FOR SPECIAL EVENT PERMITS ISSUED FOR ART BASEL RELATED EVENTS BEGINNING NOVEMBER 29, 2022 AND ENDING DECEMBER 3, 2022. WHEREAS, pursuant to Section 62-521 of the Code of the City of Miami, Florida, as amended ("City Code"), titled "Temporary Events in General," temporary events are limited to no more than two (2) events per year per property for a maximum of two (2) weeks per permit; and WHEREAS, pursuant to Section 62-521(b)(4) of the City Code, the number of events can be waived upon affirmative vote of the City Commission; and WHEREAS, the properties located at 2534 North Miami Avenue, Miami, Florida, and the Virginia Key Beach Park Trust wish to host temporary events until 5 a.m. during Art Basel Week beginning November 29, 2022 and ending December 3, 2022; and WHEREAS, the City Commission wishes to authorize the City Manager to consider requests from other private property owners who seek a waiver of the two (2) events per year per property for a maximum of two (2) weeks per permit pursuant to Section 62-521 of the City Code, and host temporary events up to 5 a.m., during Art Basel Week beginning November 29, 2022 and ending December 3, 2022 as may be approved by the City Manager in his sole discretion; and WHEREAS, the proposed temporary events at the above location will be beneficial to the City's residents; and WHEREAS, the events will require permits to be issued by the City of Miami ("City") to ensure life -safety and quality of life issues and appropriate conditions may be imposed on each permit; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA. Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Pursuant to Section 62-521(b)(4) of the City Code, the two (2) temporary event per year per property limitation is hereby waived to allow the property at 2534 North Miami Avenue, Miami, Florida and the Virginia Key Beach Park Trust to host temporary events during Art Basel Week from November 29, 2022 and ending December 3, 2022 until 5 a.m. the following morning. Section 3. The City Manager is authorized' to evaluate any special events permits issued by the City for Art Basel related events for purposes of independently providing a waiver of the two (2) temporary event per year per property limitation provided in Section 62- 521(b)(4) of the City Code, and further authorized,1 at his sole discretion, to extend the limitation up to 5 a.m. for special event permits issued by the City for Art Basel related events beginning November 29, 2022 and ending December 3, 2022. Section 4. This Resolution does not waive any other requirements of the City Code, including but not limited to, applicable fees, inspections, and permits. Section 5. This Resolution shall become effective immediately upon its adoption.
