HomeMy WebLinkAboutR-23-0049City of Miami Resolution R-23-0049 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13013 Final Action Date: 1/26/2023 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S RECOMMENDATION AND FINDING, ATTACHED AND INCORPORATED AS EXHIBIT "A", THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI ("CITY"); WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A REVOCABLE LICENSE AGREEMENT ("AGREEMENT"), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, BETWEEN THE CITY AND LAW ENFORCEMENT & TECHNOLOGY FEDERAL CREDIT UNION, FOR USE OF APPROXIMATELY 1,016 PER SQUARE FEET OF OFFICE SPACE INSIDE THE MIAMI POLICE DEPARTMENT HEADQUARTERS LOCATED AT 400 NORTHWEST 2ND AVENUE, MIAMI, FLORIDA, FOR A MONTHLY USE FEE OF $1,862.67 ($22.00 PER SQUARE FOOT) INCREASING ANNUALLY BY $1.00 PER SQUARE FOOT, FOR AN INITIAL TERM OF FIVE (5) YEARS, AND AN OPTION TO EXTEND FOR FIVE (5) ADDITIONAL ONE (1) YEAR RENEWAL OPTIONS, WITH TERMS AND CONDITIONS TO BE MORE SPECIFICALLY SET FORTH IN SAID AGREEMENT; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER NECESSARY DOCUMENTS, INCLUDING AMENDMENTS AND MODIFICATIONS TO SAID AGREEMENT, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY TO EFFECTUATE THE USES CONTEMPLATED HEREIN. WHEREAS, Law Enforcement & Technology Federal Credit Union, formerly known as the United Police Federal Credit Union ("Licensee") has provided financial services to the City of Miami ("City") employees, their families and patrons since 1936, including at the currently location of the Police headquarters building, located at 400 Northwest 2nd Avenue, Miami, Florida ("Police Headquarters"); and WHEREAS, the City and Licensee wish to enter into a Revocable License Agreement ("Agreement") for the Licensee's continued use of 1,016 square feet of office space on the third floor inside the Miami Police Department ("MPD") Headquarters, to continue to provide financial services to City employees, their families, and patrons; and WHEREAS, the Agreement shall provide for a monthly use fee of $1,862.67 ($22.00 per square foot) increasing annually by $1.00 per square foot, for an initial term of five (5) years and an option to extend for five (5) additional one (1) year renewal options; City of Miami Page 1 of 2 File ID: 13013 (Revision:) Printed On: 6/26/2025 File ID: 13013 Enactment Number: R-23-0049 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Pursuant to Section 18-85(a) of the Code, by a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's written findings, attached and incorporated as Exhibit "A", that competitive negotiation methods and procedures are not practicable or advantageous, and waiving the requirements for said procedures, are hereby ratified, approved, and confirmed. Section 3. The City Manager is authorized' to negotiate and execute the Agreement, in a form acceptable to the City Attorney, between the City and Licensee, for use of approximately 1,016 per square feet of office space inside the MPD Headquarters building located at 400 Northwest 2nd Avenue, Miami, Florida, for a monthly use fee of $1,862.67 ($22.00 per square foot) plus pilot fees with annual increases, for an initial term of five (5) years with an option to extend for five (5) additional one (1) year renewal options, with terms and conditions as more specifically set forth in said Agreement. Section 4. This Resolution shall become effective immediately upon its adoption.
