PZ-20-8015 04/06/22 44, FLIEW C0�Q Site Location & Surrounding Uses The Property is located in the Highland Park neighborhood, west of the Southeast Overtown Park West (SEOPW) Community Redevelopment area, and Culmer Quadrant study area. The Property is within a Transit Oriented Development (TOD) area due to its proximity to the Culmer Metrorail Station and is situated along Northwest 7 Avenue a Transit Corridor. The Property is comprised of four parcels. The southernmost parcel is developed with a one-story duplex, the abutting parcel to the north has a one-story structure with a Commercial Use, and the two most northern parcels are vacant. The properties to the north and south are zoned "D1",to the west "D1"and "T6-8-O",and "T6- 12-0" to the east. Surrounding Uses include Transportation, Residential, Commercial, and Industrial. According to the American Community Survey (ACS), 5-year estimates (2015-2019), the Median Household Income for the Tract is $32,823, which is three -percent lower than the Median Household Income in the City of Miami, and it is 44-percent lower than the Area Median Income of $59,100. Approximately 20-percent of the population living in the subject Census Tract live below the poverty line. This is lower than the same statistic for every surrounding Tract, which have percentages of population living in poverty ranging from 23-percent to almost 50-percent. Most of the residents in this Census Tract also rent the homes in which they live (80.22 percent). The Median Rent in the area is $897. Concurrently, the Applicant proposes to amend the existing FLU to correspond to the Rezone request. The proposed FLU designation is Restricted Commercial is very similar to the existing FLU designation, Light Industrial, as they both allow for intense uses. However, the proposed FLU designation allows for greater density in its residential uses with a maximum density of 150 dwelling units per acre. Policy LU-1.1.10: "The City's land development regulations will encourage high density residential development and redevelopment in close proximity to Metrorail and Metromover stations." Policy HO-1.1.7: "The City will continue to control, through restrictions in the City's land development regulations, large scale and/or intensive commercial and industrial land development which may negatively impact any residential neighborhood and will provide appropriate transitions between high-rise and low-rise residential developments." The proposed Rezone allows for similar uses with the D1 to the north, T6-8-O to the west and south, and T6-12-0 to the east whether by Right or through the entitlement process to the. The major difference is the by Right Industrial Uses and the prohibited Residential Uses to the abutting D1 property. Furthermore, the Property is located within two blocks of the Culmer Metrorail station, which places it within a Transit Oriented Development (TOD) area. Per Article 4, Diagram 11, the Property can participate Historic Preservation Transfer of Development Density program established in Chapter 23 of the City Code of Ordinances. Participating in this program would allow for 132 units on site. Criteria 2 7.1.2.8.f.1.b. "The need and justification for the proposed change, including changed or changing conditions that make the passage of the proposed change necessary." Analysis for In 2019, the City of Miami's Planning Department began a Criteria 2 neighborhood -wide study of the area bounded by the Miami River, 836, and 1-95. This study was called 'Culmer Quadrants' (the "Study"). Based on their analysis, the Planning Department recommended approval for the rezone of Quadrant One. Staff found that the existing Future Land Use Map (FLUM) designation of Restricted Commercial accommodated the proposed zoning as the current designation is compatible with "T6-8-O". On September 24, 2020, pursuant to Miami City Commission Ordinance No. 13924, the Miami City Commission rezoned the parcels located in Quadrant One from "T6-8-L" Urban Core Transect Zone - Limited to "T6-8-O" Urban Core Transect Zone - Open. As such, these parcels were excluded from Rezone Application PZ-20-7526. The proposed Rezone for this Property from "D1 "to "T6-12-0", by the Applicant, provides them a way to circumvent participation in the City's Public Benefits Program for the benefit of a single applicant at the expense of the Public. The Miami 21 Code is intended to capture in instances precisely like this scenario, rather than rezoning to a higher transect "T6-12-0",the Applicant can capture additional development capacity for a "T6-8-O via participation in the public benefits. PZ-20-8015 Finding Criteria 2 In accordance with Article 7, Section 7.1.2.8 (f)(1)(b) of Miami 21 Code, the requested change in zoning to "T6-12-0"is consistent, however it is inconsistent with the findings of the Study. Alternatively, staff recommends that rezoning the site to "T6-8-O" is more appropriate for the proposed Rezoning. Criteria 3 Section 7.1.2.8(f)(2): "Achange may be made only to the next intensity Transect Zone or by a Special Area Plan, and in a manner, which maintains the goals of this Miami 21 Code to preserve Neighborhoods and to provide transitions in intensity and Building Height." Analysis Section 7.1.2.8(f)(2) establishes that changes shall occur in Criteria 3 succession, in which the zoning change may be made only to a lesser Transect Zone; within the same Transect Zone to a greater or lesser intensity; or to the next higher Transect Zone, or through a Special Area Plan. The proposed zoning change is consistent with the successional zoning change requirements stated in Section 7.1.2.8(a)(3). The proposed zoning change from "D1 "to "T6-12-0"is a change to the next higher intensity. However, to the west the Property abuts a neighborhood that was recently rezoned from "T6-8-L"to "T6-8-O". The request to rezone from "D1" to "T6-12-0" is inconsistent with the findings of the Planning Department's Study. Pursuant to Article 5, Section 5.6, Illustration 5.6, the proposed rezoning from "D1"to "T6-12-0"would allow the site to be developed with a maximum Height of 12 stories with a maximum benefit Height of eight -stories. The resulting potential 20-story development is not compatible with the Study whereby the Planning Department determined the appropriate height for the Quadrant is a maximum Height of eight -stories by Right with a maximum benefit Height of four - stories, allowing for a maximum of a 12 -story development. CONCLUSION Pursuant to Article 7, Section 7.1.2.8.(f)(2) of Miami 21 Code, the request to rezone is consistent with the Miami 21 Code in that it is successional; however, it is also inconsistent in that this request would not preserve the "T6-8-0"neighborhood to the west and contrary to the findings of the Planning Department's Culmer Study. While the property abutting to the east was recently rezoned from "D1" to "T6-12-0", Alternatively, staff recommends that rezoning the site to "T6-8-0"as more appropriate for the proposed Rezoning. Staff made a similar recommendation for the parcel located to the east that was rezoned from "D1" to "T6-12-0". However, that site was declared a brownfield and required environmental remediation to redevelop the site. The Miami City Commission found that the rezoning from "D1" — Work Place District Zone to "T6-12-0", Urban Core Transect Zone — Open, may increase the likelihood of redevelopment and subsequent remediation of the Property's contamination. The City of Miami received an Application for Rezone from Trendy Properties, LLC for an assemblage that is approximately 0.59 acres (25,708 square feet) located approximately at 1210, 1222, 1234, and 1250 Northwest 7 Avenue. The existing zoning for the Property is "D1" and with "T6-8-0" to the west, "D1" to the south and north, and "T6-12-0" to the east. The Property is comprised of residential, sales and commercial, and vacant properties. The Applicant has proposed to change the zoning to "T6-12-0". Staff found that the proposed request is not consistent with the Rezoning Criteria from Miami 21 Article 7, Section 7.1.2.8.f. Though the Property meets the requirements for rezone, changing the zoning creates an undesirable impact on the zoning and development patterns of the area. Staff recommends Denial of the requested rezone to "T6-12-0". Alternatively, staff recommends that rezoning the site from "D1"to "T6-8-0"is more appropriate for the Property, based upon the facts and findings in this staff analysis. The purpose of this letter is to submit the attached applications which seek to (a) amend the Future Land Use Map ("FLUM") designation under the Miami Comprehensive Neighborhood Plan ("MCNP") of the Properties from Industrial to Restricted Commercial; and (b) change the zoning of the Properties reflected in the Miami 21 Zoning Atlas from D1 to T6-12-0 (the "Applications"). The Properties are partially improved infill property located along the west side of NW 7th Avenue, between NW 12th and 13th Streets centrally located within the Highland Park neighborhood. The neighborhood is well defined, bounded by State Road 836 to the north, the Miami River to the south and west, and Interstate 95 to the east. See Attached Exhibit 1. NW 7th Avenue is the main north -south artery for the neighborhood; the Properties are located within two blocks of the Culmer Metrorail station and within a few minutes' drive of the Health District. The Properties are also close to east -west arteries such as NW 10th, NW 11th, and NW 14th Streets, which offer easy access to employment centers in Downtown and Edgewater. Miami Dade Transit bus service offer countywide accessibility from a stop directly in front of the Properties.' With such a central location and easy routes to major employment centers it is curious why the neighborhood continues to be characterized by under -development and under -investment. These seek to remedy that, by replacing industrial zoning that is neither compatible nor condu primarily residential neighborhood, with mixed -use development that will contribute to the fabric of the developing Highland Park. PZ-20-801 5 04/06/22 Together, the Properties measure approximately 27,600 square feet, or approximately 0.63 acres, and feature 250 feet of linear frontage along a single street, NW 7th Avenue. The frontage exceeds the minimum criteria of Article 7.1.2.8.c.1 of Miami 21 which renders the Properties eligible for rezoning. The requested rezoning to T6-12-0 complies with the successional zoning criteria of Section 7.1.2.8.a. and 7.1.2.8.f.2 of Miami 21. The Successional Zoning Table in Section 7.1.2.8.a.3 allows for successional rezoning of D1 properties to several potential T6 Transect Zones in order to yield the most coherent pattern given the established zoning patterns and context in the immediate vicinity. In this instance, the established zoning pattern is one of high density residential of moderate intensity with most of the properties in Highland Park already zoned T6-8. Growth patterns encouraged by the Planning Department recognize the need for a mix of uses and the lack of compatibility of industrial uses with this evolving residential, mixed -use neighborhood. Located directly on Highland Park's only local north -south artery, the T6-12-0 Transect Zone befits the residential, mixed -use context, and yields the most coherent zoning pattern for the neighborhood, concentrating a higher intensity on Highland Park's main street. Further, the Properties' close proximity to various mass transit opportunities and employment centers favors higher intensity in the neighborhood. In similarly compelling circumstances, the City Commission recently recognized the appropriateness of the T6-12-0 Transect Zone along NW 7th Avenue when it approved the rezoning of the property directly across the street from D1 to T6-12-0.3 The City has also previously supported other applications seeking a change from D1 to T6-12-0.4 The Applications are consistent with the goals and objectives of the MCNP by facilitating high density, mixed -use development near multi -modal public transportation and employment centers that will draw new residents to Highland Park, serve them with a mix of neighborhood commercial uses, and encourage increased Metrorail ridership and pedestrianism. The current industrial FLUM designation and zoning serves none of these purposes and fails to leverage the neighborhood's ideal location. Specifically, approval of the Applications furthers the following goals, objectives and policies of the MCNP: 1) Policy LU-1.1.7: Land development regulations and policies will allow for the development and redevelopment of well -designed mixed -use neighborhoods that provide for the full range of residential, office, live/work, neighborhood retail, and 2 Indeed there is a current effort, sponsored by the City, to amend the zoning of the portion of the neighborhood west of the Properties to provide for a greater mix of uses within the existing high density residential context. PZ-20-801 5 04/06/22 The proposed change to T6-12-0 will unlock a wider range of viable uses that are appropriate based for the location of the Properties. T6-12-0 will promote high -density residential, office and neighborhood commercial uses in close proximity to multiple modes of transit, employment centers, schools, and the Urban Central Business District. By locating the higher intensity along NW 7th Avenue within a couple of blocks from the Culmer Metrorail Station, development of the Properties under T6-12-0 will incentivize ridership on the Metrorail and the NW 7th Avenue Transit Corridor as an alternative to personal automobile use. As the neighborhood's most intense thoroughfare and the backbone of the area's automobile and bus transit network, NW 7th Avenue is the most logical place to locate additional height and intensity, as has been proposed directly across the street from the Properties. Consistent with one of Miami 21's core principles, T6-12-0 zoning for the Properties provides for transitioning, facilitating a step down in height and massing from NW 7th Avenue, to the lower height and intensity T6-8 neighborhood to the west. The current Light Industrial designation and D1 zoning do not advance the policies of the MCNP and Sections 7.1.2.8.f.1(b) and 7.2.2.8.c.2(g) of Miami 21. At present, the Properties are part of a strip of Light Industrial straddling NW 7th Avenue, which separates the residential portion of Highland Park from the South East Overtown Park West Community Redevelopment Area and Urban Central Business District. In the past, the Seaboard Coastline Railroad, which ran just east of the Properties, provided freight service to area warehouses and the Biscayne Chemical complex formerly located east of the Properties. The freight railroad is long gone now, and with it, the purpose and feasibility of industrial zoning in the area. Not surprisingly, portions of the Properties are vacant, and the others struggle to find viable long-term use. This has led to their underutilization and, given the neighborhood's ideal urban location, urgent need for change. With Culmer Metrorail Station located a mere two blocks from the Properties and highways defining the other boundaries, the neighborhood encompasses a narrow strip of underperforming industrial sandwiched by properties to the northeast offering institutional zoning, and properties to the west characterized by relatively few newer multi -family structures mixed in with a significant proportion of vacant lots (87 out of 215 properties). Entire blocks within the neighborhood are completely vacant, with others offering a hodgepodge of empty lots and underdeveloped low -density duplexes and single-family homes, remnants of a different time in the City's history. The wider area includes underdeveloped industrial and medium density residential properties to the south located with in the South East Overtown Park West Community Redevelopment Agency area, and the well - established low -density Spring Garden neighborhood further south and east, buffered from Highland Park by the Seybold Canal and Metrorail. By also promoting neighborhood - serving retail and office uses along the 7th Avenue corridor, the Restricted Commercial designation and T6-12-0 zoning will provide pedestrian -friendly options within Highland Park for residents, visitors, and non-resident employees of the nearby employment centers. New commercial uses and increased housing opportunities will also foster increased Metrorail ridership via Culmer Station and use of the NW 7th Avenue Transit Corridor. These factors firmly support a change from Light Industrial and D1 zoning that currently inhibits neighborhood revitalization, to a Restricted Commercial designation and T6-12-0 zoning that promotes high density, mixed -use development that leverages the neighborhood's central location and promotes use of the nearby Metrorail. Given their location along the main thoroughfare of Highland Park and within a short walk from Culmer Station, the Properties are situated at the epicenter of this valuable but underutilized City neighborhood.
