Subject: Brownfield Property Designation Request - Richman PDGP
Purpose of Item:
The Richman Parkview Gables Development Partners LLC has requested a Brownfield
Area Designation for property that is located outside of the existing City of Miami
Designated Brownfield Area. Whenever a Brownfield Designation request is made
outside of the existing boundary, pursuant to Florida's Brownfield Redevelopment Act
Section 376.80, if the local government recognizes the property as a Brownfield, it shall
provide public notice and public hearings, and adopt a Resolution for vote in a final
hearing via City officials (Miami City Commission).
Background of Item:
The referenced lots owned by Richman Parkview Gables Development Partners LLC
are planned for redevelopment into a multifamily 120-unit 11-story building. Two of the
three lots sit vacant and are contaminated with arsenic and lead that likely occurred
from previous owners that operated an auto repair facility. The presence of this
contamination has obligated the current owners to conduct testing throughout the
property to delineate the extent. The contamination will also obligate the current owners
to implement engineering modifications to its planned development. The designation of
the lots as a Brownfield Area will facilitate incentives from the State of Florida that could
offset some or all of the expenditures occurred that are associated with the
environmental contamination.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
DESIGNATING THE PROPERTIES LOCATED AT 5601, 5615, AND 5645
SOUTHWEST 8 STREET, MIAMI, FLORIDA 33134 AS A BROWNFIELD AREA
WITHIN THE CITY OF MIAMI, FLORIDA, PURSUANT TO CHAPTER 376.80(2)(C),
FLORIDA STATUTES
WHEREAS, the Richman Parkview Gables Development Partners, LLC ("Richman") is
the owner of property located at 5601, 5615, and 5645 Southwest 8th Street, Miami, Florida
33134 ("Subject Property"); and
WHEREAS, the Subject Property is located outside of the existing City of Miami
Designated Brownfield Area Map, attached hereto; and
WHEREAS, although the existing City of Miami Designated Brownfield boundary does
not include the Subject Property, an individual Brownfield Area Designation can occur via
majority vote of the jurisdiction's governing body; and
WHEREAS, Richman has submitted the attached request to designate the Subject
Property as a Brownfield Area pursuant to Chapter 376.80(2)(c), Florida Statutes; and
WHEREAS, Miami Dade County Division of Environmental Resources Management
("DERM") records indicate the Subject Property is contaminated as a result of its historical uses;
and
WHEREAS, Richman's proposed redevelopment of the Subject Property for multifamily
residential use will require site rehabilitation as that term is defined at Chapter 376.79(19),
Florida Statutes, and thus environmental related expenses will be incurred for hiring of technical
and engineering assistance to provide strategy on conducting further Corrective Action, and
handling the disposal of contaminated soil encountered during redevelopment; and
WHEREAS, Richman is requesting the Brownfield Designation pursuant to Chapter
376.80, Florida Statutes, in which the State of Florida has facilitated incentives for voluntary
cleanup and redevelopment of contaminated property for entities that did not cause or
contribute to the contamination; and
WHEREAS, the City Commission has determined that the Subject Property has met the
criteria established at Section 376.80(2)(c)1-5, Florida Statutes, to be designated as a
Brownfield Area, specifically:
1. whether the applicant controls the property and has agreed to rehabilitate and
redevelop the Brownfield area;
2. whether the rehabilitation and redevelopment of the property will result in economic
productivity of the area;
3. whether the project is consistent with the local comprehensive plan and is a
permittable use under the City of Miami's ("City") land development regulations;
4. whether the applicant has complied with the procedures outlined in Florida's
Brownfields Redevelopment Act and has provided notice as required by law,
Sections 376.80(2)(c)(4) and 376.80(1)(c)(4)(b), Florida Statutes; and
5. whether the applicant has provided reasonable assurance that it has sufficient
financial resources to implement and complete the rehabilitation agreement and
redevelopment plan;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as fully set forth in this Section.
Section 2. The City Commission designates the Subject Property as a Brownfield Area
within the City pursuant to Section 376.78, et. seq., Florida Statutes, to be called the Parkview
Apartments Green Reuse Area.
Section 3. In accordance with the Brownfields Redevelopment Act, Section 376.80(1),
Florida Statutes, for Brownfield program administration processes, the City Manager is directed
to notify the Florida Department of Environmental Protection and the Miami -Dade County DERM
of the designation of the Subject Property as a Brownfield Area, and to undertake any other
necessary related procedures, notices, and requirements for said designation.
Section 4. The map of designated Brownfield sites and areas shall be updated to
include the Subject Property.
Section 5. This Resolution shall become effective immediately upon adoption and
signature of the Mayor

from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission
