City of Miami Resolution R-23-0012 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www. m iamigov.cam File Number: 12908 Final Action Date: 1/12/2023 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A HIGH INTENSITY DRUG TRAFFICKING AREA ("HIDTA") STATE AND LOCAL TASK FORCE AGREEMENT BETWEEN THE CITY OF MIAMI, ON BEHALF OF THE MIAMI POLICE DEPARTMENT, AND THE UNITED STATES DEPARTMENT OF JUSTICE, DRUG ENFORCEMENT ADMINISTRATION ("DEA"), IN SUBSTANTIALLY THE ATTACHED FORM, TO PARTICIPATE IN THE HIDTA GROUP 43 TASK FORCE FOR THE PURPOSE OF INVESTIGATING, DISRUPTING AND DISMANTLING INDIVIDUALS AND ORGANIZATIONS INVOLVED IN THE TRAFFICKING OF NARCOTICS AND DANGEROUS DRUGS IN SOUTH FLORIDA; FURTHER AUTHORIZING THE CITY MANAGER TO DESIGNATE THE CHIEF OF POLICE OR HIS DESIGNEE TO EXECUTE ANY OTHER NECESSARY DOCUMENTS, IN THE FORM ACCEPTABLE TO THE CITY ATTORNEY, IN ORDER TO IMPLEMENT THE ACCEPTANCE OF ANY REIMBURSEMENT FUNDS. WHEREAS, evidence exists that trafficking in narcotics and dangerous drugs exists in the South Florida area and that such illegal activities have a substantial and detrimental effect on the health and general welfare of the people of the State of Florida; and WHEREAS, in order for the governments of affected areas to continue their responsibility of investigating, disrupting and dismantling individuals and/or organizations involved in the trafficking of narcotics and dangerous drugs, it is necessary for participating governmental agencies to execute State and local task force agreements, as coordinated by the United States Department of Justice, Drug Enforcement Administration ("DEA"); and WHEREAS, the South Florida High Intensity Drug Trafficking Area ("HIDTA") Task Forces enhances the effectiveness of Federal, State and local law enforcement resources through a coordinated law enforcement initiative, which seeks the most effective investigative and prosecutorial avenues to obtain arrests, prosecutions and large asset forfeitures regarding individuals and organizations involved in drug trafficking offenses; and WHEREAS, the DEA and the City of Miami ("City") are authorized to enter into cooperative agreement with state and local law enforcement agencies to combat the use and abuse of controlled substances under the provisions of 21 U.S.C. § 873; and WHEREAS, a detective from the Miami Police Department ("MPD") will be assigned to the South Florida HIDTA 43 Task Force ("Task Force") to work in conjunction with Federal, State and local law enforcement personnel in identifying, locating and apprehending individuals who commit these crimes in the City and the Southern District of Florida; and City of Miami Page 1 of 2 File ID: 12908 (Revision: A) Printed On: 1/1812023 12908 Legislation SUB THIS DOCUMENT IS A SUBSTITUTION TO ORIGINAL. File ID: i2908 Enactment Number: R-23-0012 WHEREAS, during the period of assignment to the HIDTA 43 Task Force, the City will be responsible for establishing the salary and benefits, including overtime, of the officer(s) assigned to the Task Force, and for making all payments due to the officers; and WHEREAS, the DEA will, subject to the availability of funds, reimburse the City for overtime payments up to a yearly sum of approximately $19,840.25 per officer; and WHEREAS, the term of the HIDTA 43 Task Force Agreement will be in effect commencing on the date of execution through September 30, 2026; and WHEREAS, no matching funds are required from the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to execute the HIDTA State and Local Task Force Agreement between the City, on behalf of the MPD, and the DEA, in substantially the attached form, to participate in the HIDTA 43 Task Force for the purpose of investigating, disrupting and dismantling individuals and organizations involved in the trafficking of narcotics and dangerous drugs in South Florida. Section 3. The City Manager is further authorized' to designate the Chief of Police or his designee to execute any other necessary documents in order to implement the acceptance of any reimbursement funds. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 The herein authorization is further subject to compliance with a!I legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
