A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
PURSUANT TO SECTION 29-B(C) OF THE CHARTER OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, RATIFYING THE INTERLOCAL
AGREEMENT FOR TEMPORARY CONSTRUCTION EASEMENTS RELATED
TO EMERGENCY 36 -INCH WATER MAIN ("INTERLOCAL AGREEMENT"),
AND GRANT OF EASEMENT ("EASEMENT AGREEMENT"), TO MIAMI-DADE
COUNTY, A POLITICAL SUBDIVISION OF THE STATE OF FLORIDA
("COUNTY"), FOR THE GRANT OF A TEMPORARY, NON-EXCLUSIVE
CONSTRUCTION EASEMENT, ON A PORTION OF THE CITY OF MIAMI
OWNED PROPERTIES ON WATSON ISLAND, IDENTIFIED AS 980
MACARTHUR CAUSEWAY (FOLIO NUMBER 01-3231-000-0030), FOLIO
NUMBER 01-3231-061-0040 AND THE SURROUNDING SUBMERGED LANDS,
MIAMI, FLORIDA (COLLECTIVELY THE "PROPERTY"), CONSISTING OF
APPROXIMATELY 1.513 ACRES, AS MORE PARTICULARLY DESCRIBED IN
EXHIBIT "A", ATTACHED AND INCORPORATED, FOR THE PURPOSE OF
CONSTRUCTION STAGING AND INSTALLATION OF A THIRTY-SIX (36) INCH
WATER MAIN, WITH AN AUTOMATIC REVERTER ONCE THE WORK IS
COMPLETED.
WHEREAS, the County, through the Miami -Dade Water and Sewer Department
("WASD"), operates and maintains the Miami -Dade County ("County") water and sanitary
wastewater systems; and
WHEREAS, the City of Miami ("City") is the fee simple owner of certain real properties
identified as 980 MacArthur Causeway, folio numbers 01-3231-000-0030, folio number 01-3231-
061-0040, and the surrounding submerged lands Miami, Florida (collectively the "Property");
and
WHEREAS, the County has requested two (2) temporary non-exclusive easements from
the City on the City's Properties based on the need to relocate its thirty-six (36) inch water main
that is in conflict with the Florida Department of Transportation's ("FDOT") Signature Bridge
Project by no later than February 1, 2023 ("Project"); and
WHEREAS, the thirty-six (36) inch water main serves as the primary water transmission
line for South Beach neighborhood and provides water supply to the downtown Miami area; and
WHEREAS, the two temporary easements are being granted to the County to implement
a project of a governmental agency or instrumentality in accordance with Section 29-B(c) of the
Charter of the City of Miami, Florida, as amended ("City Charter"); and
WHEREAS, once the County has completed the construction of the thirty-six (36) inch
water main, the County will automatically release all temporary easements; and

WHEREAS, in order to accommodate the relocation of the thirty-six (36) inch water main
the City has agreed to ratify the Interlocal Agreement and Easement Agreement attached and
incorporated as Exhibit A, thereby granting the two (2) temporary non-exclusive easements on
the City Property; and
WHEREAS, the permanent easement contemplated in the temporary easement will be
subject to City Commission approval at a later date.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated herein as if fully set forth in this Section.
Section 2. The interlocal agreement for temporary construction easements related to
emergency 36 -inch water main ("Interlocal Agreement"), and grant of easement ("Easement
Agreement") to Miami -Dade County, a political subdivision of the State of Florida, ("County"), for
a temporary, non-exclusive construction easement, on a portion of the City -owned properties on
Watson Island, identified as 980 MacArthur Causeway (folio number 01-3231-000-0030), folio
number 01-3231-061-0040 and the surrounding submerged lands, Miami, Florida (collectively
the "Property"), consisting of approximately 1.513 acres, as more particularly described in
Exhibit "A", attached and incorporated, for the purpose of construction staging and installation of
a 36-inch water main with an automatic reverter clause is hereby ratified.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
