Hannon, City Clerk FROM: Victoria Mendez, City Attorney S A 6- for DATE: November 21, 2022 RE: Resolution No. R-22-0462 — Authorize Amendment No.1 — Mutual Aid Agreement with Miami -Dade County File No. 12848 At its November 17, 2022 meeting, the City Commission adopted the above referenced agenda item, RE.9, authorizing the City Manager to execute Amendment #1 to the Mutual Aid Agreement between Miami -Dade County and the City of Miami for Voluntary Cooperation and Operational Assistance, providing for special provisions for concurrent jurisdiction and the creation of "Joint Enforcement Zones" for the enforcement of quality of life violations pursuant to the Mutual Aid Act, Chapter 23, Part 1, of the Florida Statutes. The item inadvertently published with an incorrect description of the effective date. The Legislation has been corrected and incremented to Revision A. WHEREAS, it is the responsibility of the governments of the City of Miami ("City") and Miami -Dade County ("County") to ensure the public safety of their citizens by providing adequate levels of police services to combat criminal activity; and WHEREAS, other related and ancillary "quality of life" crimes expose the residents, visitors, and business owners of in our community of serious health and safety risks; and WHEREAS, the City and the County previously entered into a Law Enforcement Mutual Aid Agreement between the County and the City for Voluntary Cooperation and Operational Assistance ("Agreement"); and WHEREAS, the City and the County have authority under the Florida Interlocal Cooperation Act of 1969, Section 163.01, Florida Statutes, to enter into ierlccal agreements to jointly exercise any power, privilege, or authority which they stare Fared which each might exercise separately; and fa 7-7; WHEREAS, the City and the County have authority under the Mut O: Aicje ct, Chapter 23, Part 1, Florida Statutes, to enter into mutual aid agreements; arfH WHEREAS, it is in the best interests of the community to amend` fife exjstin�"' Agreement to provide for the special provision of concurrent jurisdiction and the creation of "Joint Enforcement Zones" to combat quality of life violations ("Amendment #1")and WHEREAS, the provisions of Amendment #1 to the Agreement shall take effect upon execution and approval by the City and the County; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized to execute Amendment #1 to the Mutual Aid Agreement between the County and the City for Voluntary Cooperation and Operational Assistance, in substantially the attached form, providing for special provisions for concurrent jurisdiction and the creation of "Joint Enforcement Zones" as specified therein to allow for the enforcement of quality of life violations pursuant to the Mutual Aid Act, Chapter 23, Part 1, of the Florida Statutes. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
