 12 trash receptacles along 2nd Ave and to collect garbage from them daily. As well, the Wynwood BID will Submitted into the public record for item(s) RE.7, on 04-13-2023, City Clerk purchase and place 24 trashcans, which the Wynwood BID will install on cross streets and along North Miami Ave. This will be contingent upon the City's agreement to collect the trash from the receptacles daily. 2. The Wynwood BID will partner with the City departments to ensure that basic City services are provided in a timely and effective manner as delineated in the Baseline of Services. This will include, among other items, such standard City services as mechanical truck sweeping, hand sweeping of sidewalks and gutters, and "graffiti busters", and police coverage. 3. On a routine basis, the Wynwood BID will provide to the City Public Works Dept. photos and addresses of damaged sidewalks in need of repair. 4. The Wynwood BID will work with the City Capital Improvements Dept. to facilitate the next generation of sidewalks to enhance pedestrian viability. 5. The Wynwood BID will work with the City of Miami to explore programs and initiatives to enhance the streetscape of the neighborhood, including but not limited to, tree and benches. 6. The Wynwood BID will advocate for the purchase and installation of human scale street lamps in Wynwood—the City does it for other commercial communities. The tall cobra lamps currently in place in Wynwood were originally designed for highway usage, and may have been serviceable for a warehouse district. They are absolutely the wrong lighting for a pedestrian district. 7. Approximately half of the City`maintained streetlights in the District do not currently have working bulbs, which has worsened some of the recent security/safety problems seen in the District. The Wynwood BID will monitor the street lamps, which are "out" on the streets and will report these outages to the appropriate departments —whether they are City, FPL, or County offices for proper replacement of bulbs. How the Wynwood BID will Improve the District In speaking with one voice, the Wynwood BID will more effectively communicate with the City of Miami and, as needed, with the County. Due in part to the high rate of change in leadership within almost all City departments, it is difficult for the City of Miami to have a clear sense of the direction in which Wynwood is heading. There has not been time at the City to thoroughly re -assess Wynwood. In terms of City services, it is still generally seen as a warehouse district. Over the past 5-7 years Wynwood has seen an explosion of new business. What were once underutilized warehouse buildings have been repopulated with creative office and retail businesses. There are thousands of new daily inhabitants of the District and tens of thousands of visitors who descend on Wynwood on a monthly basis. A BID will help improve this by establishing a Baseline of Services to provide within the City Budget as well as advocating new or expanded services, which are more consistent with changes in the neighborhood. The Wynwood Business Improvement District will also undertake enhancements, improvements, and benefits for the community of Wynwood that the City of Miami has neither the financial resources not the will to undertake on our behalf, including: Security The BID will supplement security services and re -define pedestrian and bicycle -based protection. City police services by car are becoming decreasingly appropriate in Wynwood's emerging pedestrian district. Currently, officers do not walk or bike on patrol in the district. A Wynwood BID will supplement City -provided services so that our walking areas will not only be perceived as safer, but will in fact be safer. A positive safety perception will enhance the duration and enjoyment of visits to Wynwood, and provide for a safer place to live and work. Sanitation The Wynwood BID will extensively supplement sanitation services in the District. Wynwood needs a strong and experienced sanitation team. Streets and sidewalks in Wynwood are dirty and largely unaddressed by the City. Some portions of the sidewalks are in desperate need of repair. The Wynwood BID will further advocate for the City to provide twelve trash receptacles for NW 2nd Avenue, and request that the City collect the trash on a daily basis from this commercial area just as it does in otherareas of the City. In exchange for an agreement with the City that trash will be collected daily, the BID will purchase and put in place an additional 24 trash receptacles in its first year. Lighting In order to improve sidewalk visibility at night while helping to illuminate the vibrant art that defines the Wynwood community, The Wynwood BID will initiate a program which will raise funds for increased lighting to be placed on the sides of Wynwood's buildings. Grant possibilities will be explored at the Federal level to determine the possibility of using solar energy for this purpose. The BID will partially fund the property owner's costs of installing down lighting on the sides of their buildings. Additionally, somewhere between 30-50% of the cobra street lamps in Wynwood are currently not functioning. Under the current plan, street lamps are not repaired until they are reported to the correct office. The Wynwood BID staff will work to create a more efficient and continuous reporting program to minimize the number of street lamps in disrepair. Parking should focus on convenience and service to customers and the generated revenue should, as allowed by State statute, provide for improvements to the Wynwood district. Planning and Zoning Through either an SAP initiative or a coordinated legislative effort, the Wynwood BID will invest funds into an effort to correct those oversights in the Miami 21 code which stunt and slow reasonable density development in the Wynwood district. Signage In concert with WADA, the Wynwood BID will develop, install, and maintain "Wynwood Styled" signage that clearly defines the art district's boundaries. The BID will also work to develop and install pedestrian signage that directs pedestrians to Wynwood attractions and enables visitors to navigate the district. Events In discussion with the galleries and commercial businesses in the District, The Wynwood BID will partner with WADA and use funds to host, develop, and nurture new events that will both appeal to residents and draw visitors to the area. It will further support street enlivening activities in an attempt to reinvigorate the pedestrian shopping and dining atmosphere. Arts The Wynwood BID will act as a resource for preserving, documenting and helping to evolve the lively outdoor murals, which have helped to make Wynwood into a world- renowned arts destination. The BID will also foster cooperation between the District's respected galleries as well as between gallerists and artists, At the heart of this effort in teiiiis of coordination and leadership will be the establishment of an Art Curator as a BID paid staff member, the first such position within a US BID. The goal is to help make the District into a 24-hour, free to the public, outdoor living museum, both accessible and inspiring to all. Activities Through partnership with WADA, a dedicated 501(c)3 organization partner, the Wynwood BID will seek to secure the private sector and foundation grants deemed appropriate for expanded placemaking activities. Submitted into the public record for item(s) RE.7, on 04-13-2023, City Clerk Wynwood's BID: The Fine Print • The Wynwood BID will be established by a resolution of the City Commission of the City of Miami on April 11`h, 2013, and will be brought into existence by a 50% plus one vote of affected property owners on June 4, 2013. • The Wynwood BID will be a dependent organization established as a Board of the City of Miami, and will be subject to the Sunshine Laws of the State of Florida, as well as the same procurement procedures that govern the activities of the Coconut Grove BID, a board of the City. • The annual Wynwood BID budget will be submitted for approval in a timely manner to the City Commission of the City of Miami. • The Wynwood BID will conduct an annual audit and will provide it to the City of Miami in a timely fashion. • The Wynwood BID will work in partnership with WADA-- a 501(c) 3 organization-- for purposes of procuring grants from the public and private sector that support placemaking in the commercial Wynwood neighborhood. • The Wynwood BID will have a Sunset Provision of 10 years. At that time, in order for the BID to continue, there must be another vote held among affected property owners. This vote must result in a minimum of 50% plus one in order to continue the BID. • If at any point in the first ten years, there is a desire to increase the number of folios included in the Wynwood BID, there must be a vote by all the affected property owners (not just the new folio owners). If the vote is successful at a level of 50% plus one, the BID will be expanded. However if the vote does not succeed, the only result will be that the expanded BID will not come into existence. In the event of a non -successful vote to expand the Wynwood BID, the original BID will not be dissolved; it will remain in place and in effect for the duration of its ten-year teen. • In each year of its existence, the BID will undertake a Baseline of Services review in cooperation with the City Manager of the City of Miami. In this way, the BID will monitor City provided services and ensure that these services are not being reduced as'a result of the supplemental services being provided by the BID. During the first two years of its existence, the BID will conduct a baseline of services analysis every six months to give the City the opportunity to re-evaluate Wynwood as an evolving pedestrian district that merits, therefore, appropriately enhanced City services. • The Wynwood BID Project —and WADA as the funding conduit for the BID formation effort-- will sign a Memorandum of Understanding with the City Clerk's Office of the Submitted into the public record for item(s) RE.7, on 04-13-2023, City Clerk City of Miami so that the proper notices, advertisements, affidavits and services can be provided which guarantee the integrity of the BID election. BID Governance • In the two months after the June 4th in -person election date, property owners in the Wynwood BID will have the right to nominate himself or herself or another property owner to sit on the Wynwood BID Board. All nominations will be submitted to the affected property owners of Wynwood for a vote, with one vote per property owner regardless of the number of folios owned. • There will be five voting members of the Wynwood BID Board. The top five vote getters will be seated as members of the BID Board on October 1, 2013. The terms will be staggered. In the first year elected voting members of the Wynwood BID Board, by blind draw at the first meeting, terms of the five members will be determined as: Director A, a term of one year, Director B, a term of one year, Director C, a term of two years, Director D, a term of two years, Director E, a term of two years. • All subsequent terms will be two years. • A director may serve a maximum of three two-year terms in the first ten years of the BID. Directors A and B in the above first -year terms may, if elected, serve a maximum of seven years in the first ten year period of the BID. New elections will be held in the month of September each year. • The Board will establish such committees as it deems necessary, and will determine the qualifications of those who sit on the committees. • The Board will have the power and responsibility to write By-laws. • All Board members must be paid up and current in terms of the BID assessments on their properties. • The BID Board will strictly observe the requirements and guidelines of the Sunshine laws. • The BID Board will have fiduciary responsibility for the Wynwood BID. • The BID Board will comply with the City of Miami's procurement guidelines. • All BID Board meetings will be publicly noticed. The Wynwood BID shall assess work -live space (defined as space that dedicated 50% or more of the floor space to work area). Based on the use classification above, assessment methodology will include four categories of assessment: (1) square footage of first floor adjusted footage will be assessed at 22 cents per square foot; (2) upper stories of adjusted square footage will be assessed at 11 cents per square foot; (3) any ground floor additional square footage of land that is not occupied by a building will be assessed at 11 cents per square foot; and (4) any vacant square footage of property or vacant area used for parking will be assessed at 11 cents per square foot. To ensure an educated vote, the assessment methodology, amount of assessment, and BID objectives will be provided to each folio owner prior to such vote. In any given year, and in ensuing years, the Board of Directors of the Wynwood BID will have the authority to increase the assessment over the previous year's rate by (a) one cent for the first floor adjusted footage and (b) by one half -cent for upper stories, additional land that is not built upon on ground floor, and vacant land. The Board of Directors must make this decision in a time -sensitive manner prior to the submission of the assessment level for the County Trim Notice. In any given year, the Board of Directors, at their discretion, may alternatively choose to not assess the additional rate for the following year. During the first year of operations, the Wynwood BID will collect the assessments by sending out invoices and tracking incoming payments/checks upon arrival. In the event of unpaid assessments in the first year, the Wynwood BID will cooperate with the City Manager of the City of Miami to establish liens on the delinquent properties. Beginning with the second year of assessment collections, the Wynwood BID will submit the necessary information to Miami -Dade County so that the collections can be included on the Trim Notice as a non ad valorem assessment. The County will then convey the funds to the City, which will periodically convey the funds to the Wynwood BID. The Coconut Grove BID has never had to pay a fee to either the County or the City for collection activity. In order for this relationship to function, the City of Miami will sign an intergovernmental agreement on behalf of the Wynwood BID with the County. During the ten-year tenure of the Wynwood BID, those properties that are subsequently developed will be assessed at the rates that were approved by the original vote on May 21, 2013, with the addition of any incremental increases that have been enacted by the Board of Directors in compliance with the initial conditions of the Wynwood BID vote. Introduction Business Improvement Districts (BIDs) are an effective vehicle to cooperatively finance and maintain new levels of services and improvements that local government alone cannot accomplish. All revenues from the Wynwood Business Improvement District assessment will be directed back to the defined geographic area to finance a supplemental menu of enhanced • services including security, sanitation, support of the arts, events, marketing, transportation, and advocacy with the municipal government on such district -specific matters as planning and zoning, capital improvements, and business development. Relationship with Wvnwood Partner 501 (c ) 3 Organization By agreement of its Boards of Directors, the Wynwood Business Improvement District (BID) will work hand -in -hand with the Wynwood Arts District Association (WADA), an independent 501 (c)(3) organization,. This will benefit the Wynwood BID in two specific ways: 1. WADA would be able to submit grant proposals to government and foundations as well as to solicit tax deductible donations for proposed projects of the BID 2. As the precedent district arts association, WADA can provide expertise, skills, and services aimed at marketing Wynwood. Note however these services may have to be procured on a competitive basis through a recognized procurement process agreed to by the City of Miami. The procurement process would then be executed by members of the Wynwood BID Board or their designated Selection Committee. It is projected that this relationship between the BID and WADA will be synergistic and productive, and that it will strongly benefit both organizations and the Wynwood district as a whole. Advocacy Efforts The Wynwood BID will speak to the City and the County with a single unified voice. This partnership will seek a positive, productive and forward -looking relationship in all government related subjects, including but not limited to, baseline of services, infrastructure, zoning and land use regulation. 1. The Wynwood BID will make the case for the City of Miami to place 12 trash receptacles along 2nd Ave and to collect garbage from them daily. As well, the Wynwood BID will Submitted into the public record for item(s) RE.7, on 04-13-2023, City Clerk purchase and place 24 trashcans, which the Wynwood BID will install on cross streets and along North Miami Ave. This will be contingent upon the City's agreement to collect the trash from the receptacles daily. 2. The Wynwood BID will partner with the City departments to ensure that basic City services are provided in a timely and effective manner as delineated in the Baseline of Services. This will include, among other items, such standard City services as mechanical truck sweeping, hand sweeping of sidewalks and gutters, and "graffiti busters", and police coverage. 3. On a routine basis, the Wynwood BID will provide to the City Public Works Dept. photos and addresses of damaged sidewalks in need of repair. 4, The Wynwood BID will work with the City Capital Improvements Dept. to facilitate the next generation of sidewalks to enhance pedestrian viability. 5. The Wynwood BID will work with the City of Miami to explore programs and initiatives to enhance the streetscape of the neighborhood, including but not limited to, tree and benches. 6. The Wynwood BID will advocate for the purchase and installation of human scale street lamps in Wynwood—the City does it for other commercial communities. The tall cobra lamps currently in place in Wynwood were originally designed for highway usage, and may have been serviceable for a warehouse district. They are absolutely the wrong lighting for a pedestrian district. 7. Approximately half of the City`maintained streetlights in the District do not currently have working bulbs, which has worsened some of the recent security/safety problems seen in the District: , The Wynwood BID will monitor the street lamps, which are "out" on the streets and will report these outages to the appropriate departments —whether they are City, FPL, or County offices for proper replacement of bulbs. How the Wynwood BID will Improve the District In speaking with one voice, the Wynwood BID will more effectively communicate with the City of Miami and, as needed, with the County. Due in part to the high rate of change in leadership within almost all City departments, it is difficult for the City of Miami to have a clear sense of the direction in which Wynwood is heading. There has not been time at the City to thoroughly re -assess Wynwood. In terms of City services, it is still generally seen as a warehouse district. Over the past 5-7 years Wynwood has seen an explosion of new business. What were once underutilized warehouse buildings have been repopulated with creative office and retail businesses. There are thousands of new daily inhabitants of the District and tens of thousands of visitors who descend on Wynwood on a monthly basis. A BID will help improve this by establishing a Baseline of Services to provide within the City Budget as well as advocating new or expanded services, which are more consistent with changes in the neighborhood. The Wynwood Business Improvement District will also undertake enhancements, improvements, and benefits for the community of Wynwood that the City of Miami has neither the financial resources not the will to undertake on our behalf, including: Security The BID will supplement security services and re -define pedestrian and bicycle -based protection. City police services by car are becoming decreasingly appropriate in Wynwood's emerging pedestrian district. Currently, officers do not walk or bike on patrol in the district. A Wynwood BID will supplement City -provided services so that our walking areas will not only be perceived as safer, but will in fact be safer. A positive safety perception will enhance the duration and enjoyment of visits to Wynwood, and provide for a safer place to live and work. Sanitation The Wynwood BID will extensively supplement sanitation services in the District. Wynwood needs a strong and experienced sanitation team. Streets and sidewalks in Wynwood are dirty and largely unaddressed by the City. Some portions of the sidewalks are in desperate need of repair. The Wynwood BID will further advocate for the City to provide twelve trash receptacles for NW 2"d Avenue, and request that the City collect the trash on a daily basis from this commercial area just as it does in other areas of the City. In exchange for an agreement with the City that trash will be collected daily, the BID will purchase and put in place an additional 24 trash receptacles in its first year. Lighting In order to improve sidewalk visibility at night while helping to illuminate the vibrant art that°defines the Wynwood community, The Wynwood BID will initiate a program which will raise funds for increased lighting to be placed on the sides of Wynwood's buildings. Grant possibilities will be explored at the Federal level to determine the possibility of using solar energy for this purpose. The BID will partially fund the property owner's costs of installing down lighting on the sides of their buildings. Additionally, somewhere between 30-50% of the cobra street lamps in Wynwood are currently not functioning. Under the current plan, street lamps are not repaired until they are reported to the correct office. The Wynwood BID staff will work to create a more efficient and continuous reporting program to minimize the number of street lamps in disrepair. Parking should focus on convenience and service to customers and the generated revenue should, as allowed by State statute, provide for improvements to the Wynwood district. Planning and Zoning Through either an SAP initiative or a coordinated legislative effort, the Wynwood BID will invest funds into an effort to correct those oversights in the Miami 21 code which stunt and slow reasonable density development in the Wynwood district. Signage In concert with WADA, the Wynwood BID will develop, install, and maintain "Wynwood Styled" signage that clearly defines the art district's boundaries. The BID will also work to develop and install pedestrian signage that directs pedestrians to Wynwood attractions and enables visitors to navigate the district. Events In discussion with the galleries and commercial businesses in the District, The Wynwood BID will partner with WADA and use funds to host, develop, and nurture new events that will both appeal to residents and draw visitors to the area. It will further support street enlivening activities in an attempt to reinvigorate the pedestrian shopping and dining atmosphere. Arts The Wynwood BID will act as a resource for preserving, documenting and helping to evolve the lively outdoor murals, which have helped to make Wynwood into a world- renowned arts destination, The BID will also foster cooperation between the District's respected galleries as well as between gallerists and artists. At the heart of this effort in ten -is of coordination and leadership will be the establishment of an Art Curator as a BID paid staff member, the first such position within a US BID. The goal is to help make the District into a 24-hour, free to the public, outdoor living museum, both accessible and inspiring to all. Activities Through partnership with WADA, a dedicated 501(c)3 organization partner, the Wynwood BID will seek to secure the private sector and foundation grants deemed appropriate for expanded placemaking activities. Submitted into the public record for item(s) RE.7, on 04-13-2023, City Clerk Wvnwood's BID: The Fine Print. • The Wynwood BID will be established by a resolution of the City Commission of the City of Miami on April 11 th, 2013, and will be brought into existence by a 50% plus one vote of affected property owners on June 4, 2013. • The Wynwood BID will be a dependent organization established as a Board of the City of Miami, and will be subject to the Sunshine Laws of the State of Florida, as well as the same procurement procedures that govern the activities of the Coconut Grove BID, a board of the City. • The annual Wynwood BID budget will be submitted for approval in a timely manner to the City Commission of the City of Miami. • The Wynwood BID will conduct an annual audit and will provide it to the City of Miami in a timely fashion. • The Wynwood BID will work in partnership with WADA-- a 501(c) 3 organization-- for purposes of procuring grants from the public and private sector that support placemaking in the commercial Wynwood neighborhood. • The Wynwood BID will have a Sunset Provision of 10 years. At that time, in order for the BID to continue, there must be another vote held among affected property owners. This vote must result in a minimum of 50% plus one in order to continue the BID. • If at any point in the first ten years, there is a desire to increase the number of folios included in the Wynwood BID, there must be a vote by all the affected property owners (not just the new folio owners). If the vote is successful at a level of 50% plus one, the BID will be expanded. However if the vote does not succeed, the only result will be that the expanded BID will not come into existence. In the event of a non -successful vote to expand the Wynwood BID, the original BID will not be dissolved; it will remain in place and in effect for the duration of its ten-year term. • In each year of its existence, the BID will undertake a Baseline of Services review in cooperation with the City Manager of the City of Miami. in this way, the BID will monitor City provided services and ensure that these services are not being reduced as'a result of the supplemental services being provided by the BID. During the first two years of its existence, the BID will conduct a baseline of services analysis every six months to give the City the opportunity to re-evaluate Wynwood as an evolving pedestrian district that merits, therefore, appropriately enhanced City services. • The Wynwood BID Project —and WADA as the funding conduit for the BID formation effort-- will sign a Memorandum of Understanding with the City Clerk's Office of the Submitted into the public record for item(s) RE.7, on 04-13-2023, City Clerk City of Miami so that the proper notices, advertisements, affidavits and services can be provided which guarantee the integrity of the BID election. BID Governance • In the two months after the June 4th in -person election date, property owners in the Wynwood BID will have the right to nominate himself or herself or another property owner to sit on the Wynwood BID Board. All nominations will be submitted to the affected property owners of Wynwood for a vote, with one vote per property owner regardless of the number of folios owned. • There will be five voting members of the Wynwood BID Board. The top five vote getters will be seated as members of the BID Board on October 1, 2013. The terms will be staggered. In the first year elected voting members of the Wynwood BID Board, by blind draw at the first meeting, terms of the five members will be determined as: Director A, a term of one year, Director B, a term of one year, Director C, a tern of two years, Director D, a tern of two years, Director E, a term of two years. • All subsequent terms will be two years. • A director may serve a maximum of three two-year terns in the first ten years of the BID. Directors A and B in the above first -year terms may, if elected, serve a maximum of seven years in the first ten year period of the BID. New elections will be held in the month of September each year. • The Board will establish such committees as it deems necessary, and will determine the qualifications of those who sit on the committees. • The Board will have the power and responsibility to write By-laws. • All Board members must be paid up and current in terms of the BID assessments on their properties. • The BID Board will strictly observe the requirements and guidelines of the Sunshine laws. • The BID Board will have fiduciary responsibility for the Wynwood BID. • The BID Board will comply with the City of Miami's procurement guidelines. • All BID Board meetings will be publicly noticed. Submitted into the public record for item(s) RE.7, on 04-13-2023, City Clerk Assessment Methodology The Wynwood BID will not assess self -standing residential homes; neither will it assess live - work folios) defined as 50% or more floor space dedicated to living space). The Wynwood BID shall assess work -live space (defined as space that dedicated 50% or more of the floor space to work area). Based on the use classification above, assessment methodology will include four categories of assessment: (1) square footage of first floor adjusted footage will be assessed at 22 cents per square foot; (2) upper stories of adjusted square footage will be assessed at 11 cents per square foot; (3) any ground floor additional square footage of land that is not occupied by a building will be assessed at 11 cents per square foot; and (4) any vacant square footage of property or vacant area used for parking will be assessed at 11 cents per square foot. To ensure an educated vote, the assessment methodology, amount of assessment, and BID objectives will be provided to each folio owner prior to such vote. In any, given year, and in ensuing years, the Board of Directors of the Wynwood BID will have the authority to increase the assessment over the previous year's rate by (a) one cent for the first floor adjusted footage and (b) by one half -cent for upper stories, additional land that is not built upon on ground floor, and vacant land. The Board of Directors must make this decision in a time -sensitive manner prior to the submission of the assessment level for the County Trim Notice. In any given year, the Board of Directors, at their discretion, may alternatively choose to not assess the additional rate for the following year. During the first year of operations, the Wynwood BID will collect the assessments by sending out invoices and tracking incoming payments/checks upon arrival. In the event of unpaid assessments in the first year, the Wynwood BID will cooperate with the City Manager of the City of Miami to establish liens on the delinquent properties. Beginning with the second year of assessment collections, the Wynwood BID will submit the necessary information to Miami -Dade County so that the collections can be included on the Trim Notice as a non ad valorem assessment. The County will then convey the funds to the City, which will periodically convey the funds to the Wynwood BID. The Coconut Grove BID has never had to pay a fee to either the County or the City for collection activity. In order for this relationship to function, the City of Miami will sign an intergovernmental agreement on behalf of the Wynwood BID with the County. During the ten-year tenure. of the Wynwood BID, those properties that are subsequently developed will be assessed at the rates that were approved by the original vote on May 21, 2013, with the addition of any incremental increases that have been enacted by the Board of Directors in compliance with the initial conditions of the Wynwood BID vote. BUSINESS IMPROVEMENT DISTRICT BIDs are economic development organizations that deliver public services to specific neighborhoods to supplement the bundle of public services provided by the government. They are formed with the active participation of property owners within a defined geographic area. For the past ten years, property owners and businesses have transformed Wynwood into a viable pedestrian walking district. It has converged art, fashion and technology to create a hub that is recognized on a global scale. Developers, artists and community members have worked together to create the Wynwood of today. Now it's time to form a more cohesive vision to create the Wynwood of tomorrow, together with the economic resources to make that vision a reality. That vision starts with the establishment of a Business Improvement District (BID). Economist magazine describes BIDs as potentially "the best hope for getting parts of America's cash -strapped cities working again." In a time when municipal governments, like the City of Miami, are confronting complex problems with insufficient finances, BIDs give power to property owners to identify a district's needs and actively address those needs with a pool of financial resources. More than 1,200 BIDs now exist in North America — serving cities small, medium and large. Locally, Coconut Grove and Coral Gables have formed and implemented successful BIDs. For Wynwood, this means fixing some of the pressing issues that have hindered its progress, including security, sanitation and lighting. The BID, representing a 47-block area, will provide a unified force to advocate on behalf of the neighborhood to help Wynwood reach its full potential. A potential that research has shown will positively affect property owners, residents and community members. BIDs HAVE A SIGNIFICANT IMPACT ON COMMERCIAL PROPERTY VALUES In a New York City study, the value of commercial property within a BID increased by about 15 percentage points more on average than comparable properties in the same neighborhood but outside the BID's boundaries. This will include such standard services as mechanical truck sweeping, hand sweeping of sidewalks and gutters, "graffiti busters", and police coverage. • On a routine basis, the Wynwood BID will provide to the City Public Works Deptartment photos and addresses of damaged sidewalks in need of repair. • The Wynwood BID will work with the City Capital Improvements Department to implement the next generation of sidewalks to increase Wynwood's walkability. • The Wynwood BID will work with the City of Miami to explore programs and initiatives to enhance the landscaping of the District to get beyond the "bare concrete look" of the area. • The Wynwood BID will advocate for the purchase and installation of human scale street lamps in Wynwood — the City currently does it for other commercial districts. The tall cobra lamps currently in place in Wynwood were originally designed for highway usage, and may have been serviceable for a warehouse district. They are absolutely the wrong lighting for a pedestrian district. • The Wynwood BID will monitor the street lamps which are not working and report outages to the appropriate departments — City, FPL, or County — for proper replacement of bulbs. • The BID will advocate for transportation solutions, including bike lanes, bike racks, car sharing, transit stops, and more visible signage. The City has not thoroughly reassessed the area so it is still seen as a warehouse district in relation to City services provided. These limited services no longer make sense for this thriving neighborhood. The BID will resolve issues by effectively communicating as a single voice on behalf of Wynwood to the City and Miami -Dade County. The BID will also undertake enhancements and improvements that the City cannot dedicate time, money and effort to, including: SECURITY The district is becoming increasingly more pedestrian, with a growing need for more bicycle and walking -based protection. The Wynwood BID will supplement City provided services so that the district will be safer, which will encourage business growth and increase the number of visitors to the area. BIDs CAN REDUCE CRIME The incidence of violent crimes between 1994 and 2005 and the implementation of 30 BIDs in Los Angeles neighborhoods was analyzed. The findings: implementation of a BID was associated with a 12% reduction in the incidence of robbery and an 8% reduction in the total incidence of violent crimes. Wynwood needs a strong and experienced sanitation team. Streets and sidewalks in Wynwood are dirty and largely unaddressed by the City. Some portions of the sidewalks are in desperate need of repair. Pressure cleaning will also be a priority for the district. The Wynwood BID will further request that the City provide 12 trash receptacles for NW 2 Avenue, and request that the City collect the trash on a daily basis from this commercial area just as it does in other areas of the City. In exchange for an agreement with the City that trash will be collected daily, the BID will purchase and put in place an additional 24 trash receptacles in its first year. ONE MAN'S TRASH IS ANOTHER MAN'S TREASURE In Wynwood, trash cans won't be just functional. They can be a canvas for creativity. This will further expand Wynwood's reach as a 24-hour-per-day living, outdoor musuem. Grant possibilities will be explored at the federal level to determine the possibility of using solar energy for this purpose. The BID will partially fund the property owner's costs of installing down lighting on the sides of their buildings. Additionally, between 30-50% of the cobra street lamps in Wynwood are currently not functioning. Under the current plan, street lamps are not repaired until they are reported to the correct office. The Wynwood BID staff will work to create a more efficient and continuous reporting program to minimize the number of street lamps in disrepair. • Improved lighting deters potential offenders by increasing the risk that they will be seen or recognized when committing crimes. • Improved lighting can encourage more people to walk at night, which would increase informal surveillance. The BID will also • work to develop and install pedestrian signage that directs people to Wynwood attractions and • enables visitors to navigate the district. • • EVENTS • In discussion with the galleries and commercial businesses in the district, The BID will partner with • the Wynwood Arts District Association and use funds to host, develop, and nurture new events that • will both appeal to residents and draw visitors to the area. All nominations will be submitted to the affected property owners of Wynwood for a vote, with one vote per property ownership entity regardless of the number of folios owned. • The Wynwood BID and the Wynwood Arts District Association, as the funding conduit for the BID formation effort, will sign a Memorandum of Understanding with the City of Miami's City Clerk's office so the proper notices, advertisements, affidavits and services can be provided to guarantee the. integrity of the BID election. • There will be five voting members of the Wynwood BID Board. The top five vote getters will be seated as members of the BID Board on October 1, 2013. The terms will be staggered. In the first year of the BID Board's existence, the staggered term lengths of the directors will be determined by a blind draw conducted at the first Board meeting. The terms of the five directors will be: Director A, a term of one year; Director B, a term of one year; Director C, a term of two years; Director D, a term of two years; Director E, a term of two years. • All subsequent terms will be two years. • A director may serve a maximum of three two-year terms in the first ten years of the BID. Directors A and B in the above first -year terms may, if elected, serve a maximum of seven years in the first ten year period of the BID. New elections will be held in the month of September each year. • The Board will establish such committees as it deems necessary, and will determine the qualifications of those who sit on the committees. • The Board will have the power and responsibility to write bylaws. • All Board members must be paid up and current in terms of the BID assessments on their properties. • The BID Board will strictly observe the requirements and guidelines of the Sunshine Laws. • The BID Board will have fiduciary responsibility for the Wynwood BID. • The BID Board will comply with the City of Miami's procurement guidelines. • All BID Board meetings will be publicly noticed. Hannon City of Miami Police Department The City of Miami Police Department deploys police in the Wynwood BID area as part of a much larger geographical area consisting of 192 city blocks —roughly four times as big as the projected Wynwood BID area, running from 1-95 east to the waterfront in Edgewater, from NW 36 Street to NW 20 Street. The information provided below by the police is for its larger police coverage area, not for the BID area. The strategy divides the much larger 192-block area described above (which includes the Wynwood BID) into five zones. These zones are "fluid" so that officers can easily move from one zone to another in response to ongoing criminal activity. The police strategy is to respond quickly and effectively to crimes in progress. Instead of saying that Wynwood has a specific police "presence" at any specific hour, they say that the Wynwood BID area has 24-hour police "coverage," in which police can respond to crimes as they occur in the BID area. Number of Patrol Officers Assigned to the Larger Area The MPD says that there are "four or five patrol officers" assigned to the larger area both day and night. Number of Beat Officers Assigned to the Larger Area According to the MPD, a "beat officer" is always deployed with a police vehicle, but in a traditional sense (as is the case in other commercial communities in Miami) the MPD often assigns beat officers to "walk a specific beat" or "bike a patrol route." The police indicate that there are three beat officers in the larger area. One is located in a vehicle on North Bayshore Drive — outside the BID area. Additionally, there is one patrolling full-time on NW 5 Avenue — also outside the BID area. The third beat officer is assigned to the five -zone area and spends a significant amount of time in the larger Wynwood area (this includes both Midtown Miami and the large residential area north from NW 29 Street to NW 36 Street).The MPD has stated that these officers "can [utilize] a bike [when patrolling]," but they also need to have immediate access to their police vehicle so that they can respond to crimes in other zones. Number of Neighborhood Resource Officers There are two Neighborhood Resource Officers (NRO) located in the five zone, 192 block area. They each work a total of 40 hours, or four ten-hour days per week. They are assigned to the larger area, not specifically to the BID area so it is not possible to determine how much time they physically spend in the Wynwood BID area from week to week. These two NRO officers are sometimes pressed into "patrol officer" duty by responding to crimes in progress. Summary of Police Activity Due to the constant movement in responding to crimes throughout the larger area, the police presence in Wynwood is understaffed and stretched thin. Graffiti Busters On a weekly basis, the graffiti busters work in the geographic Wynwood BID area 20 hours per week undertaking several roles to remove unwanted graffiti tags. When provided with the correct color paint by the property owner or tenant occupier and with permission, they also over -paint unwanted tags on the sides of buildings. For Wynwood events, they coordinate with the police and Code Enforcement to assist with the apprehension of nuisance taggers. The graffiti busters also remove thousands of stickers pasted up in Wynwood. Second Saturday Wynwood Art Walk On a monthly basis, The NET office provides substantial assistance to the Wynwood Art Walk. In the time leading up to the Second Saturday event, the area NET Administrator spends 8-12 hours each month coordinating with various City departments (including the MPD and Solid Waste Department) that play supporting roles in the event's success. Additionally, the NET Administrator works with the NET office in Allapattah to divert NET vehicles, equipment, and NSWs to assist Wynwood with clean-up for the evening. Art Basel Support On an annual basis, in the months of November and December, the NET office spends about 100 hours preparing for Art Basel. In the week after Art Basel, the NET office spends 50 hours cleaning the streets of Wynwood and removing illegal signs from the neighborhood.
