Accept - Seven (7) Right -of -Way Deeds
Purpose of Item:
A Resolution authorizing the City Manager to accept seven (7) Right -of -Way Deeds of
dedication and an Amended and Restated Right -of -Way Deed subject to Subterranean
Easement Reservation, all for right-of-way purposes, and approving and authorizing the
recordation of said deeds in the Public Records of Miami -Dade County, Florida.
Background of Item:
The Department of Resilience and Public Works, through its continued efforts to secure
dedications of needed public right-of-way for widening of City streets, has received
seven (7) Right -of -Way Deeds of dedication and an Amended and Restated Right -of -
Way Deed subject to Subterranean Easement Reservation, proffered by various
entities, all pursuant to Section 54-58 of the City Code.
The Department has reviewed the deeds and has received legal counsel concerning
said Resolution, and has determined that it is now in order for acceptance by the City
Comm ission.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING SEVEN (7) RIGHT-OF-WAY DEEDS OF DEDICATION AND AN
AMENDED AND RESTATED RIGHT-OF-WAY DEED SUBJECT TO SUBTERRANEAN
EASEMENT RESERVATION ("DEEDS"), AS DESCRIBED IN EXHIBIT "A,"
ATTACHED AND INCORPORATED, FOR RIGHT-OF-WAY PURPOSES; APPROVING
AND AUTHORIZING THE RECORDATION OF THE DEEDS IN THE PUBLIC
RECORDS OF MIAMI-DADE COUNTY, FLORIDA; FURTHER DIRECTING THE CITY
CLERK TO RETAIN A COPY OF THE DEEDS.
WHEREAS, the City of Miami's ("City") Department of Resilience and Public Works
("Department") recommends the acceptance of seven (7) Right -of -Way Deeds of Dedication
and an Amended and Restated Right-of-Wat Deed subject to Subterranean Easement
Reservation ("Deeds"), for the properties described in "Exhibit A," attached and incorporated;
and
WHEREAS, the Deeds have been submitted pursuant to Section 54-58 of the Code of
the City of Miami, Florida, as amended ("City Code"); and
WHEREAS, the Amended and Restated Deed Subject to Subterranean Easement
Reservation restates and amends a right-of-way deed previously submitted to the City and
recorded in public records of Miami -Dade County, Florida on September 15, 2022 in Official
Records Book 33384 at Page 2749 solely in order for the property located at approximately 225
and 233 North Miami Avenue to retain, in their present locations, certain underground pilings
and piers; and
WHEREAS, the Department finds it is in the best interest of the City to accept the Deeds
pursuant to Section 54-58 of the City Code;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized and directed to accept the Deeds for the
properties described in Exhibit "A," attached and incorporated, for right-of-way purposes.
Section 3. The City Commission authorizes' the recordation of the Deeds in the Public
Records of Miami -Dade County, Florida.
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
Section 4. The City Clerk is directed to retain copies of the Deeds.
Section 5. This Resolution shall become effective immediately upon its adoption.
