A. REQUEST
Wynwood DC Propco LLC (the "Applicant") request an Exception pursuant to Article 4, Table 3,
Article 6, Table 13, and Appendix J, Wynwood NRD-1 regulations (the "NRD-1 Overlay"),
Section 4, Table 1 of Ordinance 13114 ("Miami 21 Code"), as amended, and per Chapter 4,
Sections 4-3, 4-5, and 4-7 of the City Code of Ordinances ("City Code"), as amended, and a
request for two (2) Exceptions for an Alcohol Service Establishment (ASE) exceeding 5,000
square feet and to permit this ASE to be open until 5:00 a.m. for the property located at 2217
NW Miami Court Avenue, Miami, Florida (the "Property").
B. RECOMMENDATION
Pursuant to Article 7, Section 7.1.2.6, of Miami 21 Code), as amended, the Planning Department
recommends Approval with Conditions pursuant to Article 4, Table 3, Article 6, Table 13, and
the NRD-1 Overlay, Section 4, Table 1 of the Miami 21 Code", as amended, and per Chapter 4,
Sections 4-3, 4-5, and 4-7 of City Code, as amended, and a request for two (2) Exceptions for an
Alcohol Service Establishment (ASE) exceeding 5,000 square feet and to permit this ASE to open

D. BACKGROUND
Site Location & Surrounding Uses
The Property is generally located at 2217 NW Miami Court and consist of approximately 31,528
square feet (0.7238 acres) of land with a built and operational hotel (the "Arlo Wynwood Hotel").
The Property is bounded by the following Thoroughfares: NW 23 Street to the north, N Miami
Avenue to the east, NW 22 Street, and NW Miami Ct, please see Figure 1. The surrounding
Uses are either Commercial or Industrial in nature, please see Table 1.
Request — Special Permit, Exception for an ASE
As part of the development of the Arlo Wynwood Hotel, the Applicant seeks to activate the
ground level with a proposed ASE with over 5,000 square feet of Floor Area. This request
triggers a Special Permit — Exception under the following three separate criteria:
1. Per Miami 21 Code, Article 4, Table 3 and the NRD-1 Overlay, an ASE is allowed by
Exception.
2. Per Miami 21 Code, Article 6, Table 13. ASE (T6), an ASE occupying more than 5,000
square feet of Floor Area shall require an Exception with approval by the City
Commission.
3. Per Chapter 4, Section 4-3 of City Code, the extension of hours from 3:00 a.m. to 5:00
a.m. is allowed by Exception as outlined in Section 4-7, which states pursuant to the
Miami 21 Code, all alcohol service establishments that require an Exception shall be
subject to approval by the Planning, Zoning & Advisory Board (PZAB), and when
required, final approval by City Commission. Furthermore, the Applicant's is requesting

the flexibility depending on demand for certain venues to open the ASE earlier for some
events. Therefore, the Applicant is requesting the full hours of operation allowed by
Code with our Exception 11: 00 a.m. — 5:00 a.m., Monday to Saturday and 12:00 p.m. —
5:00 a.m., Sundays, but closed during school hours to comply with Wynwood Cafe
Specialty District regulations.
Per Chapter 4, Section 4-7(a), the City approved the Applicant's Reservation Letter for a 4COP-
S or 4COP Quota located at 2217, 2233 & 2235 NW Miami Court within the Wynwood Specialty
District (PZ-21-11442).

Proposal — Arlo Wynwood Hotel - ASE on the ground level
The Arlo Wynwood Hotel is a nine (9) story mixed -use project fronting on NW Miami Court and
NW 22 Street, consisting of 217 hotel guestrooms and ground level commercial spaces for
retail, restaurants, including the Applicant's proposed ASE. The proposed ASE will span
approximately 6,202 square feet and will have a separate entrance located on the northeast
corner of the hotel building with all queuing occurring within the east side of the hotel building on
private property, please see Figure 2.

Miami Comprehensive Neighborhood Plan (MCNP)
The Miami Comprehensive Neighborhood Plan (MCNP) Future Land Use Map (FLUM)
designates the site of the project as General Commercial. Areas designated as "General
Commercial" allow all activities included in the "Restricted Commercial" designations. These

uses include commercial activities that generally serve the daily retailing and service needs of
the public, typically requiring easy access by personal auto, and often located along arterial or
collector roadways, which include: general retailing, personal and professional services, real
estate, banking and other financial services, restaurants, saloons and cafes, general
entertainment facilities, private clubs and recreation facilities, major sports and exhibition or
entertainment facilities and other commercial activities whose scale and land use impacts are
similar in nature to those uses described above.
The proposed Exception in this application to allow Commercial Use (Alcohol Service
Establishment) is aligned with "Objective LU-1.2:
"Promote, facilitate, and catalyze the redevelopment and revitalization of
blighted, declining or threatened residential, commercial and industrial areas
through a variety of public, private, and public -private redevelopment initiatives
and revitalization programs including, where appropriate, historic designations."
The proposed Commercial Use (Alcohol Service Establishment) is consistent with this objective
of encouraging the redevelopment and revitalization of blighted, declining or threatened
residential, commercial, and industrial areas outlined in the MCNP.
Miami 21 Code
The Miami 21 Code's Transect Zone for this Property is "T6-8-O", Urban Core Zone and the
Zoning Overlay NRD-1 (Wynwood NRD), please see Figure 3. This Transect Zone consists of
the highest Density and greatest variety of Uses, including the Commercial Use, Alcohol Service
Establishment.

Per Chapter 4, Section 4-3 of City Code, the extension of hours from 3:00 a.m. to 5:00 a.m. is
allowed by Exception as outlined in Section 4-7(c), which states pursuant to the Miami 21
Code, all alcohol service establishments that require an Exception shall be subject to approval
by the Planning, Zoning & Advisory Board (PZAB), and when required, final approval by City
Commission, based on demonstration of satisfaction of criteria listed in Section 4-7(b) of the
City's Code of Ordinances. Based on the Applicant's document, PZD-07, Operational Plan, the
Applicant meets the criteria as described below:

Criteria 1: Operational/Business plan. An operational/business plan that addresses hours of
operation, number of employees, menu items, business goals, and other operational
characteristics pertinent to the application.
Analysis 1:
• Hours of Operation: The Applicant plans to operate the establishment Monday -Saturday
11:OOAM-5:OOAM and Sundays 12:00 PM-5:00 AM The Applicant is requesting an
Exception for extended hours of operation as part of this application.
• Number of Employees: The Applicant anticipates that 35 to 40 employees will be employed
at the ASE which ensures sufficient personnel to support the ASE's operation.
• Menu Items: Food and drink items that include a specialty cocktail menu, will be provided
once finalized.
Finding 1: Complies
Criteria 2: Parking plan.
Analysis 2: The Arlo Hotel Wynwood and the herein proposed ASE, which is considered a
commercial use for parking purposes under Miami 21, comply with City of Miami parking
requirements. The Applicant obtained a shared parking reduction, a 30% reduction in parking
requirements due to being within 1/4 mile of a Transit Corridor, and paid into the Wynwood
Parking Trust Fund for 25 parking spaces, per the Warrant and Waiver Final Decision - PZ-19-
2742. The development complies with parking requirements of the Miami 21 Code by providing
72 parking spaces inside the building and 9 on -street parking spaces. As such, the 16 parking
spaces that are required for the ASE use and will be provided on site. All parking at the Property
will be valet operated based on the Applicant's document - PZD-20, Valet Parking Operations
Plan.
Finding 2: Complies
Criteria 3: For Alcohol Service Establishments proposing capacities over three hundred (300)
persons, an indoor/outdoor crowd control plan that addresses how large groups of people
waiting to enter the Alcohol Service Establishment and already on the premises will be
controlled. The establishment proposes a capacity of over 300 persons.
Analysis 3: The Applicant will be implementing a variety of security measures that will ensure
orderly queuing, sufficient security personnel, and other security measures to ensure proper
crowd control both internally and external of the ASE.

Criteria 4: A security plan for the alcohol service establishment and any parking facility.
Analysis 4: The Applicant will provide and monitor security cameras that will afford full
coverage of the interior and exterior of the venue. For security personnel, there will be a security
guard checking identification at the front door. Additionally, Applicant's bar and wait staff will
check identification to enforce patron age restrictions and maintain overall control.
Finding 4: Complies
Criteria 5: For alcohol service establishments proposing capacities over 300 persons, a traffic
circulation analysis and plan that details the impact of projected traffic on the immediate
neighborhood and how this impact is to be mitigated.
Analysis 5: As part of this application, the Applicant has provided a Traffic Study and Traffic
Circulation Analysis report, PZD-10, Traffic Study and Traffic Circulation Analysis.
Finding 5: Complies
Criteria 6: A sanitation plan which addresses on -site facilities as well as off -premises issues
resulting from the operation of the alcohol service establishment.
Analysis 6: The Applicant with be contracting with a sanitation removal company for the
removal of waste daily. Additionally, staff shall keep the outside premises of the ASE clean of
trash and litter.
Finding 6: Complies
Criteria 7: A plan depicting proximity of the proposed alcohol service establishment to
districts —residential.
Analysis 7: Based on the Alcohol Reservation Letter PZ-21-11442, there are no district -
residential within 500 feet of the Property.
Finding 7: Complies
Criteria 8: If the proposed alcohol service establishment is within 200 feet of any residential use,
a noise attenuation plan that addresses how noise will be controlled shall be required.
Analysis 8: The Applicant's proposed ASE is housed completely indoors. Sound engineers have
been contracted to design the interior and sound systems in a manner that ensures all noise will
be contained entirely within the ASE.

conforms to the applicable Miami 21 Code and found to be consistent.
Zoning Overlay
Pursuant to the intent of the NRD-1 Overlay, it is to is to establish a protective series of land
development regulations to transition the existing Wynwood Industrial District into an active,
diverse, mixed -use Neighborhood, that includes a variety of new Uses, such as the Applicant's
proposed ASE. Therefore, the project conforms to the applicable NRD-1 Overlay and is found to
be consistent.
NEIGHBORHOOD SERVICES
Pursuant to Article 7, Section 7.1.3.4 of the Miami 21 Code, the Planning Department has made
referrals to the agencies below:
• Office of Zoning
• Wynwood/Edgewater - Department of Human Service Neighborhood Service Center
• Office of Code Compliance
• Wynwood Design Review Committee
• Urban Design Division — Planning Department
• Transportation Division — Office of Capital Improvements
• Department of Solid Waste
• Fire Department
The comments and recommendations from the reviewing departments and agencies have been
considered and are reflect in this analysis.
G. FINDINGS
• The Property is in the MCNP's FLU designation "General Commercial" and Miami 21
• Code, "T6-8-O", Urban Core Zone.
• Based on the Applicant's A-03 Zoning Data, the ASE is approximately 6,202 sq. ft.
• Based on the Applicant's project file — PZD-1, Letter of Intent, the Applicant's hours of
operation for the ASE is Monday — Saturday, 11:00 a.m. - 5:00 a.m. and Sundays, 12:00
p.m. - 5:00 a.m.
• Number of Employees: The Applicant anticipates that 35 to 40 employees will be
employed at the ASE which ensures sufficient personnel to support the ASE's operation.

• Menu Items: The Applicant will sell or offer for sale alcoholic beverages for consumption
on the premises as a principal Use.
• Based on the Applicant's City -approved Warrant, Waiver - PZ-19-2742, PZD-8, the
Applicant obtained a shared parking reduction, a 30 percent reduction in parking
requirements due to being within'/4 mile of a Transit Corridor, and paid into the
Wynwood Parking Trust Fund for 25 parking spaces
• Based on the project file - PZD-9 the Applicant was granted 25 parking spaces per
"Permanent Off -Street Parking Certificate of Waiver".
• Based on the project file — PZD-18, the Applicant was granted three on -street parking
spaces on NW 22 St and seven on -street parking spaces on NW Miami Ct.
• The development complies with parking requirements of the Miami 21 Code by providing
72 parking spaces inside the building and nine on -street parking spaces.
• Per Miami 21 Code, Article 4, Table 4 (Commercial) the 16 parking spaces are required
for the ASE use are provided on Based on the Applicant's plan drawing — A-03, Zoning
Data.
• Based on the project file — PZD-20, Valet Parking Operations Plan (the "Valet Parking
Operations Plan") all parking at the Property will be valet operated, please see Figure 3.
• There will be no self -parking for guests and visitors at the Arlo Wynwood.
• Based on the plan drawing — A-05, Ground Level Floor Plan, the ingress/egress for the
Valet Parking will be located on the ground floor at the northwest corner of the Arlo
Wynwood Hotel.
• Based on the plan drawing — A-05, Ground Level Floor Plan, the Arlo Wynwood Hotel
management has partnered with the City of Miami and will purchase three spaces on
Miami court to be used as a valet ramp.
• For alcohol service establishments proposing capacities over 300 persons, an
indoor/outdoor crowd control plan that addresses how large groups of people waiting to
enter the alcohol service establishment and already on the premises will be controlled.
• Applicant will use a velvet rope to separate the line of persons waiting to access ASE
which will be entirely within the Applicant's private Property.
• ASE employees will monitor the line and, in the case of any queue overflow, divert the
line into lobby to not interfere with pedestrians.
• In connection with crowd control plan, security personnel will be adequately staffed
during all hours of operation.
• The Applicant will provide and monitor security cameras that will afford full coverage of
• the interior and exterior of the venue.
o For security personnel, there will be a security guard manning the front door and
checking identification.
o Parking facilities within the hotel are also monitored by security cameras covering
the entire floorplate and the hotel's security personnel will do routine walk-
throughs of the parking levels. Further, since all parking is valet operated the
Applicant anticipates that only employees will access the parking levels.

H. CONCLUSION
The proposed Alcohol Service Establishment Use allowed by Miami 21 Code, as amended,
and the City Code of Ordinances, as amended, and align with the goals and objectives of
the Miami Neighborhood Comprehensive Plan. The requested Exception complies with all
criteria and regulations set forth in Miami 21 and Chapter 4 (Alcoholic Beverages) of the City
Code.
Pursuant to Article 7, Section 7.1.2.6 of the Miami 21 Code, as amended, and Chapter 4
of the City Code of Ordinances, as amended, the Planning Department recommends
Approval with Conditions of the Exceptions as presented with the following conditions:
I. CONDITIONS
1. The proposed Alcohol Service Establishment shall be in accordance with the plans
entitled "A-04, Site Plan" as prepared by Donald F. Wolfe Jr., Architect Florida Reg. AR
009944 consisting of one (1) page and bearing the e-Plan approval stamp.
2. This Exception has been approved for an Alcohol Service Establishment with 6,202
square feet of floor area with a total capacity established in accordance to the City of
Miami's Building Department's codes and regulations established by the State of Florida
and Miami -Dade County governing the construction, alteration, and maintenance of
buildings and structures within the City of Miami for the protection of residents and
property.
3. It shall be unlawful to play or operate music boxes, jukeboxes, radios, musical
instruments or any other musical devices on or about the premises between the hours of
11:00 p.m. and 7:00 a.m. the following day, unless said music devices are played or
operated in a closed building and the sound is not audible from the outside of the
building so as to disturb the quiet, comfort or repose of persons in any dwelling, hotel or
other type of residence.
4. The Alcohol Service Establishment shall be limited to the following hours of operation:
Monday — Saturday, 11:00 a.m. - 5:00 a.m. and Sundays, 12:00 p.m. - 5:00 a.m.
5. Pursuant to Chapter 4, Section 4-5 of the City Code of Ordinances, as amended, shall
be closed during school hours.
6. Any noise generated onsite shall conform to Chapter 36 of the City Code noise
regulation.
7. Any concerns or complaints related to noise nuisance will be addressed and resolved
immediately.

8. Per Chapter 4 of the City Code, no loitering and/or drinking outside of the establishment
shall be permitted at any time.
9. This Exception is limited to the applicant, Wynwood DC Propco LLC. Any other entity
must be approved by the Planning Department and may require a new Exception.
10. The operation of this ASE is through a "Lease Agreement" between the Applicant (the
"Landlord") and the ASE Operator (the "Tenant"), and the Tenant will utilize its own
4COP-Quota license for the operation of the ASE.
11. The Applicant, owner, or successor shall comply with the requirements of all applicable
departments/agencies as part of the City of Miami building permit submittal process.
12. The Applicant, owner, or successor must meet all applicable building codes, land
development regulations, ordinances, other laws, including but not limited to contractual
agreements, and pay all applicable fees due prior to the issuance of any building permit.
13. The Applicant, owner, or successor shall meet the conditions all applicable local, state,
and federal regulations.
14. Any modifications to the approved plans as a result or consequence of the Applicant's
compliance with other departments and/or agencies and/or codes, shall require a new
review for approval confirmation from the Planning Director in accordance with Article 7
of the Miami 21 Code.
15. Pursuant to Miami 21 Code, Section 7.1.2.6(e) "an Exception shall be valid fora period of
two years during which a building permit or Certificate of Use must be obtained. This
excludes a demolition or landscape permit. A one-time extension, for a period not to
exceed an additional year, may be obtained if approved by the Planning Director."
16. Failure to comply with the conditions here in may result in the immediate revocation of
this Permit and shall be subject to any fines and penalties pursuant to City Code of
Ordinances, as amended.
