A RESOLUTION OF THE MIAMI CITY COMMISSION RESCINDING RESOLUTION
NO. 16-0303, ADOPTED ON JUNE 23, 2016, IN ITS ENTIRETY; AUTHORIZING
THE CITY MANAGER TO TAKE ANY AND ALL ADMINISTRATIVE ACTIONS
NECESSARY TO EFFECTUATE THIS RESOLUTION.
Background of Item:
The City of Miami adopted Resolution No. R-16-0303 on June 23, 2016 ("R-16-0303").
After careful consideration and analysis, it is determined that it is in the best interest of
the City to rescind R-16-0303 in its entirety.

A RESOLUTION OF THE MIAMI CITY COMMISSION RESCINDING RESOLUTION
NO. 16-0303, ADOPTED ON JUNE 23, 2016, RELATING TO FUTURE LEGISLATION
AND AMENDMENTS TO THE CITY OF MIAMI CODE, OR TEXT AMENDMENTS TO
THE MIAMI 21 CODE, SPONSORED OR CO -SPONSORED BY THE CITY
ADMINISTRATION, IN ITS ENTIRETY; ESTABLISHING A MORE STREAMLINED
PROCESS FOR AMENDMENTS TO THE CITY CODE, OR TEXT AMENDMENTS TO
THE MIAMI 21 CODE, SPONSORED OR CO -SPONSORED BY THE CITY
ADMINISTRATION; AUTHORIZING THE CITY MANAGER TO TAKE ANY AND ALL
ADMINISTRATIVE ACTIONS NECESSARY TO EFFECTUATE THIS RESOLUTION.
WHEREAS, the City of Miami adopted Resolution No. R-16-0303 on June 23, 2016,
relating to Future Legislation and amendments to the Code of Ordinances of the City of Miami,
Florida ("City Code"), or text amendments to the Miami 21 Code, sponsored or co -sponsored by
the City Administration ("R-16-0303"); and
WHEREAS, it is in the best interest of the City to rescind R-16-0303 in its entirety and
establish a more streamlined process for amendments to the City Code, or text amendments to
the Miami 21 Code, sponsored or co -sponsored by the City Administration;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated herein as if fully set forth in this Section.
Section 2. City of Miami Resolution No. 16-0303, adopted on June 23, 2016, is
rescinded in its entirety.
Section 3. The City Administration is directed to publish any amendment to the City
Code, or text amendment to the Miami 21 Code, sponsored or co -sponsored by the City
Administration, in the Future Legislation section of the City Commission agenda for one (1)
regular City Commission meeting prior to placing the proposed amendment on a subsequent
City Commission agenda for First Reading. Items placed in the Future Legislation section shall
require no action from the City Commission. The City Administration shall publish the full title of
the proposed amendment in the Future Legislation section.
Section 4. This Resolution shall not apply to amendments to the Miami 21 Zoning Map
or amendments to the Future Land Use Map of the Miami Comprehensive Neighborhood Plan.
Furthermore, the City Commission may waive the requirements of this Resolution by a four -
fifths (4/5ths) affirmative vote for an emergency ordinance in accordance with Section
166.041(3)(b) of the Florida Statutes or any other ordinance deemed to be in the best interest of
the health, welfare, or safety of the public.
Section 5. This Resolution shall not apply to amendments to the City Code or text
amendments to the Miami 21 Code proposed by any elected official who is the primary sponsor
of the amendment.
Section 6. The City Manager is authorized to take any and all administrative actions
necessary to effectuate this Resolution.
Section 7. This Resolution shall become effective immediately upon its adoption.
