No 2010-01 by a vote of five to one (5-1) recommending APPROVAL of the Virginia Key Master Plan,

WHEREAS, the City of Miami ("City") recognizes the key role of parks in providing educational, 4
cultural, recreational, and other well-beingZ
programs to our citizens and visitors and in enhancing the CO
quality of life of our citizens: and ee:

WHEREAS, pursuant to Resolution No. 05-0606, adopted January 13, 2005, the City Commission 0)
authorized the City Manager to execute a negotiated Professional Services Agreement with the firm of cc,
Edward D. Stone, Jr. and Associates, Inc. d/b/a EDSA to provide a Master Plan for Virginia Key,
pursuant to the Request for Qualifications No 03-04-028 (the "RFQ"); and a
WHEREAS, the Miami Waterfront Advisory Board: at its meeting on October 5. 2009, adopted a 1
motion by a unanimous vote. to approve the Virginia Key Master Plan as presented with additions and E
inclusions; and r

WHEREAS, the City Commission, at its meeting on October 8, 2009, adopted a motion to defer the m
presentation and approval of the final master plan to the first City Commission meeting in May 2010 s-
and to (1) immediately allow a mountain bike facility on the North Point, (2) immediately move forward 2
with the remedietion of the landfill and utilize the 545 million in Miami -Dade County funds for same, 03
and (3) to ensure the Virginia Key Beach Park Trust has the flexibility to construct, operate, or maintain
the proposed Civil Rights Museum complex and any other facilities as the Trust may deem necessary, v

WHEREAS. the Miami Planning, Zoning and Appeals Board, at its meeting on July 21, 2010
adopted Motion No. 10-001 by a vote of eight to one (8-1) recommending APPROVAL with conditions:
1) No lighting in the playing field area. and 2) Public ramp to be provided with a minimum of thirty {30)
trailer parking spaces of the Virginia Key Master Plan;
NOW. THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI.

To accept the Virginia Key Master Plan as
presented with the following additions and
inclusions:
• Welcome Center on the Marine Stadium site and
restoration of Marine Stadium.
• A transportation plan to and from the Marine
Stadium, Park and Passive use areas.
• No Hotel or Hotels on site.
• Inclusion of one or two of the identified Boat
Ramps included in the Master Plan.
• Re- inclusion of the BMX and Mountain Bike
trails.
• Creation of an Implementation Committee.
• Cleaning up the landfill and examine possible
leaking from the site into the bay.
Proper remediation.
• Increase the buffer areas between nature areas
(Le. mangrove) and the proposed playing fields.
• Historic Virginia Key Beach continued restoration.

- along with all of us -- we all have to he vigilant about following the deed resn•icrions and,
again, the long-term jurisdictional board. Transportation is important because it would
complement the use of cars to the island We cannot imagine that access to the island will
forever be simply by virtue a f cars. We would need an island tram. We should address the
problem of sea level rise. Think of the causeway -- and this is a very inspirational bullet point --
as a scenic byway, which it teo- much already is. We need to enhance that, enhance vier
corridors, and environtnentalh sensitive water- taxi systems. We do need to watch aver the
manatee areas when we think of the water taxis. This is a slide that show -- in the yellow line is
a possible water taxi route that has been vetted with DERM (Department of Environmental
Research .Management). It shows multiple points from near Ba7side all the way south to the
Grove, but the notion is thaw to gel a water taxi system to the island and even beyond into Key
Biscayne would be, I think, very progressive- 1t is a long-term regional transportation issue- We
realise it will take a long time ro bring this forth We did not want it to be left unsaid The
magenta or fiichsia line is a bus route- There is an existing bus route. We just think maybe we
should increase thefrequency of buses to gain more access from a diverse community to the
island. Within the island we would suggest an internal transportation system of solar powered
trains. This will allow people access ro the entirety of the island. It also would be important if
we could negotiate a way that the train could get from the area in fr•or,r of the stadimn to Arthur-
Lamb Road without entering the Rickenhacker Causeway, and that would be perhaps if they
could use a slip of the parking area .for the ;i•L lST 4raderny. If we go back then, we really have
already covered the region labeled six and eight and two and seven. And so, for the rest of the
presentation, we're going to.fucus on the North Point, which is the area labeled number three;
the Shrimpers Lagoon, the area labeled number .five, the landfill area, which is labeled number
loin.; and the Marine Stadium and irs basin, labeled number one. The North Point plan -- and
there are a member of parts of this plan that are, specially the North Point and the Shrimpers
Lagoon area, really are ah•eadu again highly sensitive, beaten id environmental areas, and we
want ro have vet} little impact there. We do not want a plan that densijies and intensifies
fee -tot -Wes where. So the .North Point plan, as a result of a series of meetings and -- is already
being developed is ah-eadi underway. It's an area where there will be mountain biking. The
mountain biking will take place in the area called out as Zone Number One. Then there is a trail
-- so there are mountain hike trails that are actually being laid out because there's topography
there The topography is a result of bay bottom that has been brought there over the trans.
Then there's a trail around the perimeter of the ,Vorth Paint. Thai's a trail for walkers and
joggers and kind of slower _folks, let's say, not so extreme sport folks. They have veil beautiful
scenic views hack to the CO, so those triangular red cones are for views. There's an area
labeled 15 of low planting so as not ro ohsclne those bewailed views back to the City There's an
area for eco-camping, which is the light green number two. .4nd then u•e propose hammocks and
beach restoration throughout the rev with some foot bridges and there's a parking area with
biosnale and impervious material that runs vertically. It's number five, next to the treatment
plant. In other words, it's a place that celebrates the natural environment but lets people go
thee, with their mountain bikes and have fun. It's very important to the Urban Paradise Guild
and a number Mother environmental groups that there be buffers between different areas of
actia•tfy to protect the people an the trails that are just walking firm the people that are mountain
biking. The Shrimpers Lagoon area, we wanted again to include Jimbo's and the surrounding
beach, low -scale recreational amenities, promote ongoing habitat restoration. And there's a
wonder.lru1 job which the City and the County are doing together-. Juan Fernandez, from the City,
is slowly restoring all of these beaches in a program that he has that I'm sure you're aware of
but 1 want to sal it for the people who are watching. It's a really wonder//cl program that's kind
of happening quietly in the background and should be celebrated So this is the drawing for the
Shrimpers Lagoon. If you go down the list, you'll see that we're just encouraging the restoration
and improvement of existing facilities of the boat launch tvith canoe and kayak rentals; of
elevated boardhvalks, which are existing and need repair; of existing parking to he switched over
to bioswale:: and impervious parking, which is low carbon footprint and eco friendly: of beach
pavilions which already exist, again just to improve them; enhance public beach areas, which is
ongoing, because of the Juan Fernandez program that he's doing with DERM,- restoring the

working with DERM and the Aram' Carps of Engineer [sic] to look at the_ feasibility of building
the marina. If we do that, we believe that the -- o+r the investment would have there by us
running that Marina, not including any revenues from the garage at this point,- just from that, we
would have a 1 b percent return, syhich will he subs;antial. So we would have not only monies
that wound also help generate towards the general fund, btu also we would be able to with
monies that we could get from the RFP (Request for Proposals) on the MEC (Marine Exhibition
Center) and revenues from the garage to have further support of monies for the rebuild of the
Stadium itself So we strongly support this plan as a very _feasible project for as -

first thank Jorge, Hilario, Dr. Bush, Dade Heritage Trust, Friends of the [sic] Marine Stadium.
The community has come together not only to save the Marine Stadium, who was in danger of
being deneolished, but to save the whole Virginia Key. And we -- the Manager has specific plans
far marinas and -- but we are also working on the Marine Stadium renovation. There is o
winlov a here we could access funding for the renovation before December and we're working
on U. It's a possibility. We still have to come to the County with a feasibility plan in the next
now 12 month [sic]. So there is a real, real possibility that we could start the renovation of the
Afaring Stadium in several month [sic], less than a year, so it is because of the community. And
1 am so happy that this has changed completely from what it was before. And 1 understand that
past Aebninrstr'anon had their ideas al -what it should be, but I drink this is a -- the first teal plan
that has been crafted by the residents, by all the groups that care about environment and historic
preservation, lave fra. nature. So I'm veil• proud to have been part -- small part in this process.

largest nonprofit historic preservation organisation. And on behalf of Dade Heritage Trust, the
organi_ation which nominated and secured the historic designation of the Marine Stadium, thus
caving it ji-om demolition, and the organisation which has been pushing forward the initiative to
sae and restore this icon of modern architecture, we headily endorse this version of the
Virginia Key plan. The DHT (Dade Heritage Tr•(Istj trustees, Jorge Hernande: and Hilario
Candela and the L'MlUniversitr of t•liami) School al -Architecture and Don Worth, a DHT
trustee and coclrair of DHT's Friends of %lar•ine Stadium, have donated hiendr eds, even
thousands of hours to this endeavor This plan may not give everyone everything they want, but
it is ear efidly thought our, respectful of preserving green space and public access, and it keens
the Miami Marine Stadium as the centerpiece it so richly deserves to be. We urge your support

Tropical.4tedubon Society. Unfortunately, our director had to leave to go to another meeting,
but this is an issue that's of great importance to Tropical- We've been involved from the
beginning, and we're leery- proud to be part of the public planning coalition. I'd first of all like to
thank the Cin' far allowing the public to be a part of this process, far listening to us, and
allowing us to bring to you an iinpnveclplan. Anil, of course, I'd like to thank the UM studio
and all of the other residents and community organisations that have been a parr of this process
I'd like to share with /eau some of the things that we hope to see as this plan goes into the
implementation phase, as we hope it will. First of all, we'd like to see increased educational
opportunities. FVe're very eager to see a presence of the National Park service in the marine

basin area. We'd like to see an emphasis on restoration and conservation, which is a big part of
the .North Point area that t'ou saw in the plan. Wed like to see unproved signage in the critical
wildlife area, and we're very interested to see apublic• boar ramp in the marine basin area. This
is something that members of the public have spa en vcyty strongly about rtt all the clrarrettes and
meetings that we've had..4 few areas that we're concerned about: first of all, the landfill site,
ihch has been, of course, a seriously contentions issue. We believe ihat it needs to be
thoroughly cleaned and there needs to be a verb tbornugh evaluation before anything can move
for -yard. A recent study indicates that there is pollution linking fi•orn this area, so of course,
that's a serious public health concern. And of course, we isrrnt to make sure that there are no
lights during the tattle nesting season because this is, of course, a sensitive issue for wildlife.
We're concerned about the eater taxi system. We hope that the Cin- will work yen• closer- with
DFRRf and the Marine Animal Rescue Society to ensure that is no threat to manatees..411 in oil,

Treasrtre Coast Regional Planning Council. Id briefly like to read an e-mail (electronic) i sent
to the Corrxrrissiorr, to ,Mayor Diaz and the Commission in April of 2007. Yalu- Honor and
Commissioners, Miami is about to lose a structure unique in the world to what sorne misguided
individuals call progress. Throughout history great leaders have also been great visionaries- Is
there not one of you who has the vision la find a way to restore the Miami Marine Stadium to its
,former glory with nest- and innovated uses? Is there not one of you who can step ow of the
cookie -curter mold and demonstrate the qualities of a true leader; or is Miami destined to
become just another giant Wal-Mart Srrpercenter? Do something bold Save the stadium and
show the world how great ;tliarni can be. That was when the environment in the Commission
was to bulldoze everything. Thar was in 2007. 1 had the courtesy of a reply ;from ova people:

building consensus, doing the planning charretres, putting it together, they've created one oldie
most unique and outstanding plans i've ever had the measure of seeing, I'd like to commend all
of them on that work. The ingenuity, the creativio is brilliant. Finally, as someone who began
inboard hydroplane racing in the 1960s and for 20years was an officer or involved in Florida

every single public meeting, rt•hether our comments were welcome or not. And £ was the author
of the plan for the September- 2009 charrette, where I served as the facilitator for the Norih Point
and natural areas table. The plan you have before you represents fain- years of work, hundreds
ofciri:ens involved, thousands of hous. as you know And I really do appreciate that the City
Commissioners, especially Chairman Sarnoff and the Mayor-, have created this possibility-,- have
listened to the public- The North Point area is unique and it creates unique possibilities for
enyu•onmenral education and recreation in a natural setting. One of the elements that was part
of the consensus developed at the 2009 char t-etre was buffers far different areas ofhtanan use,
between those areas for safety and to create a more natural experience because the last thing a
hiker needs is to see a mowrtain biker or hear a mountain biker rushing by just a few yards
away- So 30-read wide buffers were mandated at that charrette and they should be included,
although they're not in the graphics- I've been assured by Enrique Nune_ that they will be
included in the narrative for the plan. The consensus that we developed at that chat-I•etre did
include the mountain biking community, who I personally incited, and so they have -- they were
in agreement with this concept- With regard to the boat ramps, that was another consensus item.
1 drink n-e all do need to reali:e, however, that this is also a regional issue And as our
population has gone up, our capacity has gone down, so we need to be thinking as a community,
as a County, as a City about this issue for long -terra planning. Finally, coning provides an
essential le: -el of protection for natural areas that does not currently exist. There is no :ening
code for parks. It's currently :opted as civic space. That, unfortunately, allows 5 percent of the
sin face area to be built with buildings. That does not include parking lots, walkways, tennis
courts, baseball diamonds, et cetera. What x•e need are multiple layers of protection, one for
city parks to provide thin capacity for us so thot we don"! hecorne a city full of couch potatoes.

extraordinary effort- And we do, however, have two issues that we would ask you to please
consider. (Inc. we could really like to see a boat rarnp included in the marina section with, von
know, £guess a minimum or spots. I think we've been -- we've heard that's feasible. Nye think
that 30 is better- than none. And one other little issue. we would recommend not creating athletic
fields on Virginia Key at all as -- we feel these facilities belong in neighborhoods where they're
;none accessible to most of the citizens of Miami. But f you do go ahead with creating athletic
felrils on the area designated by the coalition plan, please put no lights because they really could
harm the wildlife. And again, just -- we realty are happy about this coalition and the plan.

University of Miami. I'm very pleased to see this coalition plan come forward I've lived an Key
Biscayne in the '70s. 1 was active in issues regal -ding i• nginia Key, which included things like
Worlds Fair sites, gambling casinos- There's been a whole hodgepodge ()likings that didn't
represent the public interest, and I'm absolutely delighted to see that the City has embraced the
public planning process and has allowed this group to come together to coalesce and to bring
this to a conclusion. And I'm also glad ro see that there is interest in -- exercise in this. i was
instrumental in getting an extra lane put on each of the bridges during the rebuilding of the
Rickenbacker Causeway when the high bridge was put in. And so there is ample space. And so
where's been a teal growth in hiking, which is Wonder f t1 ro see, but it's gotten to a paint where we
;teed some additional control, And there is a bike path that's separated front traffic. It's not
large enough to accommodate the distance riders that use the place now, but there may be some
ability to schedule one lane on weekends for bicycles, or something like that, so that this
becomes not a source of hostility, but ()source of celebration that woe have all these people w•ho
ar•e n}'ing to remain physically fir. Thank you.

Sweeny_ 1 manage the Biscayne Bay Aquatic Preserves an behalf of the Department of
Envir•nnmental Protection. And sve manage 70.000 acres that run fv;n the headwaters ofOleia
Ravi. dawn to Cant Sound and Virginia Key is included in the BBAP (Biscayne Bat Aquatic
Preserves) boundaries. And 'just wanted to just bring a few topics to light- Overall, our• office
is really pleased with the plan and how it's developed. One thing that 1 wanted to just mention is
we are pleased with the public's appreciation and the Commission's appreciation for the Bill
Sadowski critical nil ill ife areas designation as our store's only marine critical wildlife area and
as such it's actually closed Of to the public. but we're excited that there's a visual access to the
bay through the observation deck, and maintaining the integrity of this boundary is really
critical- I also just wanted ro mention that we support the no lighting concept that was being
proposed in am• of the recreational fields that inav be constructed. Sea turtles frequently use not
only the aquatic preserve, bur also Biscayne National Park, which also abut Virginia Key, and
respecting the ecological inregrHn of the North Point, it should definitely be maintainer! We're
excited to have the Historic Miami rliarine Stadium in our preserve, and we'd like to rtist
encourage continue working with the City and others to ensure (hat any of the activities being
proposed have the least amount of environmental impact possible mowing forward The other
ilea that we wanted to express was the -- hitting on the water taxis_ Well, we definitely
encourage physical and visual access to the bay and being able to provide access to some of the
islands within Biscayne Bay, we want to make sure that some of the issues surrounding
water tat -is, such as increasing the amount of visits or travel inside ofBiscayneBay, particularly
in the areas that manatees frequent, is considered And lastly, sort of unrelated to the Virginia
Key ,ti faster Plan, but something rhat's important to the preserve is providing boaters access,
and we'd like to see the Dinner Key, otherwise knon•n as Seminole Boar Rwnp, be maintained as
environmental impacts are already occurring there, and proposing a new boat tamp elsewhere
would also introduce new environmental impacts.

The successful Proposer shall be required to plan,
design, permit and construct a public boat ramp and
floating dock on the Property to the northwest of
Miami Marine Stadium as an additional_component of
the Virginia Key Master Plan.
Vessels moored at wetslips shall be limited in size as
per applicable regulatory requirements. Marina shall
provide for a minimum of 648 dry storage racks.
Marina shall maintain the existing 190 wetslips and
build approximately 300 additional wetslips. The size
and number of any and all additional wetslips shall be
subject to all applicable rules and regulations,
including, but not limited to, zoning, permitting,
aquatic preserve limitations, and other regulatory
requirements.
The successful Proposer shall allow the NMMA boat
show event ("Boat Show") access and use of the
Property annually during the seven (7) days of the
Boat Show, inclusive of President's Day weekend.
The successful Proposer shall also accommodate the
Boat Show during the three (3) week set up period and
the two (2) week tear down period for a total not to
exceed six (6) weeks. This restriction shall be
coterminous with the Lease.
The successful Proposer shall enter into a cross -
access agreement with Specialty Restaurants
Corporation dlbla Rusty Pelican Restaurant ("Rusty

afforded and granted access to, over, and across the above -mentioned access road.
The Successful Proposer shall be required to plan_ design, permit and construct a
public boat ramp and floating dock on the Property to the northwest of Miami
Marine Stadium as an additional com onent of the Virginia Key Master Plan.
The Successful Proposer shall allow the National Marine Manufacturer's
Association (NMMA") boat show event {-Boat Show) access and use a portion
of the Property annually during the seven (7) days of the Boat Show, inclusive of
President's Day weekend. The Successful Proposer shall also accommodate the
Boat Show during the three (3) week set up period and the two (2) week tear down
period for a total not to exceed six (6) weeks. This restriction shall be coterminous
with the Lease for as long as the Boat Show is held at Virginia Key, even if the
Boat Show is held elsewhere but later returns to Virginia Key during the Lease
Term.
