Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), establishing a new
Special Revenue Project titled: "Miami Seatbelt Enforcement Project FY 2023;"
accepting a subgrant award from the Florida Department of Transportation ("FDOT") in
the amount of $85,000.00 ("Funds") with no matching funds required; appropriating the
funds to the Miami Police Department to provide resources to reduce seatbelt violations
for highway safety; authorizing the City Manager to execute the subgrant agreement, in
substantially the attached form, with FDOT; further authorizing the City Manager to
designate the Chief of Police or any other designee to negotiate and execute any and
all other necessary documents, all in forms acceptable to the City Attorney, in order to
implement the acceptance and administration of the subgrant award.
Background of Item:
The City of Miami ("City") submitted a grant application to the Florida Department of
Transportation ("FDOT") requesting funds in the amount of $90,000.00, to fund the
Miami Police Department's ("MPD") motor vehicle and highway safety initiatives to
combat incidents of seatbelt violations in the City ("Project"). The City received
notification that the application was approved for funding in an amount not to exceed
$85,000.00 ("Grant") for reimbursement of the Project's personnel and services. The
Grant will be used to continue MPD's efforts to decrease seatbelt violations, establish a
highway safety campaign to bring awareness to "305 Buckle Up", and enhance
enforcement efforts and deterrence capabilities to reduce seatbelt related fatalities in
the City. The implementation of the Project's cost will be allocated towards the
acquisition of magnetic highway visibility enforcement signs to be affixed to patrol cars,
personnel costs which will cover overtime salaries and benefits including those provided
pursuant to the Federal Insurance Contributions Act. The subgrant award will terminate
on September 30, 2023.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ESTABLISHING A NEW SPECIAL REVENUE PROJECT TITLED "MIAMI SEATBELT
ENFORCEMENT PROJECT FY 2023"; ACCEPTING A SUBGRANT AWARD FROM
THE FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT") IN THE AMOUNT
OF $85,000.00 WITH NO LOCAL MATCH FUNDS REQUIRED; APPROPRIATING
SAID FUNDS TO THE MIAMI POLICE DEPARTMENT TO PROVIDE RESOURCES
FOR MOTOR VEHICLE SAFETY INITIATIVES AND EDUCATIONAL CAMPAIGN TO
REDUCE SEATBELT VIOLATIONS AND INCREASE HIGHWAY SAFETY;
AUTHORIZING THE CITY MANAGER TO EXECUTE THE SUBGRANT AGREEMENT,
IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND
FDOT; FURTHER AUTHORIZING THE CITY MANAGER TO DESIGNATE THE CHIEF
OF POLICE OR ANY OTHER DESIGNEE TO NEGOTIATE AND EXECUTE ANY AND
ALL OTHER NECESSARY DOCUMENTS, ALL IN FORMS ACCEPTABLE TO THE
CITY ATTORNEY, IN ORDER TO IMPLEMENT THE ACCEPTANCE AND
ADMINISTRATION OF THE SUBGRANT AWARD.
WHEREAS, the City of Miami ("City") submitted a grant application to the Florida
Department of Transportation ("FDOT") requesting funds for the implementation of the Miami
Police Department's ("MPD") motor vehicle and highway safety initiatives and educational
campaign to combat incidents of seatbelt violations in the City ("Project"); and
WHEREAS, the City received a subgrant award from FDOT providing for approved
funding in an amount not to exceed $85,000.00 ("Grant") for reimbursements to the City for
equipment and expenditures by MPD to perform the Project's initiatives; and
WHEREAS, the Grant funds will be used by MPD to continue its efforts to decrease
seatbelt violations, establish highway safety by bringing awareness to the "305 Buckle Up"
campaign, and enhance seatbelt enforcement operations and deterrence capabilities intended
to reduce motor vehicle fatalities in the City; and
WHEREAS, upon implementation of the Project, the Grant will be allocated towards the
acquisition of magnetic highway visibility enforcement signs to be affixed to marked MPD patrol
units and reimbursement of overtime salaries and benefits, including those provided pursuant to
the Federal Insurance Contributions Act, for MPD officers assigned to the Project; and
WHEREAS, the subgrant agreement to accept Grant funds will terminate on September
30, 2023; and
WHEREAS, there are no matching funds required from the City for the acceptance of
this Grant;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The following new Special Revenue Project is established and resources are
appropriated as described below:
FUND TITLE: Miami Seatbelt Enforcement Project FY 2023
RESOURCES: Florida Department of Transportation
APPROPRIATIONS: MPD Highway Safety and Education

Section 3. The City Manager is authorized' to execute the subgrant agreement, in
substantially the attached form, between the City and FDOT.
Section 4. The City Manager is further authorized' to negotiate and execute any and all
other necessary documents, all in forms acceptable to the City Attorney, for the purposes stated
herein.
Section 5. The City Manager is authorized' to designate the Chief of Police or any other
designee to execute the necessary documents to implement the acceptance of the Grant with
no City matching funds required for the provision of magnetic highway visibility enforcement
signs, overtime reimbursement of MPD's members conducting enforcement initiatives to reduce
incidents of seatbelt violations and establishing a highway safety campaign.
Section 6. This Resolution shall become effective immediately upon its adoption
and signature of the Mayor.2

1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City of Miami Commission.
